THE FOLLOWING TERMS & CONDITIONS APPLY TO THIS SALE:
Definitions:
A. As used herein the term BID PRICE means the price at which a lot is sold to the purchaser and the term PURCHASE PRICE means the aggregate of (a) the bid price, (b) THE BUYERS PREMIUM PAYABLE BY THE PURCHASER EQUAL TO 22% OF THE BID PRICE and applicable local and state sales tax.

B. BUYER, YOU or PURCHASER may be used interchangeably in these Terms, and is the individual or their legal representatives who is a bidder in Treasure Quest Auctions sales, and are the designated winner or buyer of a lot or lots.

C. TREASURE QUEST AUCTIONS, LLC - TREASURE QUEST AUCTION - TQA - WE - or - US, individually and collectively refer to the same entity and may be used intermittently in the terms of the sale.

1. This is a live sale with sequential closing on all lots. Absentee bids are accepted before the sale by Treasure Quest Auctions and will be executed by Treasure Quest Auctions accordingly on behalf of the absentee bidder(s). At the closing of each lot offered in the sale, the highest bidder shall be deemed to have purchased the offered lot in accordance with all of the conditions set forth herein and thereafter (a) assumes full risk and responsibility for the lot purchased, and (b) will pay the purchase price in full plus applicable premium and taxes for all lots purchased. The placement of a bid in this sale shall constitute acceptance of all terms and conditions stated herein.

2. We accept absentee or left bids in advance of sale. In-house purchases by check, cash or money order will be subject to a 17% buyer?s premium. All other purchases are via Live Auctioneers LivePayments only. We do not utilize a credit card processing terminal in-house. In the event identical bids are submitted for a lot, the earliest submitted bid will take precedence. It is our intent to execute your left bids faithfully and promptly, however, we assume no responsibility for failure to execute a bid or bids for any reason whatsoever.

3. Auction Estimates - We furnish pre-sale estimates for all lots included in the catalog. These are intended as an approximate guide to our opinion of current market value. The final accepted bid price may be above or below the estimates provided.

4. The buyer of any letter, book or document does not receive any copyright ownership.

5. No lot may be transferred to buyer prior to completion of payment for the item(s).

6. Each sale made pursuant to the conditions of sale will be deemed to constitute a grant of a security interest by the buyer to us (and we may retain as collateral security for the purchaser's obligations to us), any of the purchaser's property in our possession, and we may apply against such obligations all monies held or received by us for the account of, or owing to, the buyer.

7. Buyers who purchase multiple lots, are required to pay for all lots we do not allow post-sale choice of what you prefer to have vs. what you competitively bid and won. (Post sale buyer's remorse is not a legitimate basis to negate your bids). Buyers who fail to pay in-house shipping costs within 10 days of our notice to you as to the shipping total forfeit the entire purchase, with no refund. In-house shipping is payable by Paypal invoice, checks or money orders only.

8. If the foregoing conditions or any other applicable conditions herein are not met by purchaser with, in addition to other remedies available to us and the consignor by law, including but without limitations, the right to hold the purchasers lot(s) liable for the purchase price, we at our sole discretion may either (a) cancel the sale, retaining as liquidated damages all payments made by purchaser, or (b) resell the property, either publicly or privately, and in such event the purchaser shall be liable for the payment of any deficiency PLUS all costs and expenses of both sales incurred by TQA, including payment of our commission at our standard rates, all other charges due hereunder, attorney's fees and incidental damages.

9. All items are sold "as is - where is" with no warranty express or implied. All statements contained in the catalog or in any bill of sale, invoice or elsewhere as to period, culture, source, origin, condition, measurements, quality, rarity, provenance, importance, exhibition and literature of historical relevance or physical condition are qualified statements of opinion and are not absolute factual representations or warranties. If buyer has any question regarding the legitimacy/authenticity or condition of any lot, please contact us or more importantly, come view it in person at the preview to satisfy your concerns. The buyer hereby accepts the benefit of the consignor's warranty of title and other representations and guarantees made by the consignor for the purchaser's benefit. The purchaser expressly acknowledges and agrees that in no event shall TQA be liable for any damage including, without limitation, any compensatory, incidental or consequential damages in the event of any omission or error on our part.

10. We reserve the right to withdraw any property at any time before the actual sale.

11. If any dispute arises after the sale, our sales records shall be conclusive in all respects. If we are prevented by fire, theft or any other reason whatsoever from delivering any property to the purchaser, our liability shall be limited to the sum actually paid by the purchaser and shall in no event include any incidental, wishful or consequential damages.

12. We try to accurately describe every item in the sales catalog. Lots offered in our sales are used and may well show signs of age and use consistent with the objects use and function. We strive to be accurate in our descriptions but errors or oversights may occur, we're human just like you. Substantial defects to a lot are noted. However, minor defects may not be noticed or mentioned. If any substantial defect not described in the catalog is found, the purchaser has 24 hours from pickup, or delivery, to notify TQA of the concern. This is not an approval sale. TQA will assess your concerns and will render a decision as to whether a refund, whether partial or whole, will be provided at our sole discretion. Any return for any reason other than authenticity of the lot (i.e., not a facsimile or modern reproduction not noted) is at our sole discretion and all return costs are born by the purchaser of the item(s). All items are sold as-is, where is, at time of sale.

Payments - Acceptable forms of payment for lot(s) purchased in this sale are (a) cash (In House Only), (b) cashier's check (c) personal check made to Treasure Quest Auctions, LLC (d) or credit card via Live Payments. We do not accept credit cards outside of Live Payments. All sales are final. No bid can be withdrawn at any time. All payment must be in U.S. dollars. All lots must be paid in full within 3 days of the auction close, or 3 days from the issuance of invoice by Live Payments / Treasure Quest Auctions.

If you have not contacted Treasure Quest Auction to arrange payment within 3 days of the time that our invoice is sent, you will be charged using the credit card you used to register for the auction for the amount of your invoice.

SALES TAX
Online purchases from Treasure Quest Auctions may be subject to sales tax. Please see the following for more details. If you are tax-exempt, you can submit your tax-exempt certificate to Live Auctioneers PRIOR to end of the sale to prevent the collection of tax. If you are tax exempt, and are picking up your items in-person, you must present a valid NYS sales tax certificate, tax certificates from other states will not be accepted as NYS does not reciprocate tax exemption status with other states.

13. These Conditions of Sale shall bind the successor and assigns of all bidders/buyers and inure to the benefit of our successors and assigns. No waiver, amendment or modification of the terms hereof shall bind us unless specifically stated in writing and signed by us. If any part of these Conditions of Sale is for any reason found to be invalid or unenforceable by a court of competent jurisdiction, the rest shall remain valid and enforceable in accordance with the laws of New York State.

14. Shipping: In-house shipping is available on many lots, at our sole discretion and is almost ALWAYS the cheapest option. You may also arrange your own shipping with various carriers at your discretion. We are a small auction house, depending on the volume of shipping requests it may take us 4 or more weeks to prepare your item(s) for shipping. Do not assume all items can be shipped by us. If there is any question as to whether TQA is able to ship your item in-house, you are encouraged to contact us no later than the day before the sale begins (Saturday) with that question. IF TQA determines the item, or item?s you wish to bid on would be best handled by an external shipper, we will advise accordingly and provide you with contacts for our local shippers that can serve your needs.

The buyer is encouraged to make arrangements for a reputable commercial shipper to pack and ship their purchase(s), and is responsible to contact their shipper of choice to make arrangements for pickup of their items (upon successful completion of all payment terms).

***PLEASE NOTE - TQA will invoice you for shipping via Paypal invoicing to your email of record with Live Auctioneers for all shipping costs. Payment of shipping costs is expected within 3 days of our invoice to you, payments not made within 10 days from our notice will result in the forfeiture of your lot(s), without refund. If paying via Paypal, your shipping address in Paypal MUST match your shipping address provided to Live Auctioneers. We WILL NOT ship to an address that does not match what your address in Paypal is indicated as at time of payment. Paypal will not indemnify TQA for lost/non-delivered packages if we change the address from anything other than what is in Paypal for you when you pay the shipping invoice.

We do not accept credit-cards in-house, all payments for shipping must be made via Paypal, by check, or by money order.

***Important!! Failure to pay your shipping fees within TEN DAYS of our invoice to you will result in FORFEITURE of your item(s), without refund of any kind. We cannot store your items for long periods, so please be prompt in your shipping payments. By bidding in this sale, you agree to these terms.

POST-SALE PICKUP - PLEASE READ!!!
* All lots that are not being shipped must be picked up within a 21 day period (3 weeks) following the conclusion of the sale. We do not have much extra space and prompt removal of your purchases helps us bring in the next round in quickly. We are NOT a long term storage facility please do not expect us to hold your items for long periods, they will be forfeited by you if you fail to contact us to arrange pickup. Should extenuating circumstances prevent you the buyer from being able to meet this requirement, please contact Treasure Quest Auctions to discuss possible alternative arrangements.

Failure to contact Treasure Quest Auctions to schedule a pickup will result in FORFEITURE of your item or items, without refund, regardless of circumstance. We do greatly value your business, but we are a small auction house and have more than enough to do without managing the personal schedules of hundreds of buyers with reminders and follow-ups to come claim your items. As the buyer, it is your sole responsibility to follow through on obtaining your purchase(s) in person.

IF, extenuating circumstances may prevent your ability to pick-up your purchase(s) within the 21 day deadline, AND you have contacted us before the 21 day period expires, we will try to work with you at our discretion to hold your purchases beyond the three week period, however, a storage fee of $5 per day, per lot, will be assessed and will be payable in full at time of your pick-up before the item(s) are released to you. There is limited space available at our Auction Hall and we are unable to provide long term storage. Again, items not picked up within the prescribed time frame will be subject to forfeiture as unclaimed, and no refund of any kind will be due.
