Ohio Department of Agriculture Compliant Template
This document outlines the binding agreement between the bidder (hereinafter "Buyer") and [Thanasack Auctions LLC] (hereinafter "Auction Firm"), licensed by the Ohio Department of Agriculture. By registering for a bidder number or participating in any auction conducted on [thanasackauctions.com], the Buyer agrees to be bound by the following terms and conditions.
1. Licensing and Governance
All auctions are conducted in accordance with Ohio Revised Code Chapter 4707 and Ohio Administrative Code 901:8-2. The Auction Firm is licensed by the Ohio Department of Agriculture.
Auction Firm: Thanasack Auctions LLC
License Number: 2026000150
Governing Law: All disputes shall be governed by the laws of the State of Ohio, and venue shall be in Franklin County, Ohio.
Auction Types
Most auctions conducted by the Auction Firm are absolute. In an absolute auction, the item will be sold to the highest bidder regardless of the price. Please note that within an auction otherwise designated as absolute, individual lots may be on reserve if specified in the auction description and advertisements.
In contrast, in a reserve auction, the seller reserves the right to establish a minimum price, often referred to as a reserve, below which the item will not be sold.
In an Absolute Auction, the Seller is strictly prohibited from bidding on any items they have consigned. This prohibition ensures the integrity of the auction process and compliance with Ohio auction laws. (Reference: Ohio Administrative Code 901:8-2-01)
"Fake Bidding" or "Shill Bidding" refers to any bid made by the Seller, family members, or associates, with the express intent to artificially inflate the price of an item. Such bidding is strictly prohibited in accordance with Ohio Administrative Code 901:8-2-01.
The auctioneer and employees of the Auction Firm reserve the right to bid on items and may enter their own items into the auction, provided such actions strictly comply with all applicable laws and regulations.
Professional Disclaimer
We are proud to leverage our GIA professional training during auctions, offering educated insights to help guide the bidding process. Please note that these assessments are based on professional observations rather than formal laboratory appraisals, as we use various professional instruments, but this is not laboratory equipment. While we strive for accuracy, these insights are shared to be as helpful as possible and should be considered educational guidance rather than certified valuations. As with all human assessments, please understand that we may occasionally make mistakes, and we encourage all bidders to exercise their own due diligence through the various photos and provided videos if applicable.
2. Bidder Registration
All persons seeking to bid must register and provide valid identification via (Hibid thanasack auctions TBD). The Auction Firm reserves the right to refuse a bidder's number to any person at any time. By registering, the Buyer represents that they have the legal capacity to enter into a binding contract.
3. "As Is, Where Is" Sale
ALL ITEMS ARE SOLD "AS IS, WHERE IS" WITH ALL FAULTS.
Neither the Auction Firm nor the Seller makes any warranties or representations, express or implied, concerning the merchantability, fitness for a particular purpose, or condition of the items being sold.
-Descriptions are provided for informational purposes only. It is the buyers responsibility to review the descriptions for better assessment and understanding of the lots. The description may also include key pickup information as well as special condition reports. Please REVIEW the descriptions.
-The Buyer is responsible for inspecting items in the photos or during scheduled preview times if applicable prior to bidding.
-The failure of the Buyer to inspect an item shall not constitute grounds for a refund or price adjustment.
-Assume all jewelry related items are by total weight unless otherwise noted in the descriptions. While we strive for precision, gemstone and diamond measurements in mounted settings represent professional estimates only.
-All items are deemed to be and assumed to be untested unless otherwise stated.
4. Online Bidding & Technical Disclaimers
Internet Connectivity: The Buyer is solely responsible for maintaining a stable and secure internet connection. Bidders are encouraged to use a high-speed connection to ensure bids are transmitted in a timely manner.
Technical Liability: The Auction Firm and its platform providers are not liable for any technical errors, platform outages, hardware failures, or missed bids due to connectivity issues, server delays, or software glitches. The Auction Firm shall not be held responsible for bids not processed or accepted due to these factors.
Soft Close / Dynamic Bidding: Auctions may utilize a "soft close" feature. If a bid is placed within the final minutes of a lot's closing time (typically the last approximately 60 seconds), the bidding window for that specific lot will be automatically extended for an additional increment. This process continues until no further bids are received, ensuring all bidders have a fair opportunity to respond.
5. Bidding Process and "Sold" Status
The highest bidder acknowledged by the auctioneer shall be the Buyer. In the event of a dispute between bidders, the auctioneer has the final discretion to determine the successful bidder or to re-offer the item for sale. All bids are final and cannot be reversed or retracted once the auction lot has closed.
In addition to these terms, the Buyer must abide by the separate user agreement and policies of the HiBid platform, which governs the online bidding interface.
Contract Formation: Once the auctioneer says "Sold" (or the online clock expires), a binding contract is formed between the Buyer and the Seller.
