Treasured Auctions Terms and Conditions
By registering for and/or placing a bid with Treasured Auctions, you acknowledge that you have read, understood, and agree to be bound by the following terms and conditions, including our shipping and payment policies.
1. General Representation
All items are sold AS IS, WHERE IS, WITH ALL FAULTS. Treasured Auctions, for itself and as an agent for the seller, strives to accurately describe each item description, age, medium, and condition, including any damage, repairs, or restorations. These descriptions are opinions only and not warranties. No representations or warranties are made regarding authenticity, condition, age, medium, provenance, authorship, attribution, or period of any item.
Buyers are strongly encouraged to inspect photos prior to bidding to assess condition, size, repairs, damage, and overall appearance. Photos are part of the description and condition report, but the absence of specific condition details does not imply that an item is in perfect condition. Buyers should expect wear consistent with age.
Photos may be close-ups and may not reflect actual size. Refer to the description or contact us at treasuredauctions@gmail.com for size inquiries.
All sales are final, with no refunds, returns, or exchanges except for guaranteed items as outlined below, or where Treasured Auctions cancels a lot prior to fulfillment due to inventory error, prior sale, unavailability, or administrative error.
2. Guaranteed Items
Guaranteed items include a specific guarantee disclaimer in the description, ensuring authenticity and correctness of identification.
Buyers may request a return and refund at the time of pick-up if they provide adequate proof disputing authenticity or identification of the item. For select established buyers, refunds for shipped guaranteed items may be considered with adequate proof.
Refunds are processed within 3 business days after the item is returned in the same condition as sold, with a tracking number provided by the buyer. Treasured Auctions is not responsible for lost or damaged returns and reserves the right to deny refunds for such items.
For non-guaranteed item refunds, the buyer premium is non-refundable.
3. Coins, Bullion, and Paper Notes
To prevent fraud and maintain competitive premiums, no refunds are accepted for coins, bullion, or paper notes based on condition. Refunds are not permitted for shipped items or after the buyer leaves the pick-up table. Refunds are only considered if authenticity of the item is in question.
4. Buyer Responsibility for Inspection
It is the responsibility of the buyer to inspect each lot carefully before bidding to verify condition, description, provenance, and authenticity. Bidding signifies that the buyer has either examined the item as desired or chosen not to.
5. Bid Discrepancies
In case of any discrepancy, including tie bids, the record maintained by Treasured Auctions is final. Treasured Auctions has sole discretion to determine the successful bidder, withdraw a lot, cancel a lot, or reoffer it for sale in the event of a dispute, error, or administrative issue.
6. Buyer Premium
The purchase price includes the final bid plus a 25% buyer premium.
The buyer premium is non-refundable except where Treasured Auctions cancels a lot prior to fulfillment due to inventory error, prior sale, unavailability, or administrative error. In that case, any amount actually paid for the cancelled lot, including buyer premium charged on that cancelled lot, will be refunded.
Any presale bids must be submitted in writing and approved by Treasured Auctions in writing. The company copy of any such bid shall conclusively be deemed to be the sole evidence of same, and the company shall not be held responsible for any failure to execute any presale bid.
7. Shipping
Request Process: Buyers must email treasuredauctions@gmail.com for alternative shipping methods within 7 days after the auction. Failure to do so will incur a storage fee of $1.00 per item per day.
Buyer Responsibility: Buyers are responsible for arranging shipping unless shipping is paid in the invoice.
Shipping Timeline: Items will be shipped within 5 business days after payment clearance.
Shipping Address: The shipping address must match the invoice address. To update the address, the buyer must send an email to treasuredauctions@gmail.com, titled Shipping Address Change, with the new address. Treasured Auctions is not responsible for lost items due to failure by the buyer to update the address.
Packaging and Carriers: Items are packaged professionally and shipped via UPS or USPS, fully insured with tracking.
Liability: Treasured Auctions acts as an agent for the buyer and is not responsible for loss or damage during transit. Claims for loss or damage will be filed with the carrier on behalf of the buyer, with reimbursement based on the carrier decision. Credit card chargebacks filed against Treasured Auctions for shipping issues will waive our responsibility to pursue reimbursement for the buyer.
International Shipping: Import duties and customs fees are the responsibility of the buyer.
Fees: A minimum $10 labor fee applies for shipping labor, materials, or pick-up, regardless of value or size.
8. Pick-Up
A $10 pickup fee will be charged for all pickup requests to offset handling and labor costs.
Pickup is by appointment only, as we do not maintain a staffed storefront. Buyers must schedule a pickup appointment in advance to ensure staff availability.
Buyers are responsible for arranging pick-up of large or heavy items, including providing packing materials, vehicles, tie-downs, and manpower. Treasured Auctions does not provide packing materials or tools, and labor assistance may not be available.
Agents sent for pick-up must present a copy of the invoice for identification.
For invoices over $1,000, photo ID and a digital copy of buyer identification by email, text, or on-site photo are required.
Items not picked up within the designated time without prior written arrangements for shipping or alternative pick-up will be forfeited without a refund.
9. Non-payment, Storage, and Forfeiture
If a buyer fails to pay on time and a non-payment dispute has been filed, any later payment made through the platform does not automatically guarantee completion of the sale.
Even if payment is later collected by the platform, we reserve the right, at our sole discretion, to cancel the transaction, refund the buyer if applicable, refuse further service, and resell, relist, or assign the item to another buyer or party we deem appropriate.
Items not removed from our premises within 7 days after the auction ends will be subject to a storage fee of $1.00 per item per day regardless of size or value. Storage fees must be paid before release of any item.
After 30 days, unclaimed items, paid or unpaid, become the property of Treasured Auctions without a refund.
Failure to pay storage fees will result in termination of the purchase without a refund, and items will become the property of Treasured Auctions.
10. Reserves
Unless the sale is specifically and explicitly advertised and announced as without reserve, each lot is offered subject to a reserve. Some lots in this sale are offered subject to a reserve, which is a confidential minimum price agreed upon by the consignor and Treasured Auctions, below which the lot may not be sold.
Bidder acknowledges that a set reserve may not be relative to the estimates. The auctioneer may reject any bid or raise that is not appropriate with respect to the value of such lot.
11. Payment
Invoice and Payment Timeline: Buyers will receive an invoice within 3 business days after the auction. Full payment is due within 7 days of the invoice date and must be completed before the pick-up day. Failure to pay within 5 days may result in cancellation of the sale, permanent blacklisting, and reporting to the auction platform for a site-wide ban without notice.
Payment Methods: For purchases exceeding $10,000, only bank wire transfers or checks are accepted. For purchases under $10,000, acceptable methods include cash, check, money order, Visa, MasterCard, American Express, Discover, PayPal, and bank wire transfer. A $15 fee applies for domestic and international wire transfers. A $30 fee applies for returned checks. Items will not be released for shipment until payment has cleared.
Sales Tax: All purchases are subject to 8.875% New York sales tax unless the buyer provides a valid tax-exempt certificate.
12. Modifications, Withdrawals, Inventory Errors, and Availability
Treasured Auctions reserves the right to modify, add, or remove any section of these terms and conditions at any time, with or without notice.
Treasured Auctions also reserves the right, at its sole discretion, to withdraw, cancel, void, or rescind any lot or sale before or after the auction due to inventory error, clerical error, duplicate listing, prior sale, loss, damage, unavailability, title issue, consignor dispute, platform error, payment risk, bidder conduct, or any other administrative issue.
A winning bid notification, invoice, or platform generated message does not guarantee final availability or completion of the sale. All sales are subject to final review and confirmation by Treasured Auctions.
If a lot is cancelled by Treasured Auctions due to inventory error, prior sale, unavailability, or administrative error, the sole remedy available to the buyer is cancellation of that lot and refund of any amount actually paid for that cancelled lot. Treasured Auctions shall not be liable for replacement items, lost opportunity, consequential damages, shipping arrangements, travel expenses, or any other damages.
13. Right to Refuse Service
As a private business, Treasured Auctions reserves the right to refuse service, deny bidder approval, cancel bids, cancel invoices, void transactions, or terminate any sale for any lawful reason, including but not limited to bidder conduct, payment risk, fraud concern, inventory error, prior sale, unavailability, platform error, administrative error, non-payment, chargeback risk, abusive communication, or violation of these terms.
