Oliver Auctions Estate Sale Terms and Conditions
By participating in this estate sale, all buyers, sellers, and attendees agree to the following terms and conditions. These rules govern the sale and are binding on all participants.
1. All Sales Are Final
All items are sold "as-is," "where-is," with no warranties or guarantees, expressed or implied.
There are no returns, exchanges, or refunds on any items purchased.
Buyers are responsible for inspecting items before purchasing. All sales are final upon payment.
2. Payment Terms
Payment is due in full at the time of purchase.
Accepted payment methods include cash, major credit cards, and debit cards. Personal checks are accepted only at the discretion of Oliver Auctions.
All applicable taxes must be paid unless the buyer provides a valid tax-exempt certificate at the time of purchase.
3. Item Condition and Descriptions
Oliver Auctions provides descriptions and condition reports of items to the best of its knowledge, but makes no guarantees on accuracy.
Buyers are encouraged to inspect items prior to purchase as Oliver Auctions makes no warranties regarding an item’s authenticity, age, condition, or origin.
All items are sold in their present, used condition, and may contain signs of wear and tear.
4. Pickup and Removal of Items
All purchased items must be removed from the estate sale location by the end of the sale or at a pre-arranged pickup time agreed upon by both parties.
Buyers are responsible for providing the necessary labor, packaging materials, and transportation for the removal of items.
If items are not picked up by the designated time, Oliver Auctions reserves the right to dispose of or resell the items, and no refunds will be provided. Storage fees may also apply.
5. Responsibility and Liability
Buyers are responsible for the safe and lawful removal and transportation of their purchased items.
Oliver Auctions and the property owner are not responsible for accidents, injuries, or damage that occurs on the premises during the estate sale or while loading/unloading items.
Oliver Auctions assumes no responsibility for lost, stolen, or damaged items once they have been purchased.
6. Conduct at the Sale
Attendees are expected to behave respectfully and courteously toward other buyers, staff, and the property owner.
Disruptive behavior, including pushing, line-cutting, or interfering with others' purchases, will not be tolerated.
Anyone found causing a disturbance may be asked to leave the sale without recourse.
7. Property Access and Care
Entry into the estate sale is at the participant’s own risk. Oliver Auctions is not responsible for accidents or injuries that occur on the property.
Attendees are expected to be respectful of the property and the items for sale. Any damage caused by attendees will be their responsibility.
8. No Early Access or Holding of Items
No early access to the sale or presales will be granted unless otherwise specified.
Items are available on a first-come, first-served basis, and Oliver Auctions does not hold items without full payment.
9. Dispute Resolution
In the event of a dispute regarding ownership, pricing, or other matters related to the estate sale, Oliver Auctions reserves the right to make the final decision.
If an item is mistakenly listed or priced incorrectly, Oliver Auctions reserves the right to cancel the sale of that item and refund the payment.
10. Modifications to Terms and Conditions
Oliver Auctions reserves the right to modify or update these terms and conditions at any time before or during the estate sale.
Any changes will be communicated on-site or through appropriate communication channels.
11. Governing Law
These terms and conditions are governed by the laws of the Commonwealth of Pennsylvania.
Any disputes arising from the estate sale will be subject to the jurisdiction of the courts in Westmoreland County, Pennsylvania.
