Terms & Conditions of Sale**

**1. General Terms**
All property offered and sold through Eagles Corps International LLC (Auctioneer, Company, or Broker) is subject to the following Terms and Conditions, as well as the Terms and Conditions of LiveAuctioneers. By bidding, you acknowledge that you have read, understood, and agreed to be bound by these terms.

**2. Buyers Premium and Fees**
A buyers premium of 22% will be added to the hammer price of each lot, plus a 4% transaction fee charged by LiveAuctioneers. Applicable state and local taxes will also apply.

**3. Binding Contract**
By placing a bid, you enter into a legally binding contract with Eagles Corps International LLC. If your bid is accepted, you are obligated to complete the purchase. In the event of non-payment, the Company reserves the right to:

* Resell the lot
* Cancel the sale
* Pursue legal action for recovery of the purchase price and related costs

The buyer shall be responsible for any difference between the original high bid and the resale price, as well as all collection costs and reasonable attorneys fees.

**4. Catalog Descriptions & Condition**
All property is sold AS IS, WHERE IS. Catalog descriptions, images, and statements (oral or written) are opinions only and are provided for guidance. Eagles Corps International LLC makes no warranties or representations of authenticity, provenance, condition, merchantability, or fitness for a particular purpose.

* Buyers are strongly encouraged to inspect items in person or request condition reports in advance.
* Variations in color due to photography, reproduction, or display are not grounds for return.

**5. Authenticity Disclaimer**
Eagles Corps International LLC makes no guarantees of authenticity. All sales are final. No refunds will be issued for disputes regarding authenticity, condition, or era, unless Eagles Corps International LLC, at its sole discretion, determines a material misrepresentation was made in the catalog description.

**6. Payment**
We fully utilize LiveAuctioneers Instant Payment feature. Once your invoice is sent, LiveAuctioneers will charge the credit card on file. All Payments must be received in full within three (3) business days of the auction. Accepted payment methods include:

* LiveAuctioneers invoicing system (preferred), including PayPal
* Major credit cards (verification may be required prior to processing)
* Other methods by prior arrangement

If initial payment methods are declined, a $30 processing fee may apply. Winning bidder credit cards may be charged automatically four (4) days after an invoice has been issued.

Failure to pay within ten (10) days of the auction may result in resale of the lot(s), cancellation of the sale, negative bidder feedback, and pursuit of legal remedies as outlined in Section 3.

**7. Shipping, Delivery, and Pick-Up**

* Pick-Up: Available by appointment at our Syracuse, NY location
* Shipping: Available in New York, California (Yucaipa), throughout the U.S., and internationally (subject to customs and regulations). All shipping, handling, and insurance costs are the responsibility of the buyer
* Risk of Loss: Risk transfers to the buyer once the item is delivered to the carrier. Eagles Corps International LLC is not responsible for damage or loss after release to the shipping agent. Insurance may be purchased at the buyers request and expense
* Rush Requests: Expedited shipping is available for a $20 service fee, plus any additional carrier costs

Shipping invoices are sent separately and must be paid in full before items are released. Items not removed or arranged for shipment within 21 business days of payment may incur storage fees or be deemed abandoned, with payments forfeited.

**8. Returns & Final Sale Policy**

* All sales are final
* No returns, refunds, or credits will be issued for any reason, including disputes over authenticity, condition, or expert opinion
* Items paid for after the ten (10) day deadline are strictly sold AS IS and are ineligible for return, regardless of catalog description

**9. Tax**
Sales tax of 8% will be charged for items shipped to New York addresses unless a valid resale certificate and NY resale card are submitted prior to bidding.

**10. Auctioneers Discretion**
The Auctioneer reserves the right to:

* Withdraw or re-catalog lots
* Advance or reject bids
* Resolve all bidding disputes
* Determine the winning bidder in the event of a tie or simultaneous bids

The Auctioneers decision shall be final in all cases.

**11. Liability Limitations**
In no event shall Eagles Corps International LLC be liable for any indirect, special, or consequential damages arising from the purchase or use of any lot. Bidder shall be the sole judge of value.

**12. Governing Law**
These Terms & Conditions shall be governed by and construed in accordance with the laws of the State of New York. Any disputes shall be resolved in the appropriate courts of Onondaga County, New York.
