IGAVEL INTERIORS AGREEMENT

By participating in any sale on iGavel Auctions, you agree that you have read and are bound by the conditions of sale on the iGavel Auctions site.

Likewise, by participating in any sale with iGavel Interiors, you hereby acknowledge that you are bound by the terms and conditions below.

iGavel Interiors Payment Policy - NEW TERMS

1. Payment - All payments are due immediately including buyer’s premium, applicable taxes, and/or fees and invoices must be satisfied within 48 hours.

2. Acceptable Method of Payment - For a total amount due of $5,000 or less, your credit card on file will be charged. For a total amount due greater than $5,000, we accept only certified checks, cashiers checks, cash, and wire transfers. iGavel Interiors does not accept Discover or Paypal.

3. For iGavel Interiors sales your registered credit card will be automatically charged for an invoice up to $5,000. You agree to this term by participating in the sale.

4. Personal or Business Checks are not accepted payments for iGavel Interiors sales. See 2 above.

5. Sales Tax - Items picked up or shipped to an address in New York (8.875%) or Texas (8.25% ) are subject to sales tax. To be exempt for this tax, you must have a valid resale authority certificate from your state and submit it with the correct state’s exemption form: New York State Certificate of Resale (Form ST-120) or Texas Sales and Use Tax Resale Certificate 01-339. Sales tax may be collected for other states at some time, as well.

5. International customers with invoices under $5,000 may pay their registered credit card or wire transfer in US currency. Invoices over $5,000 must be paid by wire transfer in US currency. No checks or money orders drawn on foreign banks will be accepted. There is a $30 wire transaction fee.

All payments must be completed by 4pm on Friday, October 7, 2016.

iGavel Interiors Conditions of Sale

Purchaser’s Responsibility - 48 Hours

1. Subject to the fulfillment of all of the conditions set forth, at the close of the auction sale of the lot, the contract between the Consignor and the winning bidder (Purchaser) is final, and the Purchaser thereupon will pay the full purchase price, including the buyer’s premium, applicable taxes, and/or fees within 48 hours.

2. If Purchaser has not made payment of the full purchase price, including the buyer’s premium, applicable taxes, and/or fees within 48 hours after the close of the auction sale of the lot, the Purchaser will be in default and in addition to any and all other remedies available to iGavel Interiors, the Seller and the Consignor by law, including, without limitation, the right to hold the Purchaser liable for the total purchase price, including all fees, charges, and expenses more fully set forth herein, the iGavel Interiors Seller at its option may:
i. cancel the sale of that or any other lot or lots sold to the defaulting Purchaser in the same or any other auction(s), retaining as liquidated damages all payments or deposits made by Purchaser; or
ii. resell the purchased property, whether at public auction or by private sale; or        
iii.effect any combination thereof.  

3. In addition to any other remedies available to iGavel Interiors Sellers by law or as stated in number 2 above, Seller reserves the right, beginning on the 3rd day from the date of the sale, to impose a storage fee of the greater of $50/day per lot or one percent (1%) per month per lot, based upon the full purchase price, including the buyer’s premium, applicable taxes and/or fees, whether Purchaser has made any payment or not. In addition, you may be charged up to $300 per item moving fee.

4. Upon default, Purchaser will be liable for any deficiency, any and all costs, handling charges, late charges, expenses of both sales (original and 2.ii. as above), iGavel Interiors Seller’s commissions on both sales at regular rates, legal fees and expenses, collection fees, and incidental damages.

5. iGavel Interiors may, in its sole discretion, apply any deposit or payment made by the Purchaser to iGavel or its Sellers, whether or not intended to reduce the Purchaser’s obligations with respect to the unpaid lot or lots, to the deficiency and any other amounts due as described herein.

6. Title in a purchased lot will not pass until the iGavel Interiors Seller has received the full purchase price in cleared funds.

7. iGavel Interiors Sellers will not release a lot to the Purchaser until Purchaser's invoice is paid in full for all lots on the invoice and title has therefore passed. Any earlier release by Seller to Purchaser does not affect the passing of title or the Purchaser’s unconditional obligation to pay the full price including all fees.

Seller's Shipping Policy

iGavel Interiors Shipping and Pick-Up Policy 48 Hours

All won lots are to be paid for and picked up by the successful purchaser or his shipper by 4pm, Friday Oct 7, 2016. There will be specific information in your invoice at the end of the auction.

The Purchaser/Buyer is required to make all shipping arrangements and the Seller is under no obligation to fulfill the shipping of won lots.

Sales not concluded in 48 hours are subject to moving and storage fees, insurance fees, and any other costs incurred by the Seller at the conclusion of the sale. Should the Seller have to remove the lot from the site, all guarantees for condition are void. Seller may recover removal costs by charging the Buyer’s card on file with iGavelAuctions.com, or attempt by legal or other remedies to recover costs due to Buyer’s leaving property uncollected.

International buyers are responsible for paying import costs, duties, and any additional taxes. Please note that packing and international documentation fees will be charged extra.

Larger Items and Furniture:

It is the Buyer’s responsibility to pick up or have his shipper shipper pick up all won items by 4pm Friday Oct 7, 2016. To pick up your property directly, contact office@larkmasonassociates.com to arrange a pick up time. To have your large purchases shipped, a suggested transporter is:
