IMPORTANT: PLEASE READ ALL TERMS AND CONDITIONS BEFORE BIDDING.
By registering for and participating in this auction, you acknowledge that you have read, understand, and agree to be bound by the following Terms and Conditions. Failure to read or understand these terms does not relieve bidders of their responsibilities or obligations.ALL BIDS ARE BINDING. ALL SALES ARE FINAL.
PAYMENT TERMS: All credit cards on file will be automatically charged within 24 hours of the auction's closing unless otherwise specified.Searchlight Auction reserves the right to require payment by certified funds, cashier's check, or wire transfer for any transaction totaling $1,000 or more. Additional buyer verification, including a valid driver's license, government-issued photo identification, or credit card verification, may also be required.The auction house reserves the right to require payment by wire transfer for any purchase, regardless of the transaction amount, at its sole discretion.Buyers wishing to pay in cash must notify the auction house before the auction begins. Personal or business checks may be accepted from established customers at the auction house's discretion. All checks must be made payable to Searchlight Auction.Payment for purchased items does not include shipping, handling, or other applicable fees.
BUYER'S PREMIUM, PROCESSING FEES & SALES TAX: A 24% buyer's premium will be added to the final hammer price of each lot.An additional 3% processing fee will apply to transactions paid by credit card. Pennsylvania's 6% sales tax will be collected on applicable purchases unless a valid sales tax exemption is provided.Tax-exempt buyers must submit a completed and valid exemption certificate to svauction@live.com before the auction begins. Out-of-state exemption documentation may be accepted where permitted under Pennsylvania law.Buyers are responsible for all applicable premiums, processing fees, taxes, shipping charges, and handling fees associated with their purchases.
ITEM PICKUP & SCHEDULING: All pickups are by appointment only.Unless otherwise specified in the auction listing, purchased items may be collected at:Searchlight / Saucon Valley Auction1801 Union Blvd., Suite 105Allentown, PA 18109. Following the auction, successful bidders will receive an email or text message through Shipping Saint containing instructions for scheduling pickup or requesting shipping.Buyers must select an available pickup appointment through the provided link. If none of the available appointment times are suitable, please contact us at 610-216-2011 to discuss alternative arrangements.All purchased items must be picked up within seven (7) calendar days of the auction's closing unless prior arrangements have been approved by the auction house.Items not collected within the required timeframe may be considered abandoned and subject to resale. The auction house reserves the right to apply applicable storage fees and other charges in accordance with these Terms and Conditions.Please confirm your ability to retrieve purchased items before placing a bid.
SHIPPING & HANDLING: Shipping is available for eligible items at the buyer's expense and is not included in the purchase price.Smaller items may qualify for in-house shipping, subject to applicable postage, packing, materials, and handling fees. Shipping services are generally completed after scheduled local pickups have concluded.Buyers requesting shipping must select the shipping option through the Shipping Saint link provided after the auction. This places their order in the shipping queue.Once items have been packed and shipping costs calculated, an invoice will be sent electronically. Please check your spam or junk folder, as automated notifications may occasionally be filtered by your email provider.Shipping charges must be paid before packages are released for shipment.If a buyer fails to pay the applicable shipping charges or make satisfactory arrangements for their items, the auction house reserves the right to consider those items abandoned, subject to applicable notice requirements, and offer them for resale.Any such resale will be subject to a 35% commission plus applicable lotting fees, with proceeds applied toward outstanding charges and fees to the extent permitted by law.Buyers are encouraged to contact the auction house before bidding if they have questions concerning shipping eligibility, oversized items, or estimated shipping expenses.
ITEM CONDITION, DESCRIPTIONS & AUTHENTICITY. ALL ITEMS ARE SOLD AS IS, WHERE IS, WITH NO WARRANTIES OR GUARANTEES, EXPRESS OR IMPLIED, TO THE EXTENT PERMITTED BY LAW: It is the bidder's responsibility to carefully review all photographs, descriptions, and available information before placing a bid.Searchlight Auction makes reasonable efforts to provide accurate descriptions and disclose known information regarding the items offered for sale. However, descriptions may incorporate information supplied by consignors or other third parties, and the auction house cannot guarantee the accuracy or completeness of such information.Neither Searchlight Auction nor the consignor makes any warranty or representation regarding an item's:Authenticity, genuineness, or authorshipAttribution, provenance, or historical significanceAge, period, culture, or country of origin. FINAL SALES & BIDDING OBLIGATIONSALL SALES ARE FINAL. NO RETURNS, EXCHANGES, OR REFUNDS WILL BE ACCEPTED, EXCEPT AS REQUIRED BY APPLICABLE LAW: All bids constitute binding offers to purchase. Successful bidders are responsible for completing payment and arranging pickup or shipping in accordance with these Terms and Conditions.Failure to read the auction listing, review the item's description, or understand the applicable fees and requirements does not excuse a bidder from their obligations.In the event of technical difficulties, platform interruptions, or other circumstances affecting the auction process, Searchlight Auction reserves the right to extend, postpone, suspend, or reschedule the auction when reasonably necessary.
RESERVES & AUCTIONEER DISCRETION: Certain lots may be offered subject to a confidential reserve price established by agreement between the consignor and Searchlight Auction.A reserve represents the minimum amount at which the consignor has authorized the item to be sold. Where applicable, the auction house may execute bids on behalf of the consignor up to the established reserve, as permitted by applicable law.The auctioneer reserves the right to reject bids deemed insufficient or inconsistent with the value of an item.The highest qualified bidder, as determined by the auctioneer, shall be recognized as the successful purchaser.In the event of a disputed bid, bidding irregularity, or other auction-related disagreement, the auctioneer shall have discretion, subject to applicable law, to determine the successful bidder, withdraw the lot, or offer the lot for sale again.
BUYER VERIFICATION & FRAUD PREVENTION: To protect buyers, consignors, and the auction house, additional verification procedures may be required before payment is accepted or purchased items are released.New Bidders: Purchases made by new or unverified bidders may be temporarily held while payment information, identity, and transaction details are reviewed through applicable payment processors and auction platforms.Purchases of $1,000 or More: Transactions totaling $1,000 or more may require additional identity verification or payment through guaranteed funds, particularly for buyers without an established transaction history.Precious Metals & High-Value Purchases: Purchases involving substantial quantities of gold, silver, or other precious metals may require additional verification and payment by certified funds or wire transfer.Searchlight Auction reserves the right to delay the release or shipment of purchased items until all necessary verification procedures have been satisfactorily completed.
FAILURE TO PAY, ABANDONED ITEMS & RESALE: Successful bidders are responsible for paying their invoices in full and retrieving or arranging shipment of their purchases within the designated timeframe.Failure to complete payment, pay shipping charges, or collect purchased items within the required period may result in the items being deemed abandoned, subject to applicable notice requirements and Pennsylvania law.Where permitted, Searchlight Auction reserves the right to:Assess applicable storage, handling, and administrative fees.Cancel or terminate the transaction.Resell unclaimed or abandoned items.Apply resale proceeds toward outstanding charges, commissions, and applicable lotting fees.Restrict or suspend future bidding privileges. Failure to read the Terms and Conditions, arrange transportation, or respond to pickup and shipping notifications does not release a bidder from their contractual obligations.
GOVERNING LAW & JURISDICTION: These Terms and Conditions shall be governed by and interpreted in accordance with the laws of the Commonwealth of Pennsylvania.Any legal action arising from or relating to participation in this auction, purchases made through the auction, or enforcement of these Terms and Conditions shall be subject to the jurisdiction of the appropriate state or federal courts located within Pennsylvania.By participating in the auction, bidders consent to the nonexclusive jurisdiction of such courts and waive objections to venue to the extent permitted by applicable law.
