THE FOLLOWING TERMS & CONDITIONS APPLY TO THIS SALE:
Definitions:
A. As used herein the term BID PRICE means the price at which a lot is sold to the purchaser and the term PURCHASE PRICE means the aggregate of (a) the bid price, (b) THE BUYERS PREMIUM PAYABLE BY THE PURCHASER EQUAL TO 20% OF THE BID PRICE and applicable local and state sales tax.
B. BUYER, YOU or PURCHASER may be used interchangeably in these Terms, and is the individual or their legal representatives who is a bidder in Treasure Quest Auctions sales, and are the designated winner or buyer of a lot or lots.
C. TREASURE QUEST AUCTIONS, LLC - TREASURE QUEST AUCTION - TQA - WE- or - US, individually and collectively refer to the same entity and may be used intermittently in the terms of the sale.
1. This is a live sale with sequential closing on all lots. Absentee bids are accepted before the sale by Treasure Quest Auctions and will be executed by Treasure Quest Auctions accordingly on behalf of the absentee bidder(s). At the closing of each lot offered in the sale, the highest bidder shall be deemed to have purchased the offered lot in accordance with all of the conditions set forth herein and thereafter (a) assumes full risk and responsibility for the lot purchased, and (b) will pay the purchase price in full plus applicable premium and taxes for all lots purchased. The placement of a bid in this sale shall constitute acceptance of all terms and conditions stated herein.
2. We accept absentee or left bids in advance of sale. In-house purchases by check, cash or money order will be subject to a 15% buyer?s premium. All other purchases are via Live Auctioneers LivePayments only. We do not utilize a credit card processing terminal in-house. In the event identical bids are submitted for a lot, the earliest submitted bid will take precedence. It is our intent to execute your left bids faithfully and promptly, however, we assume no responsibility for failure to execute a bid or bids for any reason whatsoever.
3. Auction Estimates - We furnish pre-sale estimates for all lots included in the catalog. These are intended as an approximate guide to our opinion of current market value. The final accepted bid price may be above or below the estimates provided.
4. The buyer of any letter or document does not receive any copyright ownership.
5. No lot may be transferred to buyer prior to completion of payment for the item(s).
6. Each sale made pursuant to the conditions of sale will be deemed to constitute a grant of a security interest by the buyer to us (and we may retain as collateral security for the purchaser's obligations to us), any of the purchaser's property in our possession, and we may apply against such obligations all monies held or received by us for the account of, or owing to, the buyer.
7. Should a buyer who is not paying via LivePayments, but by check, cash or money order, pay only a portion of the total purchase price for one or more lots won (including premiums and/or taxes), we may apply such payment(s), in our sole discretion, to the lot(s) we choose that will be released to the buyer. Payment will not be deemed made in full until we have collected all amounts due in cash, or secured funds represented by cleared checks, cashier checks or money orders.
8. If the foregoing conditions or any other applicable conditions herein are not met by purchaser with, in addition to other remedies available to us and the consignor by law, including but without limitations, the right to hold the purchasers lot(s) liable for the purchase price, we at our option may either (a) cancel the sale, retaining as liquidated damages all payments made by purchaser, or (b) resell the property, either publicly or privately, and in such event the purchaser shall be liable for the payment of any deficiency PLUS all costs and expenses of both sales incurred by TQA, including payment of our commission at our standard rates, all other charges due hereunder, attorney's fees and incidental damages.
9. All items are sold "as is". All statements contained in the catalog or in any bill of sale, invoice or elsewhere as to period, culture, source, origin, measurements, quality, rarity, provenance, importance, exhibition and literature of historical relevance or physical condition are qualified statements of opinion and not representations or warranties. The buyer hereby accepts the benefit of the consignor's warranty of title and other representations and guarantees made by the consignor for the purchaser's benefit. The purchaser expressly acknowledges and agrees that in no event shall TQA be liable for any damage including, without limitation, any compensatory, incidental or consequential damages in the event of any omission or error on our part.
10. We reserve the right to withdraw any property at any time before the actual sale.
11. If any dispute arises after the sale, our sales records shall be conclusive in all respects. If we are prevented by fire, theft or any other reason whatsoever from delivering any property to the purchaser, our liability shall be limited to the sum actually paid by the purchaser and shall in no event include any incidental or consequential damages.
12. We try to accurately describe every item in the sales catalog. Lots offered in our sales are used and may show signs of age and use consistent with the objects use and function. We strive to be accurate in our descriptions but errors or oversights may occur. Substantial defects to a lot are noted. However, minor defects may not be noticed or mentioned. If any substantial defect not described in the catalog is found, the purchaser has 24 hours from pickup, or delivery, to notify TQA of the concern. This is not an approval sale. TQA will assess your concerns and will render a decision as to whether a refund, whether partial or whole, will be provided at our sole discretion. Any return for any reason other than authenticity of the lot (i.e., not a facsimile or modern reproduction) is at our sole discretion. All items are sold as-is, where is, at time of sale.
13. These Conditions of Sale shall bind the successor and assigns of all bidders/buyers and inure to the benefit of our successors and assigns. No waiver, amendment or modification of the terms hereof shall bind us unless specifically stated in writing and signed by us. If any part of these Conditions of Sale is for any reason found to be invalid or unenforceable by a court of competent jurisdiction, the rest shall remain valid and enforceable in accordance with the laws of New York State.
14. Shipping: All property may be shipped at the buyer's expense, or otherwise picked up in person or by the buyer and/or their authorized representative upon completion of the purchase terms. TQA utilizes LiveShipping to manage shipment of your items. If buyer would prefer not to utilize the shipping partner assigned to TQA, the Buyer is encouraged to make arrangements for a reputable commercial shipper to pack and ship their purchase(s), and is responsible to contact their shipper of choice to make arrangements for pickup of their items (upon successful completion of all payment terms).
Final Term applicable to this sale:
* All lots that are not being shipped must be picked up within a 21 day period (3 weeks) following the conclusion of the sale. We do not have much extra space and removal of your purchases helps us bring in the next round quickly. Should extenuating circumstances prevent you the buyer from being able to meet this requirement, please contact Treasure Quest Auctions to discuss possible alternative arrangements.
Failure to contact Treasure Quest Auctions to schedule a pickup within the three week period post sale will result in FORFEITURE of your item or items, without refund, regardless of circumstance. We have enough to do and managing your personal affairs with reminders and follow-ups is not our responsibility. As the buyer, it is your sole responsibility to follow through on obtaining your item(s).
IF, extenuating circumstances may prevent your ability to pick-up your purchase(s), AND you have contacted us before the 21 day period expires, we will try to work with you at our discretion to hold your purchases beyond the three week period, however, a storage fee of $5 per day, per lot, will be assessed and will be payable in full at time of your pick-up before the item(s) are released to you. There is limited space available at our Auction Hall and we are unable to provide long term storage. Again, items not picked up within the prescribed time frame will be subject to forfeiture as unclaimed, and no refund of any kind will be due.
TQA has partnered with LiveShipping to handle your shipping needs for this sale. Follow the instructions within the sale to request a shipping quote from them prior to end of sale.
