ONLINE AUCTION TERMS & CONDITIONS
**GoldenTree Team LLC**
By registering for an auction, placing a bid, or otherwise participating in an auction conducted by GoldenTree Team LLC (“GoldenTree,” “Auction Company,” “we,” “us,” or “our”), each bidder (“Bidder” or “Buyer”) acknowledges that they have read, understood, and voluntarily agree to be legally bound by these Terms & Conditions, together with any additional terms, notices, pickup instructions, or conditions posted for the individual auction or lot.
**DO NOT BID UNLESS YOU HAVE READ AND AGREE TO THESE TERMS.**
1. BIDS ARE LEGALLY BINDING
Placing a bid constitutes a serious and legally binding commitment to purchase the item if the Bidder is declared the successful/high bidder.
Bidders are responsible for all bids placed through their accounts. A Bidder may not cancel, retract, or reduce a bid merely because the Bidder changed their mind, made an error, failed to inspect an item, misunderstood the description, or failed to account for applicable premiums, taxes, pickup requirements, or other charges, except where withdrawal is expressly permitted by applicable law, the auction platform, or GoldenTree.
Once a Bidder is declared the successful purchaser of a lot, the resulting purchase obligation is binding.
Failure to complete a purchase may result in suspension or termination of bidding privileges, collection activity, recovery of damages or expenses, and any other remedies available to GoldenTree or the Seller.
2. AGREEMENT TO TERMS
By clicking or selecting “Bid,” “Place Bid,” “Confirm Bid,” or any similar function on the auction platform, the Bidder represents that:
* The Bidder has reviewed and accepts these Terms & Conditions.
* The Bidder is legally capable of entering into a binding contract.
* The Bidder is responsible for all activity conducted through their bidding account.
* The Bidder has reviewed the applicable lot description, photographs, pickup information, buyer’s premium, and other auction-specific information before bidding.
* The Bidder understands that bids may result in a legally enforceable purchase obligation.
The Bidder's failure to actually read these Terms does not relieve the Bidder of their obligations after agreeing to them and participating in the auction, to the extent permitted by law.
3. ALL PROPERTY SOLD “AS IS, WHERE IS”
All merchandise is sold **AS IS, WHERE IS, WITH ALL FAULTS**, without warranties or guarantees except as expressly stated in writing by GoldenTree.
Items offered through estate auctions are generally previously owned and may exhibit age, wear, damage, repairs, alterations, missing components, odors, staining, fading, deterioration, restoration, or other conditions consistent with their age and prior use.
Unless expressly stated otherwise, GoldenTree makes no warranty or representation concerning:
* Condition
* Quality
* Merchantability
* Fitness for a particular purpose
* Age or date
* Manufacturer or maker
* Origin or provenance
* Authenticity
* Attribution
* Completeness
* Working condition
* Materials or metal content
* Gemstone identity or quality
* Measurements or weight
* Rarity
* Value or future value
Any descriptions, photographs, measurements, opinions, dates, attributions, or other information are provided as a convenience to bidders and represent GoldenTree's good-faith assessment based on available information.
4. BIDDER INSPECTION & DUE DILIGENCE
It is the Bidder's responsibility to evaluate an item before bidding.
Bidders should carefully review all photographs, descriptions, condition information, measurements, and other available information and request additional information when necessary before placing a bid.
Where an in-person preview is offered, bidders are encouraged to inspect items personally or through a qualified representative.
The absence of a reference to damage, restoration, alteration, defects, missing pieces, or other condition issues does not mean that such conditions do not exist.
A Bidder's inability or failure to inspect an item does not constitute grounds for cancellation, refund, return, or chargeback.
5. PHOTOGRAPHS & DESCRIPTIONS
Photographs form part of the lot description and should be reviewed carefully.
Colors, dimensions, proportions, and appearance may vary due to lighting, photography, monitor settings, camera equipment, perspective, or other factors.
Measurements, dimensions, weights, dates, materials, and other specifications are approximate unless specifically represented otherwise.
GoldenTree makes reasonable efforts to provide accurate descriptions but does not guarantee that descriptions or photographs are free from errors or omissions.
GoldenTree reserves the right to correct descriptions, photographs, catalog information, or other errors prior to the closing of a lot.
6. AUTHENTICITY, ATTRIBUTION & MAKER IDENTIFICATION
Unless expressly accompanied by a written guarantee from a qualified third-party authenticator, references to an artist, designer, maker, manufacturer, period, style, origin, material, or attribution should be considered GoldenTree's good-faith opinion based upon available information and not an expert authentication or warranty.
Signatures, marks, labels, stamps, certificates, boxes, paperwork, or other identifying information may be photographed or described but are not independently guaranteed unless expressly stated.
Bidders purchasing high-value art, jewelry, collectibles, designer merchandise, antiques, or other items where authenticity is material to their purchasing decision should perform their own independent research and due diligence before bidding.
7. PRECIOUS METALS & JEWELRY
Marked precious-metal items may be described according to the visible hallmark or stamp. GoldenTree does not guarantee that a hallmark is authentic or that every component of an item has the same metal content.
Unmarked silver or other precious-metal jewelry may occasionally be acid tested as a general indication of metal content. Acid testing is not laboratory analysis and does not guarantee exact purity, fineness, or composition.
Metal content may vary throughout an item, and components such as clasps, findings, pins, solder, chains, settings, or replacement parts may contain different metals or levels of purity.
Unless expressly accompanied by professional documentation, gemstones, diamonds, precious metals, weights, treatments, grades, and related descriptions should be considered approximate and are not guaranteed.
8. BUYER'S PREMIUM, TAXES & FEES
A buyer's premium may be added to the winning bid amount. The applicable buyer's premium will be disclosed through the auction listing or auction platform.
Applicable sales tax, shipping charges, handling charges, credit-card fees where legally permitted, or other disclosed charges may also apply.
Bidders are responsible for reviewing the total applicable fees before bidding.
Tax-exempt purchasers must provide valid exemption documentation in accordance with applicable requirements before the applicable transaction is processed.
9. PAYMENT
Successful bidders are responsible for full and timely payment of all purchases, premiums, taxes, and applicable fees.
GoldenTree and/or the auction platform may charge the payment method associated with the Bidder's account in accordance with the auction-specific terms and platform rules.
A declined card, expired card, insufficient funds, payment dispute, or other payment problem does not cancel the Buyer's purchase obligation.
GoldenTree reserves the right to require an alternate form of payment, certified funds, wire transfer, identification, or additional verification for any transaction when reasonably necessary.
Items may be withheld until payment has cleared.
10. CREDIT CARD DISPUTES & CHARGEBACKS
Buyers agree to contact GoldenTree promptly regarding a disputed transaction before initiating a payment dispute or chargeback whenever reasonably possible.
A chargeback or payment dispute does not automatically cancel the Buyer's contractual obligation to pay for merchandise validly purchased.
If a Buyer initiates a chargeback concerning a valid auction purchase, GoldenTree may provide the payment processor, financial institution, auction platform, or other applicable party with bidding records, acceptance of these Terms, invoices, photographs, pickup or shipping records, correspondence, and other documentation relevant to the transaction.
Nothing in these Terms is intended to waive any non-waivable rights a consumer may have under applicable law.
11. AUCTION CLOSING & EXTENDED BIDDING
Online auctions may utilize staggered closing, soft closing, extended bidding, or other automated closing procedures.
If a bid is received within a designated period before a lot is scheduled to close, the bidding period may automatically extend in accordance with the rules of the auction platform.
Bidders are responsible for understanding the closing procedure before bidding.
The time displayed by the auction platform, rather than a Bidder's personal computer, phone, or clock, controls for purposes of determining auction closing times.
12. RESERVE PRICES & WITHDRAWAL OF LOTS
Unless expressly identified as an auction “without reserve,” auctions and lots may be offered with reserve to the extent permitted by applicable law.
GoldenTree reserves the right, subject to applicable law, to withdraw, combine, separate, modify, or remove lots before completion of the sale and to reject bids when reasonably necessary to protect the Seller, the integrity of the auction, or correct an error.
Certain lots may also be subject to confidential minimum prices or Seller reserves where disclosed or legally permitted.
13. AUCTIONEER DISCRETION & BIDDING DISPUTES
GoldenTree reserves the right to reject or disqualify any bid or Bidder when reasonably necessary, including suspected fraudulent activity, bidding irregularities, payment concerns, violations of these Terms, or conduct that interferes with the auction.
If a bidding dispute, technical problem, duplicate bid, platform error, or other irregularity occurs, GoldenTree may take any action reasonably necessary and permitted by law, including reopening bidding, rejecting a bid, correcting an administrative error, or withdrawing a lot.
GoldenTree's determination regarding the administration of the auction will control to the extent permitted by applicable law.
14. TECHNICAL PROBLEMS
Online auctions depend upon third-party software, internet connections, servers, devices, and other technology outside GoldenTree's direct control.
GoldenTree is not responsible for missed bids, internet outages, software errors, platform interruptions, delayed transmissions, device failures, notification failures, browser incompatibility, or other technical issues beyond GoldenTree's reasonable control.
Bidders should not wait until the final seconds of an auction to place a bid.
If a significant technical problem affects the fairness or operation of an auction, GoldenTree reserves the right to extend, postpone, reopen, cancel, or otherwise modify the affected auction or lot when legally permissible.
15. PICKUP
Successful bidders are responsible for reviewing and complying with all posted pickup dates, times, locations, and instructions **before bidding**.
The inability to attend the scheduled pickup is not grounds for cancellation or refund.
Buyers are responsible for bringing appropriate labor, equipment, tools, vehicles, packing materials, and assistance necessary to safely remove their purchases unless otherwise expressly stated.
GoldenTree personnel are not obligated to move, carry, dismantle, load, package, or transport purchased property.
Buyers are responsible for any damage caused by themselves or persons acting on their behalf while removing property.
16. FAILURE TO PICK UP / ABANDONED PROPERTY
Items not removed by the stated pickup deadline may, to the fullest extent permitted by law and subject to the auction-specific terms, be considered abandoned.
No refund will be owed solely because a Buyer failed to pick up merchandise within the required period.
Abandoned property may be disposed of, donated, resold, returned to the estate, or otherwise handled at GoldenTree's discretion as permitted by law.
The original Buyer may remain responsible for the purchase price and any reasonable storage, handling, removal, disposal, collection, or related expenses permitted by law.
17. SHIPPING
Shipping is available when specifically stated.
For auctions where only jewelry and small items offered for auction, we typically provide in-house shipping. We use USPS priority flat rate boxes and charge a $5 handling fee for each invoice regardless of how many items. Insurance and signature confirmation may be added depending on the value of the item.
When third party shipping is offered or arranged, the Buyer is responsible for applicable packing, handling, shipping, insurance, and third-party service charges. These rates are not set or controlled by GoldenTree.
If shipping is performed by an independent third-party shipper, that shipper is an independent service provider and not an employee or agent of GoldenTree unless expressly stated otherwise.
Risk associated with shipping will be allocated in accordance with applicable law, the carrier's terms, and any auction-specific shipping provisions.
Buyers are strongly encouraged, and may be required, to purchase appropriate shipping insurance for valuable merchandise.
18. NO RETURNS, REFUNDS OR EXCHANGES
**ALL SALES ARE FINAL.**
Unless GoldenTree expressly agrees otherwise in writing or applicable law requires otherwise, no refunds, credits, exchanges, cancellations, or returns will be provided based upon condition, buyer's remorse, failure to inspect, inability to pick up, differences of opinion regarding attribution or value, or other matters that were available for the Buyer to evaluate before bidding.
19. TITLE & RISK OF LOSS
Title, possession, and risk of loss will transfer in accordance with applicable law and the auction-specific terms.
GoldenTree may retain possession of merchandise until all amounts owed have been paid in full and cleared.
20. ESTATE PROPERTY & THIRD-PARTY CONSIGNMENTS
GoldenTree generally acts as an agent for an estate, owner, trustee, executor, consignor, or other Seller and does not necessarily own the property being offered.
GoldenTree relies in part upon information provided by Sellers and other third parties and cannot independently verify every representation concerning the history or ownership of every item.
21. RIGHT TO REFUSE SERVICE
GoldenTree reserves the right to suspend, block, or permanently revoke bidding privileges when reasonably necessary because of unpaid invoices, abandoned purchases, fraudulent conduct, abusive behavior, repeated violations of auction rules, interference with an auction, or other legitimate business or security concerns.
22. ACCOUNT SECURITY
Bidders are responsible for maintaining the confidentiality and security of their auction accounts, usernames, passwords, payment methods, and devices.
Bids placed through a Bidder's account will be treated as authorized by that Bidder unless applicable law requires otherwise.
Bidders must immediately notify the applicable auction platform and GoldenTree if they believe their account has been compromised.
23. MINORS
Bidders must be at least 18 years old and legally capable of entering into a binding contract unless a higher minimum age is required by applicable law or the auction platform.
24. PERSONAL PROPERTY ONLY
Unless expressly stated otherwise, these Terms apply to auctions involving personal property and estate contents. Real estate, titled vehicles, regulated goods, alcoholic beverages, firearms, or other specially regulated property may be subject to separate terms and legal requirements.
25. COMPLIANCE WITH LAW
Bidders and Buyers are responsible for complying with all laws applicable to their purchase, possession, transportation, shipment, or use of purchased property.
GoldenTree reserves the right to refuse or cancel a transaction when completing the transaction would violate applicable law.
26. LIMITATION OF LIABILITY
To the fullest extent permitted by applicable law, GoldenTree, its owners, employees, contractors, representatives, and Sellers will not be liable for indirect, incidental, special, exemplary, or consequential damages arising from participation in an auction, use of the auction platform, inability to place a bid, condition of merchandise, pickup, removal, or transportation of purchased property.
To the fullest extent permitted by applicable law, GoldenTree's liability relating to a particular purchased lot will not exceed the amount actually paid to GoldenTree for that lot.
Nothing in these Terms excludes liability that cannot legally be excluded or limited.
27. INDEMNIFICATION
To the fullest extent permitted by law, a Bidder or Buyer agrees to indemnify and hold harmless GoldenTree, its owners, employees, contractors, representatives, and the Seller from claims, damages, losses, liabilities, or reasonable expenses arising from the Bidder's or Buyer's violation of these Terms, unlawful conduct, or negligent acts during pickup, removal, transportation, or handling of purchased property.
28. PLATFORM TERMS
Auctions conducted through a third-party online auction platform may also be subject to that platform's separate terms, policies, bidding rules, payment requirements, and privacy practices.
If an auction-specific term or platform requirement differs from these general Terms, GoldenTree reserves the right to apply the auction-specific provision to the extent permitted by law.
29. MODIFICATION OF TERMS
GoldenTree may update these Terms periodically.
The Terms and auction-specific conditions presented or made available to a Bidder at the time the Bidder participates in an auction will govern that participation.
Auction-specific announcements, notices, or written conditions may supplement these Terms.
30. SEVERABILITY
If any provision of these Terms is determined to be invalid or unenforceable, that provision will be enforced to the maximum extent permitted by law or severed as appropriate, and the remaining provisions will remain in effect.
31. GOVERNING LAW & VENUE
These Terms and each auction will be governed by the laws applicable to the jurisdiction in which the auction is legally conducted, without giving effect to conflict-of-law principles, except where applicable law requires otherwise.
Any specific governing-law, venue, arbitration, or dispute-resolution provision posted for an individual auction will supplement or supersede this section as applicable.
32. ENTIRE AGREEMENT
These Terms, together with any auction-specific terms, lot descriptions, notices, invoices, and applicable auction-platform terms, constitute the agreement governing the Bidder's participation in the auction.
By registering, bidding, or purchasing, the Bidder acknowledges and agrees to these Terms & Conditions.

Online auctions depend upon third-party software, internet connections, servers, devices, and other technology outside GoldenTree's direct control.
GoldenTree is not responsible for missed bids, internet outages, software errors, platform interruptions, delayed transmissions, device failures, notification failures, browser incompatibility, or other technical issues beyond GoldenTree's reasonable control.
Bidders should not wait until the final seconds of an auction to place a bid.
If a significant technical problem affects the fairness or operation of an auction, GoldenTree reserves the right to extend, postpone, reopen, cancel, or otherwise modify the affected auction or lot when legally permissible.
15. PICKUP
Successful bidders are responsible for reviewing and complying with all posted pickup dates, times, locations, and instructions **before bidding**.
The inability to attend the scheduled pickup is not grounds for cancellation or refund.
Buyers are responsible for bringing appropriate labor, equipment, tools, vehicles, packing materials, and assistance necessary to safely remove their purchases unless otherwise expressly stated.
GoldenTree personnel are not obligated to move, carry, dismantle, load, package, or transport purchased property.
Buyers are responsible for any damage caused by themselves or persons acting on their behalf while removing property.
16. FAILURE TO PICK UP / ABANDONED PROPERTY
Items not removed by the stated pickup deadline may, to the fullest extent permitted by law and subject to the auction-specific terms, be considered abandoned.
No refund will be owed solely because a Buyer failed to pick up merchandise within the required period.
Abandoned property may be disposed of, donated, resold, returned to the estate, or otherwise handled at GoldenTree's discretion as permitted by law.
The original Buyer may remain responsible for the purchase price and any reasonable storage, handling, removal, disposal, collection, or related expenses permitted by law.
17. SHIPPING
Shipping is available when specifically stated.
For auctions where only jewelry and small items offered for auction, we typically provide in-house shipping. We use USPS priority flat rate boxes and charge a $5 handling fee for each invoice regardless of how many items. Insurance and signature confirmation may be added depending on the value of the item.
When third party shipping is offered or arranged, the Buyer is responsible for applicable packing, handling, shipping, insurance, and third-party service charges. These rates are not set or controlled by GoldenTree.
If shipping is performed by an independent third-party shipper, that shipper is an independent service provider and not an employee or agent of GoldenTree unless expressly stated otherwise.
Risk associated with shipping will be allocated in accordance with applicable law, the carrier's terms, and any auction-specific shipping provisions.
Buyers are strongly encouraged, and may be required, to purchase appropriate shipping insurance for valuable merchandise.
18. NO RETURNS, REFUNDS OR EXCHANGES
**ALL SALES ARE FINAL.**
Unless GoldenTree expressly agrees otherwise in writing or applicable law requires otherwise, no refunds, credits, exchanges, cancellations, or returns will be provided based upon condition, buyer's remorse, failure to inspect, inability to pick up, differences of opinion regarding attribution or value, or other matters that were available for the Buyer to evaluate before bidding.
19. TITLE & RISK OF LOSS
Title, possession, and risk of loss will transfer in accordance with applicable law and the auction-specific terms.
GoldenTree may retain possession of merchandise until all amounts owed have been paid in full and cleared.
20. ESTATE PROPERTY & THIRD-PARTY CONSIGNMENTS
GoldenTree generally acts as an agent for an estate, owner, trustee, executor, consignor, or other Seller and does not necessarily own the property being offered.
GoldenTree relies in part upon information provided by Sellers and other third parties and cannot independently verify every representation concerning the history or ownership of every item.
21. RIGHT TO REFUSE SERVICE
GoldenTree reserves the right to suspend, block, or permanently revoke bidding privileges when reasonably necessary because of unpaid invoices, abandoned purchases, fraudulent conduct, abusive behavior, repeated violations of auction rules, interference with an auction, or other legitimate business or security concerns.
22. ACCOUNT SECURITY
Bidders are responsible for maintaining the confidentiality and security of their auction accounts, usernames, passwords, payment methods, and devices.
Bids placed through a Bidder's account will be treated as authorized by that Bidder unless applicable law requires otherwise.
Bidders must immediately notify the applicable auction platform and GoldenTree if they believe their account has been compromised.
23. MINORS
Bidders must be at least 18 years old and legally capable of entering into a binding contract unless a higher minimum age is required by applicable law or the auction platform.
24. PERSONAL PROPERTY ONLY
Unless expressly stated otherwise, these Terms apply to auctions involving personal property and estate contents. Real estate, titled vehicles, regulated goods, alcoholic beverages, firearms, or other specially regulated property may be subject to separate terms and legal requirements.
25. COMPLIANCE WITH LAW
Bidders and Buyers are responsible for complying with all laws applicable to their purchase, possession, transportation, shipment, or use of purchased property.
GoldenTree reserves the right to refuse or cancel a transaction when completing the transaction would violate applicable law.
26. LIMITATION OF LIABILITY
To the fullest extent permitted by applicable law, GoldenTree, its owners, employees, contractors, representatives, and Sellers will not be liable for indirect, incidental, special, exemplary, or consequential damages arising from participation in an auction, use of the auction platform, inability to place a bid, condition of merchandise, pickup, removal, or transportation of purchased property.
To the fullest extent permitted by applicable law, GoldenTree's liability relating to a particular purchased lot will not exceed the amount actually paid to GoldenTree for that lot.
Nothing in these Terms excludes liability that cannot legally be excluded or limited.
27. INDEMNIFICATION
To the fullest extent permitted by law, a Bidder or Buyer agrees to indemnify and hold harmless GoldenTree, its owners, employees, contractors, representatives, and the Seller from claims, damages, losses, liabilities, or reasonable expenses arising from the Bidder's or Buyer's violation of these Terms, unlawful conduct, or negligent acts during pickup, removal, transportation, or handling of purchased property.
28. PLATFORM TERMS
Auctions conducted through a third-party online auction platform may also be subject to that platform's separate terms, policies, bidding rules, payment requirements, and privacy practices.
If an auction-specific term or platform requirement differs from these general Terms, GoldenTree reserves the right to apply the auction-specific provision to the extent permitted by law.
29. MODIFICATION OF TERMS
GoldenTree may update these Terms periodically.
The Terms and auction-specific conditions presented or made available to a Bidder at the time the Bidder participates in an auction will govern that participation.
Auction-specific announcements, notices, or written conditions may supplement these Terms.
30. SEVERABILITY
If any provision of these Terms is determined to be invalid or unenforceable, that provision will be enforced to the maximum extent permitted by law or severed as appropriate, and the remaining provisions will remain in effect.
31. GOVERNING LAW & VENUE
These Terms and each auction will be governed by the laws applicable to the jurisdiction in which the auction is legally conducted, without giving effect to conflict-of-law principles, except where applicable law requires otherwise.
Any specific governing-law, venue, arbitration, or dispute-resolution provision posted for an individual auction will supplement or supersede this section as applicable.
32. ENTIRE AGREEMENT
These Terms, together with any auction-specific terms, lot descriptions, notices, invoices, and applicable auction-platform terms, constitute the agreement governing the Bidder's participation in the auction.
By registering, bidding, or purchasing, the Bidder acknowledges and agrees to these Terms & Conditions.
