ACME Auctions - Terms & Conditions
By registering to bid with ACME Auctions through LiveAuctioneers, all participants acknowledge and agree to the following Terms & Conditions. These terms govern the auction in full and supersede all prior announcements, advertisements, and published materials.
1. Bidding & Registration
Bidders must register with LiveAuctioneers to participate. ACME Auctions reserves the right, in its sole discretion, to approve or deny any registration and to refuse bidding privileges based on a bidders past performance with ACME Auctions, other auctioneers, or LiveAuctioneers.
2. Buyers Premium & Payment
A 25% buyers premium, plus any applicable sales tax, is added to the hammer price of each lot.
Invoices are issued through the LiveAuctioneers payment interface within 24 hours of the auction?s conclusion. This sale uses LiveAuctioneers? Standard Autopay system: by registering, bidders authorize LiveAuctioneers to charge the card on file for the full invoice amount.
If Autopay is declined, the buyer must provide an alternative form of payment within 48 hours of the sale. Failure to remit payment within this period may, at the discretion of ACME Auctions, result in cancellation of the sale, assessment of damages, and/or the filing of a non-paying bidder dispute with LiveAuctioneers.
3. Shipping, Third-Party Shippers & Local Pickup
ACME Auctions does not provide in-house packing or shipping. All packing and shipping are the sole responsibility of the buyer and must be arranged with independent third-party shippers.
Free Local Pickup: Winning bidders may collect their purchases in person from ACME Auctions by appointment at no additional charge. Buyers are responsible for bringing all necessary packing materials and assistance.

Buyers must contact The UPS Store directly to obtain quotes, provide packing/shipping instructions, and pay them directly. ACME Auctions will not collect or remit shipping payments on the buyer?s behalf.
LiveAuctioneers Live Shipping: For certain lots, buyers may request packing and shipping quotes through LiveAuctioneers Live Shipping. Any such services are provided by independent shippers, and the contract is between the buyer and the shipper, not ACME Auctions.
Once property is released to the buyer, the buyers agent, or any third-party shipper (including The UPS Store or shippers obtained via LiveAuctioneers Live Shipping), ACME Auctions has no responsibility for packing, handling, shipping costs, transit time, loss, or damage in transit. Multiple lots purchased by the same bidder may be grouped for transfer to a shipper when practical; any combined shipping charges are determined solely by the shipper.
Customs forms for international shipments (if any) will reflect the full purchase price. Items will not be marked as ?gift.? International buyers are responsible for all customs duties, taxes, and fees.
4. Descriptions & Condition Reports
Catalog descriptions, estimates, and any statements (oral or written) are provided as opinions for guidance only and do not constitute warranties or guarantees of any kind. The absence of a condition note does not imply that an item is in perfect condition or without defects. Photographs form part of the description.
Prospective bidders are strongly encouraged to inspect items in person or to request additional information or condition reports prior to bidding. Requests must be made at least two days before the auction. All property is sold AS IS, WHERE IS, and all sales are final.
5. Estimates & Reserves
Pre-sale estimates are for reference only and do not predict or limit the final sale price. Some lots may be subject to a confidential reserve. The auctioneer is authorized to bid on behalf of the consignor up to the reserve.
6. Auctioneer?s Authority
The auctioneer has sole and absolute discretion in the conduct of the sale, including, but not limited to, the right to accept or reject any bid, to resolve any dispute between bidders, to advance bidding in such increments as deemed appropriate, to withdraw or reoffer any lot, and to group or subdivide lots.
7. Internet & Absentee Bidding
Online bidding through LiveAuctioneers is offered as a convenience. ACME Auctions is not responsible for errors, omissions, interruptions, or technical failures in the bidding process. In events where floor, absentee, telephone, and internet bids are all accepted, the auctioneer?s decision as to the successful bidder and final hammer price is final.
8. Transfer of Title & Risk of Loss
Title to each lot and risk of loss pass to the buyer at the fall of the hammer. Thereafter, buyers are responsible for the security, insurance, and transport of their purchases, whether collected in person or shipped by a third party.
9. Returns & Limited Guarantee
Except as expressly stated herein, all property is sold without warranty and all sales are final. Returns will only be considered if:
(a) the physical condition of the lot materially differs from the catalog description;
(b) the buyer requested and received a written condition report prior to bidding; and
(c) the buyer notifies ACME Auctions in writing within 24 hours of receipt.
Any determination of material difference is at the sole discretion of ACME Auctions. Approved returns must be received within 10 days, in the same condition and with the same components as when originally shipped or collected. Shipping, packing, and insurance costs are non-refundable.
10. Sales Tax
Applicable sales tax will be added to all invoices as required by law, unless the buyer provides a valid resale certificate or other tax-exempt documentation acceptable to ACME Auctions before invoicing.
11. Legal Disputes
Any dispute arising out of or relating to the auction, these Terms & Conditions, or any purchase made hereunder shall be resolved by binding arbitration in Suffolk County, New York, under the rules of a mutually agreed arbitration service. The prevailing party may recover reasonable attorneys? fees, collection costs, interest, and associated expenses.
12. Acceptance of Terms
Placing a bid constitutes full and unconditional acceptance of these Terms & Conditions. No alteration or amendment is binding unless made in writing and signed by an authorized representative of ACME Auctions.
