TERMS AND CONDITIONS OF SALE
By registering for this auction, placing a bid, or purchasing a lot, each bidder agrees to these Terms and Conditions of Sale, the applicable LiveAuctioneers terms and policies, and any notices or additional terms contained in the auction listing or individual lot description.
**DIMENSIONS & SHIPPING NOTICE:** Dimensions and weight displayed in LiveAuctioneers’ dimensions and weight fields are estimates for shipping purposes only. Please refer to the item description for the actual item measurements. Contact us with any questions or for additional information.
1. JWA AUCTIONS AND THE PROPERTY
JWA Auctions may act as agent for an estate, consignor, private owner, or other seller and may also offer property in which it has an ownership interest. The identity of a consignor or owner need not be disclosed unless required by law.
All property is offered subject to these Terms and Conditions. JWA Auctions reserves the right to withdraw, combine, divide, reorder, or modify any lot; reject any bid or bidder; correct cataloging or clerical errors; establish or modify bidding increments; and postpone, reopen, or cancel a sale when reasonably necessary.
Lots may be offered subject to a confidential reserve. JWA Auctions may reject a bid below the reserve or withdraw a lot that does not meet its reserve.
2. ONLINE BIDDING
This is an online-only auction conducted through LiveAuctioneers. Each bidder is responsible for maintaining a valid LiveAuctioneers account, safeguarding account credentials, confirming bids before submission, and maintaining adequate internet and device access.
A bid is binding once accepted. JWA Auctions is not responsible for internet interruptions, delayed transmissions, platform errors, device failures, missed bids, or other technical problems beyond its reasonable control. In the event of a bidding dispute, platform malfunction, or irregularity, JWA Auctions may determine the successful bidder, reject or reopen bidding, resell the lot, or take other reasonable corrective action. JWA Auctions? sale record will be final to the fullest extent permitted by law.
3. PURCHASE PRICE AND BUYER?S RESPONSIBILITY
The purchaser must pay the hammer price, the buyer?s premium shown on the auction listing or invoice, applicable sales or use taxes, and all other charges associated with the purchase, including shipping, packing, handling, insurance, customs, duties, tariffs, brokerage charges, storage, and related expenses.
The bidder registered through LiveAuctioneers will be treated as the purchaser and is personally responsible for the invoice unless JWA Auctions has approved a disclosed principal or agency relationship in writing before the auction.
4. PAYMENT
All payments must be completed through the LiveAuctioneers LivePayments system using the payment options made available by LiveAuctioneers. Successful bidders will receive their invoices and payment instructions through their LiveAuctioneers accounts.
Payment must be completed within the period stated on the invoice or in the LiveAuctioneers checkout instructions. JWA Auctions does not accept direct or off-platform payment for purchases made through this auction unless JWA Auctions expressly authorizes an alternative in writing.
Title to purchased property will not pass until JWA Auctions has received confirmation of full, cleared, and undisputed payment of the entire amount due.
5. NONPAYMENT
Every accepted bid constitutes an enforceable purchase obligation. If a purchaser fails to make timely payment or otherwise breaches these Terms, JWA Auctions may, to the extent permitted by law:
(a) cancel the sale;
(b) offer the property to the underbidder;
(c) resell the property publicly or privately;
(d) recover any deficiency between the original purchase price and the resale proceeds;
(e) recover reasonable storage, handling, collection, legal, and resale expenses;
(f) suspend or refuse the purchaser?s future bidding privileges;
(g) report the default to LiveAuctioneers; and
(h) pursue any other remedy available at law or in equity.
A purchaser remains responsible for the invoice unless JWA Auctions confirms cancellation or other resolution in writing. Nothing in these Terms restricts a purchaser?s nonwaivable rights under applicable payment-network or consumer-protection laws.
6. CATALOG DESCRIPTIONS
JWA Auctions makes a reasonable, good-faith effort to research, photograph, identify, and describe each lot accurately. Nevertheless, property is often antique, vintage, previously owned, restored, repaired, altered, incomplete, or of uncertain origin. Descriptions may contain errors, omissions, approximate information, or opinions about which reasonable specialists may disagree.
Unless expressly stated as a written guarantee, descriptions concerning artist, maker, authorship, attribution, origin, culture, period, date, age, provenance, material, medium, dimensions, weight, condition, restoration, rarity, or value represent JWA Auctions? good-faith opinion based on the information reasonably available when cataloged.
Measurements, dimensions, weights, capacities, and quantities are approximate. Photographs may not accurately reproduce scale, color, tone, surface, texture, wear, restoration, or every condition issue. Screen settings and lighting may cause additional variations.
Estimates are opinions of possible auction value and are not appraisals, promises, or guarantees of selling price, authenticity, condition, or future value.
7. CONDITION AND INSPECTION
All property should be expected to show age-appropriate wear and may have damage, losses, repairs, replacements, restoration, alterations, fading, staining, crazing, cracks, chips, corrosion, oxidation, odors, insect activity, mechanical defects, missing components, or other imperfections.
The absence of a condition statement does not imply that a lot is free from defects. References to particular defects do not constitute a complete condition report or imply the absence of additional defects.
Bidders are responsible for examining the photographs and description and conducting whatever inspection, research, consultation, or independent testing they consider necessary before bidding. Private in-person inspection may be available by advance appointment. Requests for condition information, additional photographs, or appointments should be submitted before bidding to info@JWAauctions.com.
Condition reports and additional photographs are provided as a courtesy and represent opinion only. They are not comprehensive inspections or warranties.
8. AUTHENTICITY, ATTRIBUTION, AND PROVENANCE
Bidders are responsible for conducting their own due diligence concerning authenticity, authorship, attribution, age, origin, provenance, and condition before bidding. JWA Auctions recommends obtaining independent professional advice whenever any such issue is material to a bidder?s decision.
Qualifying expressions such as ?attributed to,? ?school of,? ?circle of,? ?studio of,? ?workshop of,? ?manner of,? ?style of,? ?after,? ?possibly,? ?probably,? and similar language indicate uncertainty and must not be interpreted as an unqualified statement of authorship or origin.
Provenance information is based on available records and representations from prior owners or consignors and may not be independently verified. Changes in scholarly opinion, market opinion, scientific testing, or attribution after the sale do not, by themselves, provide a basis for cancellation or refund.
Nothing in these Terms excludes or limits an express warranty or legal right that cannot lawfully be excluded, including rights arising from representations governed by applicable fine-art, consumer-protection, or other law.
9. JEWELRY, GEMSTONES, AND WATCHES
Gemstone identifications, treatments, origins, grades, carat weights, metal content, and measurements are approximate unless accompanied by an independent laboratory report expressly identified in the lot description. Stones are generally examined as mounted and may not be removed for testing. Treatments, enhancements, synthetic components, replacements, and repairs may not always be detectable through ordinary examination.
Any laboratory report speaks only as of its date and is subject to the issuing laboratory?s standards and limitations. JWA Auctions is not responsible for later differences of opinion among laboratories or specialists.
Watches and clocks are sold as collectible personal property. Unless expressly guaranteed in writing, no representation is made concerning timekeeping accuracy, movement completeness, service history, power reserve, waterproof or water-resistant qualities, replacement parts, or future operation. Mechanical items may require cleaning, adjustment, repair, or complete servicing.
References to a designer, manufacturer, or brand are based on visible marks and information reasonably available during cataloging. Bidders should request additional photographs and conduct independent authentication before bidding whenever brand attribution is material.
10. AS-IS SALE AND DISCLAIMER OF WARRANTIES
EXCEPT FOR AN EXPRESS WRITTEN WARRANTY SPECIFICALLY MADE BY JWA AUCTIONS OR A WARRANTY OR RIGHT THAT CANNOT LEGALLY BE EXCLUDED, ALL PROPERTY IS SOLD ?AS IS,? ?WHERE IS,? AND ?WITH ALL FAULTS.?
TO THE FULLEST EXTENT PERMITTED BY LAW, JWA AUCTIONS, THE SELLER, AND THE CONSIGNOR DISCLAIM ALL IMPLIED WARRANTIES, INCLUDING THE IMPLIED WARRANTY OF MERCHANTABILITY AND THE IMPLIED WARRANTY OF FITNESS FOR A PARTICULAR PURPOSE.
NO ORAL STATEMENT, INFORMAL COMMUNICATION, CONDITION REPORT, PHOTOGRAPH, OR RESPONSE TO AN INQUIRY CREATES A WARRANTY OR MODIFIES THESE TERMS. Any modification or additional guarantee must be expressly stated in writing by an authorized representative of JWA Auctions.
11. FINAL SALES AND CLAIMS
All sales are final. No return, refund, exchange, credit, or cancellation will be permitted because of buyer?s remorse, differences in subjective opinion, expected wear, a defect visible in the photographs, a matter disclosed in the description, or a condition that inspection should reasonably have revealed.
A purchaser who believes that a material error has occurred must notify JWA Auctions promptly in writing, preserve the property in the condition received, and provide photographs and supporting documentation. The purchaser may not alter, repair, clean, restore, disassemble, resell, or transfer the property while a claim is under consideration.
No return or refund is authorized unless JWA Auctions agrees to it in writing or applicable law requires it. Nothing in these Terms eliminates rights that cannot legally be waived.
12. SHIPPING, CUSTOMS, AND RISK OF LOSS
The purchaser is solely responsible for all costs and obligations associated with packing, handling, pickup, transportation, shipping, insurance, customs clearance, duties, tariffs, brokerage charges, import or export taxes, permits, storage, redelivery, and every other related fee or expense.
Shipping will be arranged through the LiveAuctioneers LiveShipping program and its designated third-party shipping providers. Shipping estimates, packing, carrier selection, pickup, tracking, delivery, shipment coverage, customs documentation, and shipping claims are administered by LiveAuctioneers and/or the designated provider under their respective terms and policies.
Upon release of a purchased lot to the purchaser, the purchaser?s representative, LiveAuctioneers, a LiveShipping provider, a carrier, or another designated shipping or pickup service, custody and risk of loss pass to the purchaser to the fullest extent permitted by law. JWA Auctions is not responsible for loss, theft, breakage, damage, delay, misdelivery, customs detention, or nondelivery occurring after the property leaves JWA Auctions? custody.
The purchaser must inspect delivered property immediately. Any shipping loss or damage claim must be submitted directly to the applicable shipping provider within the period required by that provider?s terms. Failure to provide timely notice or retain all packaging may affect or eliminate available shipping coverage.
The purchaser is responsible for determining whether property may lawfully be shipped to, possessed in, or imported into the intended destination. A purchaser?s inability to ship or import a lot does not cancel the sale or payment obligation.
13. COLLECTION, STORAGE, AND ABANDONED PROPERTY
Purchased property must be removed within the period stated in the invoice, shipping instructions, or other written notice. Property not removed when required may be subject to reasonable storage, handling, relocation, and administrative charges.
If property remains uncollected after reasonable written notice, JWA Auctions may exercise any remedy permitted by law, including transferring the property to storage, reselling it to recover outstanding charges, or treating it as abandoned where legally authorized. The purchaser remains responsible for any unpaid balance and related costs.
14. REGULATED AND RESTRICTED PROPERTY
Certain property?including firearms, weapons, ivory, endangered-species materials, cultural property, alcohol, and other regulated items?may be subject to special federal, state, local, or international restrictions.
The purchaser is responsible for all licenses, permits, registrations, transfers, legal eligibility, and regulatory compliance. JWA Auctions may refuse to release or ship property when doing so may violate applicable law or carrier policy. Such restrictions do not relieve the purchaser of the payment obligation unless applicable law requires otherwise.
15. LIMITATION OF LIABILITY
TO THE FULLEST EXTENT PERMITTED BY LAW, JWA AUCTIONS, ITS CONSIGNORS, OWNERS, MEMBERS, OFFICERS, EMPLOYEES, CONTRACTORS, AND AGENTS WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, EXEMPLARY, PUNITIVE, OR CONSEQUENTIAL DAMAGES, INCLUDING LOST PROFITS, LOST OPPORTUNITY, LOSS OF USE, OR DIMINUTION IN VALUE.
TO THE FULLEST EXTENT PERMITTED BY LAW, THE MAXIMUM AGGREGATE LIABILITY OF JWA AUCTIONS AND THE SELLER ARISING FROM A LOT WILL NOT EXCEED THE PURCHASE PRICE ACTUALLY PAID TO JWA AUCTIONS FOR THAT LOT.
These limitations do not apply to fraud, willful misconduct, or any liability that applicable law does not permit the parties to exclude or limit.
16. THIRD-PARTY SERVICES
LiveAuctioneers, LivePayments, LiveShipping, payment processors, carriers, laboratories, conservators, authenticators, and other outside service providers are independent third parties governed by their own terms and policies.
JWA Auctions does not control and is not responsible for the acts, omissions, determinations, delays, platform failures, charges, or claims procedures of independent third parties. 17. GOVERNING LAW AND VENUE
These Terms and every sale conducted by JWA Auctions will be governed by the laws of the State of New York, without regard to conflict-of-law principles.
Unless applicable law requires otherwise, any dispute involving JWA Auctions or a sale must be brought in a state or federal court located in Monroe County, New York, and each bidder consents to the jurisdiction of those courts.
18. GENERAL PROVISIONS
These Terms, together with the lot description, auction notices, invoice, and applicable LiveAuctioneers terms, constitute the agreement governing the sale.
If any provision is found invalid or unenforceable, the remaining provisions will continue in effect. JWA Auctions? failure to enforce a provision on one occasion does not waive its right to enforce that provision later.
JWA Auctions may correct typographical, photographic, cataloging, clerical, or administrative errors and may update these Terms before bidding begins. Material announcements or written amendments posted before or during the auction will become part of these Terms.

Purchased property must be removed within the period stated in the invoice, shipping instructions, or other written notice. Property not removed when required may be subject to reasonable storage, handling, relocation, and administrative charges.
If property remains uncollected after reasonable written notice, JWA Auctions may exercise any remedy permitted by law, including transferring the property to storage, reselling it to recover outstanding charges, or treating it as abandoned where legally authorized. The purchaser remains responsible for any unpaid balance and related costs.
14. REGULATED AND RESTRICTED PROPERTY
Certain property?including firearms, weapons, ivory, endangered-species materials, cultural property, alcohol, and other regulated items?may be subject to special federal, state, local, or international restrictions.
The purchaser is responsible for all licenses, permits, registrations, transfers, legal eligibility, and regulatory compliance. JWA Auctions may refuse to release or ship property when doing so may violate applicable law or carrier policy. Such restrictions do not relieve the purchaser of the payment obligation unless applicable law requires otherwise.
15. LIMITATION OF LIABILITY
TO THE FULLEST EXTENT PERMITTED BY LAW, JWA AUCTIONS, ITS CONSIGNORS, OWNERS, MEMBERS, OFFICERS, EMPLOYEES, CONTRACTORS, AND AGENTS WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, EXEMPLARY, PUNITIVE, OR CONSEQUENTIAL DAMAGES, INCLUDING LOST PROFITS, LOST OPPORTUNITY, LOSS OF USE, OR DIMINUTION IN VALUE.
TO THE FULLEST EXTENT PERMITTED BY LAW, THE MAXIMUM AGGREGATE LIABILITY OF JWA AUCTIONS AND THE SELLER ARISING FROM A LOT WILL NOT EXCEED THE PURCHASE PRICE ACTUALLY PAID TO JWA AUCTIONS FOR THAT LOT.
These limitations do not apply to fraud, willful misconduct, or any liability that applicable law does not permit the parties to exclude or limit.
16. THIRD-PARTY SERVICES
LiveAuctioneers, LivePayments, LiveShipping, payment processors, carriers, laboratories, conservators, authenticators, and other outside service providers are independent third parties governed by their own terms and policies.
JWA Auctions does not control and is not responsible for the acts, omissions, determinations, delays, platform failures, charges, or claims procedures of independent third parties. 17. GOVERNING LAW AND VENUE
These Terms and every sale conducted by JWA Auctions will be governed by the laws of the State of New York, without regard to conflict-of-law principles.
Unless applicable law requires otherwise, any dispute involving JWA Auctions or a sale must be brought in a state or federal court located in Monroe County, New York, and each bidder consents to the jurisdiction of those courts.
18. GENERAL PROVISIONS
These Terms, together with the lot description, auction notices, invoice, and applicable LiveAuctioneers terms, constitute the agreement governing the sale.
If any provision is found invalid or unenforceable, the remaining provisions will continue in effect. JWA Auctions? failure to enforce a provision on one occasion does not waive its right to enforce that provision later.
JWA Auctions may correct typographical, photographic, cataloging, clerical, or administrative errors and may update these Terms before bidding begins. Material announcements or written amendments posted before or during the auction will become part of these Terms.
