TERMS AND CONDITIONS:
AUCTIONEER: Annie Hodges is a Licensed Auctioneer in the state of South Carolina. Her license number is SCL #4679.
BUYER: You are a Buyer if you register and bid on any item in this online auction.
ELIGIBILITY: All Buyers must be 18 years or older to register and bid in this auction and be accepted by the Auctioneer. Accepted Buyers are entering into a contractual agreement to pay for any items they won as the highest bidder. Auctioneer has the right to deny and reject any Buyer for any reason.
CONTRACTUAL OBLIGATION: Buyer is entering into a Contractual Agreement by participating in this auction and agrees to all conditions set forth by the Auctioneer.
LOTS: All Lots are provided by Consigners and or the Auctioneer. All Lots remain the property of the Consigner and Auctioneer until the total amount of your invoice has been paid (hammer price/invoice total for winning lots + 25% commission + shipping).
ONLINE BUYERS: This auction may be on multiple online auction sites and the bids left by buyers may not be known to the auctioneer until the exact moment of the sale. The auctioneer does not know the maximum bid amounts left by bidders. Multiple bidders are bidding on multiple online auction hosting sites for the same item in the same dollar amount and often during the last seconds of a lot closing. The Auctioneer has the absolute right accept the first bid she sees. Once the hammer has fallen to the highest bidder, the property is considered sold by the Auctioneer.
SHIPPING: We ship using the most convenient service available at the time of shipping. This is typically USPS Priority Mail, Fed Ex Ground or UPS Ground. Items that are extremely delicate or over-sized will not be shipped by us. It is the Buyers responsibility to coordinate a freight company to ship these items. We charge $5.00 per small box, $10 per medium box and $20.00 per large box for a packing fee. We will combine shipping when possible. This includes all professional materials to carefully pack your items for safe transit. We charge the shipping amount and insurance, which is required at full value of the invoice at the Buyers expense. Once your item has shipped, a tracking number(s) will be provided to you via email. It is the Buyers responsibility to track their package and coordinate any transit issues with the carrier.
We will email you an invoice for shipping once your items are packed. You are required to pay within 24 hours. Items can be picked up from our location the day after the auction ends. If you plan to pick your items up, please call us so we can have everything ready for you when you arrive.
International Shipping: USPS does not guarantee delivery or tracking using Priority Mail once the package has left the United States. If you wish to use USPS Express Mail, they will guarantee your package, as well as UPS and FedEx. Please let us know if you wish to use Express shipping vs. Priority Mail. Auctioneer will complete a basic Customs Form, but all customs fees and any special reporting documents are the responsibility of the buyer. An export license may be required for International Buyers by government agencies and the Buyer must familiarize themselves with these requirements for themselves. Auctioneer will not be responsible in any way for export licensing.
TAXES AND FEES: South Carolina Residents will pay a 7% state tax. Auctioneer is located in South Carolina and collects only South Carolina taxes from South Carolina residents. Your state may require you to pay taxes on your purchase. It is your responsibility to know and report and taxes you may owe to your state. Buyers home state may require the Buyer to report and/or pay any taxes arising from purchases made by Buyer in this sale. Credit cards are processed by the Auctioneer's credit card merchant "Square." A 3% fee will be added to the buyers total for all credit and debit cards.
PAYMENT: YOU MUST PAY USING SQUARE - THE AUCTIONEER’S CREDIT CARD MERCHANT. All payments in US Dollars only. Payment is due upon receipt of your invoice or no later than within 24 hours. Auctioneer will email you an invoice with a link to pay your total amount due using SQUARE MERCHANT PAYMENTS at the end of the auction. We accept credit and debit cards from Mastercard, VISA, American Express, and Discover. We also accept wire transfers and cash. We do not accept checks, PayPal, or any other form of payment.
Once payment is made and accepted by the Auctioneer, title and goods will transfer to buyer. The Auctioneer has the right to charge $20 per day storage fees for not picking up within 7 days from the end of the auction. Storage fees begin on the 8th day. Cash Buyers must pay their invoice under the same terms as those who are having us ship to them – upon receipt of invoice or within 24 hours. Auctioneer will consider any items not picked up within 30 days as abandoned and has the right to resell items in any manner she sees fit.
BUYERS PREMIUM: The auctioneer charges a 25% buyer’s premium which includes the premium charged to Auctioneer by all online auction hosting sites.
CONDITION: Auctioneer offers all lots “AS IS - WHERE IS.” All sales are final, and returns are not accepted. Auctioneer tries to offer detailed photos, description, condition, estimate, and multiple photographs of every item. Under no circumstances does Auctioneer claim to be a certified expert in any field and the Buyer is responsible for doing their due diligence prior to bidding. Due diligence includes attending a viewing of lots offered prior to the sale, researching similar items that have sold, and determining estimate, value, and condition using their own experience. Neither the Auctioneer or the Consigner will be held responsible for condition, age, description, provenance, etc. for any item whether written or oral. Measurements, dimensions, and condition are approximate. Buyers are encouraged to contact Auctioneer with any questions relating to items. Auctioneer will make every effort to respond within 24 hours. The Auctioneer will not be able to answer any questions on sale day.
