Salem Auction House Terms & Conditions. All property is sold AS IS, WHERE IS and ALL SALES ARE FINAL. Neither Salem Auction House LLC or the Consignor makes any representation or warranty, expressed or implied, as to the merchantability, fitness, or condition of the property or as to the correctness of description, genuineness, attribution, provenance, or period of the property. All measurements are approximate. In the case of vintage clothing, assume there are stains. By registering for a bidding number, either in person, on-line or when placing an absentee, telephone, or facsimile (fax) bid, you agree to these Terms & Conditions of Sale. ALL SALES ARE FINAL. No refunds, no exchanges, no returns, no warranties expressed or implied.

Be aware that any display items (jewelry necks or trays, baskets, boxes, etc.) are used for display only and are the property of Salem Auction House LLC. If the display item is included in the lot, it will be noted in the description.

A premium of twenty (20) percent will be added to the winning bid for all online bidders. Additionally, online purchasers are responsible for all shipping and transport charges if they choose not to pick their item up.

Salem Auction House LLC requires agreement to all Terms & Conditions.

On the fall of the Auctioneer?s hammer, title to the offered lot or article passes to the highest bidder who assumes full risk and responsibility thereof.

All State and Federal laws will be observed regarding the sale of handguns. If you are not a resident of Oregon, you must have a current Federal Firearms License to take delivery of firearms or have an FFL holder in your state take delivery of firearms for you. Firearms purchases are subject to a $15 background check fee.

All purchases are to be paid for in Cash, a Cashier?s Check, VISA, MasterCard, AMEX, or Discover, during or immediately after each Auction. Salem Auction House LLC reserves the option to hold purchases until authorization is obtained on credit cards or Cashier?s Checks. No lot may be transferred to another buyer. Invoice payments will be run automatically post auction if prior arrangements have not been made with Salem Auction House.

Purchases may be removed during or at the conclusion of each auction session beginning at time of Auction. Additionally, local pickups can be arranged during Salem Auction House LLC?s business hours (listed within terms of each auction). Salem Auction House is located at 2828 Cherry Ave NE Salem OR 97301. Assume all pickups are at this location unless specified otherwise in auction instructions.

Purchases must be picked up within 10 days (unless arrangements have been made) or they will be considered abandoned.

Should Salem Auction House LLC be prevented by fire, theft, or any reason whatsoever from delivery of any property to the purchaser, our liability shall be limited to the sum actually paid by the purchaser.

Salem Auction House LLC reserves the right to withdraw any property at any time before actual sale or reject a bid from any bidder. Salem Auction House LLC team members may participate in public auctions if they wish and is publicly disclosing this information.

Auctioneer sets minimum bids at time of sale. If no bids reach that amount the item will be passed. It may or may not be offered in our next auction. The starting bid amount online may be too low and will not be honored if Auctioneer does not go that low during the Auction.

Shipping and handling charges must be paid within 5 business days of invoice generation or items will be subject to storage fees (amount at discretion of Salem Auction House dependent on size and time) or may be considered abandoned at the discretion of Salem Auction House.

Privacy and Data Protection

We use collected information, including Personal Data, to make available and to improve our high standard of reliable services. We use such information to:

Respond to inquiries or service requests and monitor such responses;
Provide information about and market our products or services;
Enable transactions conducted between you and the Salem Auction House using the Application;
Resolve problems; and
Manage the Site and Application and assess usage of the Services.
We will retain Personal Data for as long as you continue to use the Site and/or Application and as long as is necessary thereafter to meet our obligations to the Salem Auction House or other legal obligations. We use third-party credit card processors to process payments for auction items that you choose to make through the Services. To make this possible, your name, billing address and order total are shared via secure (encrypted) means with our third-party payment processors for the sole purpose of completing your order. Please note that your credit card information (number, expiration date, security code) is stored by the third-party payment processor and not us. We have entered into agreements (including data processing agreements for our users located in the European Economic Area) with our payment processors to protect and secure your information. We may disclose Personal Data to our third-party service providers to provide you with the Services, including our third party payment processor. We share Aggregate Information with companies that provide public relations and marketing services for us. Such information will only be shared by us to customize, measure and improve our Site, Application and Services. We may disclose information, including Personal Data, which we believe is appropriate to protect our rights, or to cooperate in investigations of fraud or other illegal or inappropriate activity or in response to a subpoena, court order or other comparable legal process. If a subpoena seeks information about an identified user or limited group of users, we?ll make reasonable business efforts, if permitted, to contact the user(s) before providing information to the party that requests it. We cannot guarantee that we will be able to contact the user(s) in all cases.

We may disclose Personal Data to your agent or legal representative (such as the holder of a power of attorney that you grant, or a guardian appointed for you) and may request identity verification before disclosing Personal Data in such a case.

As with any other business, it is possible that in the future we could merge with or be purchased by another company. If we are acquired, the company that acquires us would have access to the information maintained by us, including Personal Data, but would continue to be bound by this Privacy Policy unless and until it is amended.

You may view, change, or access your Personal Data at any time by logging into the Services and changing your account information. If you?d like to delete your Individual Information that you have provided in connection with the Services, please contact us at jake@salemauctionhouse.com.

We have implemented industry standard information security practices including administrative, physical, and technical measures to protect your Personal Data from loss, misuse, or unauthorized access, disclosure, alteration, or destruction. The security of your account relies on your protection of your password and mobile device(s). You are responsible for maintaining the security of your password. You are solely responsible for all activities that occur under your account or on your mobile device. You may not share your password or Services account with anyone. We will never ask you to send your password or other sensitive information to us in an email, though we may ask you to enter this type of information on the Site or the Application interface. If you believe someone else has obtained access to your password, please change it immediately. If you believe that an unauthorized access has already occurred, please report it immediately at jake@salemauctionhouse.com. You must promptly notify us if you become aware that any information provided by or submitted to in connection with the Services is lost, stolen, or used without permission.
