Pick up will be BY APPOINTMENT ONLY. Local Pickup on Sunday, Nov 1 ONLY between 1pm - 5pm in Island Park , New York. To schedule an appointment please TEXT the auction manager at 516-543-9503 with your preferred time, on the day BEFORE the pickup- on Saturday October 31 after 11 AM. Appointments will be 10 min increments. Texting prior to 11 AM will not result in being first to schedule an appointment. You will be scheduled only after everyone else who waited until 11 AM is scheduled.

-Pick Up on Nov 1 - there's only one day for pick up

For example: You won 5 items and want to pick up at 2:15 pm, you will text the manager on Saturday the day before the pick up, requesting 2:10 or 2:20 pick up slots.

If you miss your appointment, it will be pushed to the next available time if there are any available. As always there are no exceptions to the times/days. Items not picked up during the allotted time will be considered forfeited. We do NOT ship items in the auction.

The auction manager will schedule appointments on a first-come, first-served basis only after 11 AM, and will do her best to promptly respond.

IF YOU ARRIVE EARLY FOR YOUR PICKUP, PLEASE WAIT IN YOUR CAR UNTIL YOUR APPOINTMENT TIME. DO NOT PARK IN OR BLOCK THE DRIVEWAY.

IF YOU ARE ARRANGING FOR AN ALTERNATIVE PICK UP PERSON, YOU MUST TEXT THE AUCTION MANAGER FROM THE PHONE NUMBER ON FILE TO AUTHORIZE AND PROVIDE THEIR NAME.

USING A 3RD PARTY COURIER SERVICE REQUIRES A SIGNED PRIOR AUTHORIZATION. PLEASE INFORM THE AUCTION MANAGER VIA TEXT AS SOON AS YOU RECEIVE THE EMAIL CONTAINING YOUR INVOICE. YOU CANNOT SCHEDULE AN APPOINTMENT UNTIL THE AUTHORIZATION IS SUBMITTED TO THE AUCTION MANAGER.

BIDS placed through the AUCTION NINJA website on behalf of VINTAGE HAUS are a binding contract and you are responsible for paying all amounts due to VINTAGE HAUS including sale price, buyer’s premium and all applicable sales tax. Please do not bid if you are unable to pay and take possession of the items in the specified time periods for each auction. All sales are FINAL. No returns, exchanges or credits.

BUYERS PREMIUM: A buyer’s premium will be added to the final price and will be charged to the credit/debit card on file within 24 hours of the close of the auction. Please consider this additional cost before bidding.

CUSTOMER SUPPORT & COMMUNICATION: We are a text-only business! To provide you with the fastest possible service and maintain a clear, written record of all account adjustments, all customer service, pickup scheduling, and auction inquiries are handled strictly via text message. Our customer support lines do not accept incoming voice calls. Any scheduling changes or account exceptions are only valid if confirmed by our team in writing via text message. SALES TAX: All sales are subject to sales tax laws. Tax exempt buyers must provide the appropriate state sales tax exemption certificate and upload it to there profile. Auction Ninja will either accept or deny Tax Exemption. Please submit this information to AUCTION NINJA at least 72 hours prior to the end of the sale. Your profile name & address must match your resale certificate. AUCTION NINJA will keep this information on file for future auctions.

PHOTOS are an integral part of the description. We provide multiple photos and measurements along with other pertinent information. Please take the time to examine and review everything. Again, please ASK QUESTIONS prior to bidding if you need further details! If you'd like extra photos to submit to a third party Authenticator, please do not hesitate to ask! You can text the Auction Manager to see if providing additional photos is possible.

PICK UP: Buyers must pick up their items at the designated sale location within the assigned time frame stated on the sale details page. The address will be sent to the winning bidder via email. Please check junk/spam if you do not receive an email. If you are using a 3rd party courier or alternate designated person to pick up prior authorization is mandatory. Invoices totaling over $500 face courier restrictions, please see below. Please notify the Auction Manager as soon as you receive your invoice. We will request ID for your protection. We strongly suggest you bring packing materials and additional help if needed. We do not provide assistance to help you move items to your vehicle. Movers may be available at an additional cost however we cannot guarantee availability.

ALL SALES ARE FINAL ("AS-IS, WHERE-IS")
All bidding, purchases, and sales are strictly final. Every item is sold "AS-IS," "AS-FOUND," and "WITH ALL FAULTS," with no warranties, representations, or guarantees of any kind, express or implied, concerning the item’s condition, quality, functionality, value, or authenticity. By placing a bid, the Buyer explicitly acknowledges that they are bidding at their own risk and have had the opportunity to inspect the item by requesting additional photos/information prior to the auction close. A change of mind, buyer’s remorse, or failure to inspect photos does not entitle the Buyer to a refund, return, or exchange.

LOCAL IN PERSON PICKUP
APPOINTMENT SCHEDULING RULES
* By Appointment Only: All local pickups are strictly by appointment only. Appointments must be scheduled the day before the official pickup day.
* Text-Only Scheduling Window: Appointments can only be scheduled via text message. Text scheduling begins promptly at 11:00 AM the day before the scheduled pickup.
* Early Text Penalty: If you text before 11:00 AM, you will lose scheduling priority. Your text message will only be processed and responded to after all buyers who followed instructions and texted at or after 11:00 AM have been successfully scheduled.
* Missed Appointments: If you miss your assigned appointment time, you will lose your slot and be moved to the next available open spot, which may result in significant waiting or delay.
* Location Frame & Address: Buyers must retrieve their items at the designated sale location within the assigned time frame stated on the sale details page. The physical pickup address will be sent to winning bidders via email. Buyers bear the sole responsibility to check their junk, spam, or promotional folders if they do not receive the invoice email.
* Arrival & Driveway Etiquette: Buyers are strictly prohibited from blocking our driveway and/or our neighbors' driveways. If you arrive early for your scheduled appointment, you must wait inside your vehicle until your exact scheduled time slot begins.
* Packing Materials & Moving Assistance: We strongly suggest you bring your own packing materials, protective blankets, boxes, and additional physical help if needed. Auction staff do not provide physical assistance moving, lifting, or loading items into your vehicle. Independent movers may be available on-site for hire at an additional cost, but their availability is never guaranteed.

SITE ACCESSIBILITY, HAZARDS, AND LIABILITY WAIVER
* Strictly No Entry Inside Premise: Absolutely no buyers, guests, children, or couriers are allowed inside the physical premises under any circumstances. All business is transacted outdoors.
* Active Commercial Space Disclaimer: The pickup area is an active, outdoor commercial space. By entering the pickup zone, you explicitly acknowledge that the area contains inherent environmental hazards, including but not limited to: uneven, cracked, or missing pavement; stairs and steep drop-offs; ramps, safety mats, and utility cords; and temporary physical obstacles such as raw inventory, stray gravel, sticks, rocks, or exposed nails.
* Zero Liability for Injuries: You enter our designated outdoor pickup area entirely at your own risk. By crossing onto the property line, you completely and unconditionally waive all liability against the auction house, its corporate entities, managers, employees, and land owners for any personal injuries, slips, falls, or property damage that may occur.
* Hazard Warnings: While our staff will make a good-faith effort to verbally or visually notify you of any immediate on-site hazards, the absence of such explicit warning notices does not waive your assumption of risk, nor does it create any liability or negligence on the part of the auction house.

IDENTITY VERIFICATION AND INVOICE THRESHOLDS
To protect our users from fraudulent transactions and prevent identity theft, strict security tiers apply based on your final invoice total:
* Invoices Over $250.00 (ID Required): Any invoice totaling more than $250.00 requires the registered buyer to present a valid government-issued photo ID at the counter that perfectly matches the name on the auction account. Staff will take a photo of your ID, immediately print a copy to file alongside your signed invoice for bank verification purposes, and permanently delete the photo from our digital device before you leave.
* Invoices Over $500.00 (Courier Restrictions): Uninsured consumer gig apps, rideshare networks, or independent peer-to-peer delivery services (including, but not limited to, Uber Courier, Lyft, DoorDash, and TaskRabbit) cannot be used for invoices totaling more than $500.00.
* Licensed Freight Carrier Exception: For invoices exceeding $500.00, third-party pickup is permitted ONLY via a professionally licensed, bonded, and insured commercial freight carrier or white-glove moving company. The carrier must provide or execute a formal commercial Bill of Lading (BOL) at the counter. If a professional carrier does not bring a BOL, the auction house will generate a Straight BOL, which the driver must physically sign. Without a signed, valid BOL, the freight will not be released. Otherwise, the registered account holder must physically appear in person to verify their identity and sign for the items.

THIRD-PARTY COURIERS & PAYMENT DISPUTE WAIVERS
* Pre-Authorized Form Required: If you choose to use an approved third-party courier (including friends, family, private drivers, or licensed carriers), you must submit a completed and signed Third-Party Pickup Authorization Form to the auction manager prior to the scheduled pickup window.
* Duty to Inform Courier: You bear the absolute contractual duty to inform your chosen courier or driver that an official physical signature is required at our counter. If any courier (including rideshare drivers) refuses to sign our release paperwork or a Bill of Lading, we will not release any items. The auction house is not liable for any courier cancellation fees, missed trip fees, or app penalties resulting from a non-compliant courier's refusal to sign. There are no fees or penalties due from the auction house to buyers or drivers for non-compliant couriers.
* Transfer of Liability & No Chargebacks: You agree that the auction house’s liability for the condition, safety, completeness, and delivery of your goods ends entirely the moment they are released to your authorized representative or courier. This physical release constitutes full and successful delivery. You explicitly waive your right to initiate any credit card chargeback, bank dispute, or payment reversal with your financial institution for "non-delivery" or "transit damage" if a third party handles your items.
* Left-Behind Items Timeline & Storage Fees: If your courier leaves any items or portions of an invoice behind, you have a strict 72-hour grace period from the initial pickup time to coordinate and execute a secondary pickup with the auction manager. If the remaining items are not retrieved within 72 hours, a storage fee of $10.00 per day will begin to accrue on the 4th day. All accumulated storage fees must be paid in full prior to the final release of the items.
* Storage Fee Payment App Protocol: All outstanding storage fees must be paid via an approved digital payment app under the following structure to cover exact processing and administrative costs:
* Zelle: No additional fees ($0 fee).
* PayPal / Venmo / Apple Pay / CashApp:
* 3.5% fee if sent via "Friends and Family / Sending to a Friend".
* 10% fee if sent via "Goods and Services / Turn on Purchase Protection".

Payment Disputes and Chargebacks
We commit to resolving all customer service and billing issues fairly and efficiently. Before initiating a payment dispute or chargeback with your bank or credit card issuer, you agree to contact our support team at [Your Support Email/Phone] to allow us an opportunity to resolve the issue directly.
1. Permitted (Genuine) Disputes
Nothing in this agreement is intended to waive, limit, or interfere with your statutory rights under applicable consumer protection laws to dispute unauthorized charges, non-delivery of items, or materially misrepresented goods/services, provided you have acted in good faith.
2. Unacceptable Chargeback Abuse
We reserve the right to vigorously contest and take remedial action against fraudulent or abusive chargebacks. Chargeback abuse includes, but is not limited to:
* Initiating a dispute for goods or services that were successfully delivered, rendered, or downloaded.
* Initiating a dispute to bypass our published Refund and Cancellation Policy.
* Claiming a charge was unauthorized when you, a family member, or an authorized user knowingly initiated the purchase.
* Failing to contact our support team to request a resolution prior to filing a formal bank dispute.

3.Third-Party Courier and Shipping Disputes
If you choose to hire, authorize, or contract a third-party courier, shipping company, or independent driver to pick up or transport your items, our liability for the condition and delivery of those goods ends completely the moment the items are released to that third party.
* No Non-Delivery Chargebacks: You explicitly agree not to initiate a chargeback or payment dispute for "non-delivery" or "lost items" if a third-party courier fails to deliver the items to your final destination.
* No Damage Chargebacks: You explicitly agree not to initiate a chargeback or payment dispute for "goods not as described" or "damaged items" if the damage occurred, or is alleged to have occurred, after the items left our possession.
* Proof of Transfer: A signed pickup receipt, bill of lading, or digital confirmation from your designated courier serves as conclusive proof that the items were successfully delivered to you in full. Any subsequent claims for loss, theft, or damage must be pursued directly with your chosen courier.

4. Remedial Actions for Abuse
If we determine, in our sole discretion, that a chargeback was initiated in bad faith or constitutes abuse, we reserve the right to take any or all of the following actions:
* Account Termination: Immediately suspend or permanently terminate your account and access to our services.
* Debt Collection: Report the unpaid balance to credit bureaus and/or refer the matter to a third-party debt collection agency.
* Recovery of Fees: Hold you liable for the original transaction amount, plus any administrative fees, chargeback penalties, and legal costs incurred by us during the dispute process.

CHARGEBACK ABUSE, FRAUD, AND OUTSTANDING DEBT CONTRACT
The Buyer agrees that credit card chargebacks are a mechanism of last resort for unresolved merchant disputes and are not to be used to bypass these published auction terms.
* Bait-and-Switch & Wire Fraud: If a Buyer files a chargeback claiming an item is counterfeit or not as described, and it is determined that the Buyer has provided false statements to their bank, or has submitted a substitute/different item for third-party authentication, the Auctioneer will aggressively pursue criminal charges for mail/wire fraud and larceny with local and federal law enforcement.
* Survival of Debt: The Buyer explicitly acknowledges that a credit card chargeback only reverses a payment method—it does not erase the underlying legal debt created by winning the auction. If the Buyer's bank forces a chargeback refund in violation of these terms, the Buyer remains fully liable to the Auctioneer for the original purchase price, plus a $250 administrative fraud fee, all bank-imposed chargeback penalties, and all collection/legal costs incurred during recovery. The Auctioneer reserves the right to hand the outstanding debt over to a third-party commercial collections agency, impacting the Buyer’s credit rating.

AUCTION-SPECIFIC SPECIAL INSTRUCTIONS
The Buyer explicitly acknowledges that each individual auction hosted by the Auctioneer may contain additional terms, pickup instructions, shipping protocols, or conditions unique to that specific estate or property location. The Buyer must review these auction-specific terms prior to placing any bids. These additional terms are fully binding and can be found under the Special Instructions section, located under the Event Details tab (if viewing on a mobile device). In the event of a conflict between these general terms and the auction-specific Special Instructions, the Terms & Conditions will govern the transaction.
