Auction Terms & Conditions

By registering for and participating in this auction, all bidders agree to be bound by the following Terms and Conditions established by Local Line Auctions LLC.

1. Condition of Items

All items are sold AS IS, WHERE IS, WITH ALL FAULTS.

No warranties or guarantees, expressed or implied, are provided.
Item descriptions, photographs, and condition reports are provided as a courtesy and are believed to be accurate but are not guaranteed.
It is the bidder's responsibility to inspect items prior to bidding.
All sales are final. No returns, refunds, exchanges, or adjustments will be made.
2. Binding Bids

All bids placed constitute a legally binding contract.

Bids may not be canceled or withdrawn.
Winning bidders are legally obligated to complete payment.
Failure to pay may result in account suspension, collection efforts, and legal action.
3. Buyer's Premium & Sales Tax

A Buyer's Premium will be added to the final hammer price of each item.

12% Buyer's Premium for invoices paid by cash.
15% Buyer's Premium for invoices paid by credit card or other electronic payment methods.

Applicable New York State sales tax (8%) will be collected unless a valid tax-exempt or resale certificate is on file before the auction closes.

4. Payment Terms & Credit Card Authorization

By registering and bidding, you authorize Local Line Auctions LLC to charge the payment method on file for any purchases made.

Invoices may be processed immediately following the auction close.

Charges include:

Hammer Price
Applicable Buyer's Premium
Sales Tax
Any applicable fees

If the payment method on file is declined:

The bidder remains responsible for the full invoice amount.
Local Line Auctions LLC may attempt additional charges or require another form of payment.
Failure to pay may result in account suspension, collection activity, and legal action.
5. Pickup & Abandonment Policy (STRICTLY ENFORCED)

ALL ITEMS MUST BE REMOVED WITHIN FIVE (5) DAYS OF THE AUCTION CLOSE UNLESS OTHERWISE ANNOUNCED.

Failure to remove purchased items within the stated pickup period constitutes voluntary abandonment.

Abandoned property may, at the sole discretion of Local Line Auctions LLC, be:

Resold
Donated
Disposed of

No refunds, credits, or compensation will be issued.

All ownership rights are permanently forfeited.

6. Removal & Loading

Buyers are solely responsible for loading and removing all purchased items.

NO LOADING ASSISTANCE WILL BE PROVIDED.

Buyers are responsible for bringing:

Adequate help
Proper tools
Appropriate moving equipment

Buyers assume all risks associated with removal, including injury or property damage.

Local Line Auctions LLC, the property owner, and consignor shall not be liable for accidents, injuries, losses, or damages occurring during inspection, pickup, loading, or removal.

7. Chargebacks & Payment Disputes

By registering and bidding, you agree not to initiate a credit card chargeback without first contacting Local Line Auctions LLC to resolve the matter.

Improper chargebacks may result in:

Immediate account suspension
Permanent ban from future auctions
Collection activity
Legal action to recover:
Invoice balance
Buyer's Premium
Bank fees
Collection costs
Court costs
Reasonable attorney's fees where permitted by law
8. Default

If a bidder fails to pay for or remove purchased items:

Purchases may be canceled.
Items may be resold without notice.
Payments previously made may be forfeited.
The defaulting bidder remains responsible for any resulting deficiency, costs, damages, collection expenses, and other legal remedies available under New York law.
9. Auctioneer Rights

Local Line Auctions LLC reserves the right to:

Refuse service to any bidder.
Reject or cancel any bid.
Withdraw, combine, divide, or re-catalog items.
Reopen bidding in the event of technical issues or disputes.
Resolve all bidding disputes at its sole discretion.
Cancel any sale resulting from clerical or technical error.
10. Governing Law & Venue

These Terms and Conditions shall be governed by and interpreted under the laws of the State of New York.

Any legal action arising from participation in this auction shall be brought exclusively in a court of competent jurisdiction located within the State of New York.

11. Agreement to Terms

By registering, placing a bid, or participating in this auction, you acknowledge that you have:

Understood these Terms and Conditions.
Agreed to be legally bound by these Terms and Conditions.

Participation in the auction constitutes your acceptance of all terms set forth above.
