Terms & Conditions

The following describes the terms on which Everything But The House (“EBTH”) offers you access to the EBTH services. In order to become a member on the EBTH website, you must read and accept all of the terms and conditions set forth below (the “EBTH Terms and Conditions”):
1. Buyer’s Contract. Your bids placed on the EBTH website are a contract and you are responsible for paying all amounts due to EBTH. If you cannot pay for and pick up the items during the times specified, please do not bid. While using the EBTH website, you agree that you will not:
Use the EBTH site or services if you are not able to form a legally binding contract or if you are under the age of 18 years old;
Fail to deliver payment for items purchased by you;
Circumvent or manipulate our fee structure, the billing process, or any fees owed to EBTH; or manipulate the price of any item.
2. Deadlines and Close of Internet Bidding. Items will begin to close at a specified number of items per minute on the scheduled date and start time of the online sale closing period. The items will close in the order listed on the website. All online sales will feature our automatic extension system. If an item receives a bid within the last 5 minutes, the close time will be extended 5 minutes from the time the bid is placed. The time will continue to be extended for 5 minutes with each newly placed bid and the item will not close until 5 minutes have elapsed with no additional bid activity. On the final day of the sale the system will tell you exactly how much time is remaining (The “Categories” view does not update automatically. Remember to hit refresh within your browser if using this view).
3. Bidding Instructions. Please contact the EBTH office for a detailed overview of the sale closing and bid submission process.
4. Retention of Credit Card Information. By providing your credit card information to EBTH, you authorize EBTH to charge your credit card for the purchase amount of any successful bid plus associated taxes, shipping costs (if any) and Handling Fees (if any, as defined below). You also agree and acknowledge that you will maintain valid credit card information within your user profile so long as you maintain an account with EBTH. Purchases over $1,000 using a credit card will be charged an additional 2% surcharge to help cover merchant fees. IN THE EVENT THAT YOU FAIL TO PICK-UP YOUR ITEMS IN ACCORDANCE WITH THE EBTH TERMS AND CONDITIONS, YOU HEREBY AUTHORIZE EBTH TO CHARGE YOUR CREDIT CARD FOR THE PURCHASE AMOUNT OF THE ITEM PLUS ANY TAXES, SHIPPING COSTS AND HANDLING FEES.
5. Payment Forms Accepted. Successful bidders who will be picking up items in person can pay for purchases during the designated removal and payment times listed on the Sale Details page. In the event that you do not wish to pay with the credit card provided to EBTH, you may pay with cash or check during the designated removal and payment time. Purchases over $2,500 may require payment via cashier’s check, ACH or wire. Winning buyers with questions of how to make payment should submit a question within our Contact Form located here.
6. Item Descriptions. All items are sold as is – where is. In the case of obvious faults (chips, cracks, significant damage, etc.) EBTH does its best to list the fault within the description. EBTH will provide descriptions based on its assessment of an item. However, we do not assume that our assessment of condition will be the same as your assessment. Most of the items EBTH sells are antique, vintage, or used. You should expect signs of wear consistent with age and EBTH will not list every flaw associated with each item as these are to be expected. EBTH offers a public preview inspection for the sole purpose of allowing you the opportunity to see it in person before placing a bid. If you are unsure of an item’s condition please make arrangements to attend the preview and bid accordingly.
7. Limitation of Liability. You agree that EBTH is not responsible for the acts or omissions of EBTH or other carriers in packing or shipping of purchased lots, whether or not such carrier is recommended by EBTH.
YOU ALSO AGREE AND UNDERSTAND THAT EBTH WILL NOT BE LIABLE FOR ANY INDIRECT, SPECIAL, PUNITIVE, COMPENSATORY, CONSEQUENTIAL OR EXEMPLARY DAMAGES EVEN IF EBTH HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. TO THE EXTENT PERMITTED BY LAW, EBTH’S TOTAL LIABILITY TO YOU FOR ANY REASON AND UPON ANY CAUSE OF ACTION WHATSOEVER, WHETHER IN CONTRACT, WARRANTY OR TORT, SHALL BE LIMITED TO THE AMOUNT OF MONEYS PAID BY YOU TO EBTH HEREUNDER IN THE PRECEDING THREE (3) MONTH PERIOD.
8. Sales Tax. All sales are subject to appropriate state sales tax laws. Tax exempt buyers must provide the appropriate state sales tax exemption certificate prior to the end of the sale. Upon receipt of such information by EBTH, your future purchases will not be taxed. You may be required to update certificates on file periodically as deemed necessary by EBTH.
9. Increasing Your Own Bid/Bidding Errors. Please be aware that many bidders routinely increase their own bid to price an item out of reach of other bidders. The system will ask you to review significant increases in bids after placing them to make sure you did not enter an amount in error. Please pay close attention to this to prevent you from entering a bid in error. Also, please note that if you place a bid in the “Your Minimum Bid” box instead of the “Your Maximum Bid” box the bid will immediately increase to the amount you entered (unless another bidder had a higher maximum bid). Please note that you can raise your own maximum bid by using the “Edit Max” bid text link without increasing your current bid amount. If you make a mistake before 24 hours of the sale close you can submit a request to have your error corrected (EBTH will have discretion over whether or not it was an obvious mistake) within our Contact Form located here. If the mistake is made within 24 hours of the auction closing the bid will stand as entered due to the fact that the bid you placed may prevent other bidders from placing competing bids. EBTH staff makes every attempt to watch the sale closing to insure obvious mistakes (i.e. $1000 entered instead of $10 are immediately corrected). However, EBTH cannot be responsible for individuals increasing their own bids and therefore eliminating other potential bidders. This is the risk you take when waiting until the last day to place your bids and doing so under time constraints!
10. Shipping Requests.
Standard Shipping. Items noted with “Generate a quote” under the “Pickup and Shipping Options: Delivery” section of the item listing are available for standard shipping. During a sale, you can get a shipping estimate on these items by using the quote calculator. Should you win the item, an invoice will appear in your “I’ve Won” list. By selecting the invoice and clicking “Checkout” you will be able to designate your final shipping method. Final shipping costs may vary from your original quote based on the final insurable value (winning bid amount) of the item. Insurance is added at $1.25 per $100 of value. (Shipping quote insurance amounts prior to the end of the sale are based on the current bid value.) EBTH will use reasonable efforts to ship the merchandise within ten (10) business days after the scheduled sale removal and payment date.
Custom Shipping. Items noted with “A quote will be emailed” under the “Pickup and Shipping Options: Delivery” section of the item listing require a custom shipping quote. EBTH will use reasonable efforts to provide an email quote within 24 hours. Please realize certain items may not qualify for shipping period. You are also welcome to make your own arrangements to have your items picked up by the agent of your choosing. However, this must take place during the scheduled pick up times and EBTH must receive payment for your invoice amount prior to releasing your items.
11. Alternate pickup. If after winning an item you determine you are unable to pick up your items during the scheduled removal date and time you must contact EBTH 24 hours prior to the scheduled removal date and time to determine if alternate arrangements can be made. THIS SHOULD ONLY BE CONSIDERED AS A LAST RESORT AND ON AN EXCEPTION BASIS. Items which cannot be moved will be forfeited and may be subject to disposal charges in addition to the original invoice amount.
EBTH, in its sole discretion, may arrange for the transport of the purchased items to our warehouse in St. Bernard, Ohio and arrange for an alternate pickup date and time, subject to availability. EBTH WILL CHARGE YOUR CREDIT CARD FOR THE PURCHASE AMOUNT AND TAXES PLUS THE HANDLING FEES SET FORTH BELOW.
Items which must be moved from one location to another in order to make alternate pickup arrangements are subject to a minimum handling fee of $10.00 per lot (“Handling Fee”). You agree that EBTH may charge a higher Handling Fee, in its absolute and sole discretion, for certain items which are difficult to transport.
12. Forfeiture of Items.
Failure to Pay. Any items not paid for in accordance with the EBTH Terms and Conditions will be forfeited by you and EBTH may, in its sole and absolute discretion, resell the items or donate the items to a charity of EBTH’s choosing. EBTH reserves the right to report your account to collections for the combined total of the original invoice amount and any moving or disposal charges.
Failure to Pick-Up Items. IF YOU FAIL TO PICK-UP ANY ITEMS WITHIN TWENTY-ONE (21) CALENDAR DAYS OF THE CLOSE OF BIDDING YOU WILL BE CONSIDERED TO HAVE FORFEITED THE ITEMS AND TITLE WILL REVERT TO EBTH. EBTH MAY, IN ITS ABSOLUTE AND SOLE DISCRETION, RESELL THE ITEMS OR DONATE THE ITEMS TO A CHARITY OF EBTH’S CHOOSING. EBTH RESERVES THE RIGHT TO CHARGE THE CREDIT CARD ON FILE FOR ANY MOVING OR DISPOSAL CHARGES.
13. Governing Law. This Agreement shall be governed in all respects by the laws of the State of Ohio, without regard to conflict of law provisions. You agree that any claim or dispute you may have against EBTH must be resolved exclusively by a state or federal court located in Hamilton County, Ohio.

A “Glamour in Bronze” series Art Deco bronze sculpture by the father of the Art Deco movement, the immortal Erte (Romain de Tirtoff, Russia & France, 1892-1990). Titled “Daydreams” with 23 Carat yellow gold leaf, red and gold patinas, gold link chain and polished embellishments. This magnificent bronze is of a sun kissed and glamorous raven haired beauty, relaxed, smoking a golden opium pipe while exposing her torso adorned with gold multi link chains which fall ever so perfectly down the small of her back, then connect to a golden blanket draped over her legs, as she rests on a bed table with golden supports, figural robed men wearing Chinese masks. This sculpture is one of a limited edition. The clay and then plaster model, the mold, the initial casting, and the patination were created under the supervision of the artist and were approved by him. The artist’s signature was signed in wax, from which a stamp was made and approved by the artist. Each casting is stamped with the artist’sA champion of the road, in striking black and chrome, a 2001 Victory V92C Deluxe motorcycle. Be the master of the main drag on this instant American classic. Made in Spirit Lake, Iowa this very well maintained bike is a sight to behold. Outfitted with black leather saddle bags, the piece also has black suede fringe on the handles, fenders and footrests, with a matte black 2-in-1 exhaust, making this formidable cruiser appear even more hard-core. The center marquise cut diamond measures 7mm and is 1.54 carats with SI2-clarity and I-color. The 18K yellow gold setting features four vertical rows, each with three channel set round diamonds, 24 in all. The 24 round diamonds are 1.25 carat total weight VS2-clarity and E-G color. Marked “14K” to the inside of the band.An exciting and beautifully presented Peter Max (New York, b. 1937), original mixed media, acrylic and color lithography on paper, titled “Walking in Reeds.” A brilliantly rendered piece from one of the masters of psychedelia, portraying a figure in a red robe and galero, perchance a papal reference, depicted standing along a shoreline dotted with reeds. Believed to be from his “Tidepool Refuge” series, the large vessel is sensationally designed, the shape of the walls of the vessel capturing the essence of the movement of water, the body of the piece filled with mollusk and coral – like shapes, mimicking the array of life found in the waters of the Pacific. Hawthorne is well known for his creation of massive vessels and sculptural pieces that convey the luminescent colors and shell-like forms of a mythical undersea world. Cleverly designed, each has a removable head so that the pieces could double as pitchers.A hand blown art glass bowl by well known Ohio glass artist Robert Eickholt (Columbus, Ohio, 20th, 21st century), in earth tones, with a mottled, swirled design in a loose configuration, the piece cased in clear glass, in a biomorphic shape. Signed on the base, dated 2002.A Peter Max (New York, b. 1937) mixed media with acrylic and color lithograph on paper, titled “New Moon,” completed in 2006, signed in acrylic in the upper right. An alluring piece by the master of the psychedelic genre, here a rather sweet moment rendered, a figure stands beneath an umbrella, against the rising moon, streaks of color filling the field. Housed in an ebonized frame with linen matte. Includes a certificate of authenticity from Park West Gallery.A handsome modern – contemporary Henredon shocase / display cabinet, in white washed oak, with canted corners, glazed beveled glass doors and side panels, , two tone pewter and brass tone door handles, with a dark brass colored metal band running around the top and base. The table, Art Deco in form, the large sculpted edge glass top supported by a curved base of white washed oak with brass tone trim. The chairs, a contemporary form of the Sheraton style, also in white washed oak, with open “wheel” back rests, over tapered, square legs, peach microfiber upholstery, with brass caps on the front legs. A great piece to show-off glass or sculpture.A gorgeous Erte limited Edition hand made crystal and bronze vase, made in collaboration with Baccarat titled “Sea Maidens Vase”. The full lead crystal vase is hand blown, hand cut, hand polished and etched to the bottom and side with Baccarat marks. The polished bronze figural mermaid handles were made with the lost wax process. One handle is etch signed “Erte” to the back of the one mermaid figure. The shell of the handle is stamped “1985” and notes that this piece is the first edition of 199 pieces made. Includes a Certificate of Authenticity from Benedetti Gallery of New York.A modern polychrome decorated Hopi vase, in russet, black and white, molded tapered body, with variant feather and linear designs on the shoulder and body. Includes a letter of authenticity; painted in 2000.An excellent, sinuous modern art pottery sculpture by well known Lexington, Kentucky ceramicist Wyman Rice. Aptly titled “Tranquility” the piece depicting a woman reclining in her bower, partially covered with a sheet. An elegant expressionistic piece, in Maimon’s inimitable style, with charm, elegance, spirit and sophistication. The piece is signed in the lower right and includes a certificate of authenticity from Sutton Galleries. Framed in a deep mahogany tone wooden molding frame with linen matte.A pair of gorgeous, and immaculately cared-for Art Deco – contemporary modern swiveling club chairs, asymmetrical in their lines, upholstered in a neutral faux suede microfiber.A dynamic and vivacious, blazingly colored original acrylic on wove paper by internationally renowned and well listed artist Jean Claude Picot (France, b. 1933). Accomplished in 2011, the piece is a fine example of his post-Impressionist / Expressionist / Fauvist style. Titled “Bateaux au Soleil” depicting what would normally be a rather bromidic, if not beautiful scene, enlivened by his point of view. The piece is housed in a wide gold and black painted wooden molding frame, and includes a certificate of authenticity.A set of six extraordinarily delicate modern art glass cordial glasses, each of a different form and color. Made in Italy for Vietri, the set is evocative of the designs of the Memphis group, albeit a bit more subtle and soft. Range in color from nearly colorless to a rose-crimson.A vintage Eastman Kodak 1-A Autographic Junior camera, with leather covering and original leather carrying case. A nice vintage decorative piece.A handsome men’s 14K yellow gold and diamond ring designed with three round diamonds set in a row to the center. The center diamond is 6.4mm and the diamonds to the right and left are slightly smaller at 5mm with all at 2.5 total carat weight. All the diamonds are SI2 clarity and H-I color. The gold setting has a mostly brushed gold texture to the sides with polished gold accents to the top and bottom edge. Ring size 11.5.A very nice 14K yellow gold omega necklace with push clasp and figure ‘8’ safety. Marked “14KT”. This piece measures 16″ × 6mm.A gorgeous earring and bracelet set in 14K white gold. The earrings are designed in a hinged hoop style with post backs which have a hinged closure. They are accented with .10 carat total weight of small diamonds and 3mm synthetic cabochon sapphires. 
The bracelet is a beaded mesh with hinged clasp and hoop which are accented with synthetic sapphire cabochons. The clasp is accented with 5 small diamonds having .08 carats total weight, SI1-2 clarity and I-J color. Marked “14K Italy” with a “B” mark to the bracelet clasp and the earrings.A compelling modern sculpture, in two parts, by well listed sculptor Itzik Benshalom (Israel, b. 1945), in verdigris and black patinated bronze, titled “#55”, a deceptively simple, sinuous depiction of a male and female figure, joined together, the base creating a perfect circle, the couple in intimate serenity. Each can be placed separately, as well. The piece bears Benshalom’s hand engraved signature, and is 60 in an edition of 100. Includes a certificate of authenticity from Nahan Galleries, noted as acquired directly from the artist.A Japanese inspired Raku tea vessel by Colorado Potter Richard Pankratz in hand formed ceramic white crackled glaze with a seafoam green wash and traditional metallic raku shades. The majestic lid is formed with hand hammered copper and carved mahogany which rests on metallic Raku, reminiscent of a Japanese headdress. Signed by Artist on side of vessel and incised signature to verso.
