Auction Terms & Conditions Acceptance of Terms: Buyers registering for and using Hessney bid number card and or absentee/phone bid form agree to the following Terms of Sale:

ONLINE AUCTION ENDS: Saturday, January 28, 2023 starting at 10AM
** This is a staggered CLOSING. This means the auction will begin to close at 10AM with 20 seconds between each lot. The closing time of each lot will be entended automatically an additional 2 minutes when there is active bidding.

LIVE IN PERSON PREVIEW: Friday, January 27th, 2023, 2:00-5:00 pm at Hessney Auction Center.

- PAYMENT: We will run the Credit Card you register with after the completion of the auction.

* All buyers will be charged 13% buyers premium regardless of payment type. and 7.5% NYS sales tax if you are a NY buyer. If you are tax exempt you must send us a copy of your resale certificate PRIOR to auction closing, once cards are ran we cannot refund sales tax.

PICK UP: Please be aware of pick up days and pick up at those times, we need items to be removed during these times so we can set up more auctions.

ALL FIREARMS - by Appointments only. You will be emailed a sign up link with your invoice after the close of the entire auction.
ALL AMMO/ACESSORIES: No appointment is needed.

** Semi-Auto Rifles: Any purchase of a semi-auto rifle in NYS requires a permit, please call your specific county for more information. Out of state residents purchasing a semi-auto rifle, we can ship to an FFL in your state, however you cannot pick up in person in NY without this permit,

*Shipping is available on most items. Please refer to each individual lot to determine if it will be shipped. Please email after auction to request with your Name and Address.

SHIPPING INSURANCE: Hessney Auction Company ships via USPS and UPS with Insurance on items over $100 at the cost of the buyer through the outside company Easy Post. If you item(s) are lost/damaged, all claims MUST be made through Hessney Auction Company within 30 days of shipment. If a claim is made independently of Hessney Auction Company, all insurance is voided, and we cannot make an additional claim on your behalf. If a claim must be made, please email us and we will provide you with a detailed list of what must be included in order for us to submit it to our carrier.

No Charge for NICBC (Background) Checks

* If you fail your background check you will NOT get a refund, you can consign it to a future auction.

*NOTE: New York State law requires that a National Instant Criminal Background Check must be completed prior to all firearm sales or transfers, including sales or transfers of rifles or shotguns. The sale of transfer of a firearm, rifle or shotgun at a gun auction without first conducting a Background Check is a crime.

** If you are tax exempt you MUST notify us prior to the close of the auction, along with a copy of the form, if not you will be charged tax. We cannot remove tax once the card has been processed.

If you would like your items shipped please contact our office as soon as possible with shipping information, including your FFL (If required) Any item deemed to large to ship in house will be brought to the UPS Store at your expense.

All Ammo is shipped via UPS - no Ammo can be shipped to a NYS resident but can be shipped to an FFL near you.

* We do NOT ship powder or primers or mounts

Everything is sold AS IS. WHERE IS. All Sales are Final- No Returns.
Hessney Auction Co. provides ample opportunity for buyers to thoroughly inspect goods to be sold. All purchases should be made on the buyer's own recognizance. All persons bidding in absentee who have not physically inspected the goods prior to the sale are also subjected to these terms. All lots are sold "As is". There are no warranties expressed or implied, including, but not limited to warranties of merchantability or fitness for a particular purpose. Hessney Auction Co. and consigners make no guarantee or warranty as to the authenticity of the merchandise, the correctness of the catalog, nor shall any description (oral or written) of condition, size, quality, rarity, importance or provenance be deemed a guarantee.

* Condition is listed with obvious flaws, or noted if firearm are new, unfired in box. "As New" does not mean "New" it is a condition report, meaning the firearm is "as new condition". If a firearm is brand new- unfired, it will be listed as so.

* Box Lot Ammo- Please be sure to review photos & full descriptions for box lot ammo, all is sold as is. In person preview is available. Box lot ammo may contain mixed, partial or full boxes and is sold as is. The lot descriptions are meant merely as a guide and we do not guarantee the counts or descriptions described therein. We make every effort to accurately describe all items, but there is the possibility of error. Hessney Auction Company is not responsible for any errors or omissions in the description of merchandise. Buyers Premium:
All sales are subject to a Buyer's Premium; reference to the buyer's premium is made in auction advertisments, flyers and catalogs. Buyer's premium will be a stated percentage and must be paid by the buyer as part of the purchase price.

* This is a public auction and not a retail setting. All sales are final. No returns or chargebacks are accepted.
* NO CHARGEBACKS< You agree to all terms & conditions when registering and placing all bids. It is the buyer responsibility to pick up or set up shipments.

* Some items may be sold per peice. The bid price is multiplied by the amount of items in the lot. This is shown on the catalog using the bid price x quantity. (Example "$12.50 x 4" equals a total bid of $50.00)
