Gun and Ammunition Terms and Condtions:
Fisher Realty and Auction makes no warranties or representations concerning the firing condition, operation, fitness for use, safety to store, or the reliability of any firearm, parts, or ammunition.
All bidders who participate in this auction agree to the terms and conditions of sale and agree to be bound by the same. Bidders must be at least 21 years of age to register and bid on firearms. We will not sell firearms to a number of locations, including but not limited to the following. Foreign bidders or residents of the following states:
We will not ship ammunition under any circumstances.
Alaska, California, Connecticut, Colorado, Hawaii, Illinois, Kansas, Maryland, Massachusetts, New Jersey, New York, Virginia, Washington, Washington, D.C, P.O. Boxes, U.S. Territories
Shipping will be conducted by our FFL wrapping and shipping costs will be remitted to him.
Bidders from these states cannot participate in any firearms bidding with us. We reserve the right to refuse registration, sale of firearms to any person at any time for any reason deemed necessary. Registration must be made in the same address appearing on your driver’s license. A valid driver’s license with current address is required for registration. No expired driver’s license. It is your responsibility to know your state and local laws before bidding. We will abide by all state and federal firearms laws. All purchasers of firearms must pass a background check, a fee of $30.00 applies for the first gun and $20.00 for each gun after. Firearms sold to out of state bidders will only be shipped to an FFLs dealer in the purchaser’s state (No C&R Dealers), this includes all black powder firearms, No Exceptions. Handguns purchased by out of state bidders cannot be picked up in person. Handguns purchased by out of state bidders must be shipped to an FFL in the purchaser’s state. Long guns sold to out of state bidders can only be picked up in person if it is legal for a resident of their state to do so. Firearms have not been inspected by a professional/gunsmith and are sold “As Is Where Is.” All sales are final, no refunds will be given.
Firearm buyers from out of state may be required to pay with bank wire transfer. Firearms can only be picked up by the actual purchaser after payment in full and Tennessee Bureau of Investigation background check. The actual purchaser is the name used at the time of registration for the auction. If the registered bidder is not the actual purchaser of the firearm, the purchase will be voided. Any attempted straw purchase will be reported to the Tennessee Bureau of Investigation and local law enforcement. Checks and any form of payment other than cash must be from the account of the registered bidder.
All sales are final and items are sold "as is, where is". This is an estate auction so please note items are used.
No sales tax will be charged for this auction.
PAYMENT: Credit Card used for registration will be charged immediately following the auction unless other arrangements have been made prior to auction end. By registering to bid on any item, bidder agrees to all terms and conditions of the auction. Fisher Realty & Auction reserves the right to refuse to accept bids or approve bidders for any reason.
If payment has not been received at auction end or other payment arrangements made by end of business hours on pick up day, we reserve the right to cancel any unpaid item(s) after that time. At this time, we will ban the bidder from any future sells and resell the item(s) to the back up bidder. Shipping will only be arranged after payment has cleared.
PICK-UP: You must pick your item(s) up at the stated times if you do not you will release your item to be resold or sold to the back-up bidder. This does not mean you are released from paying for items you won at auction. SO if you can not pick your items up, DO NOT bid. Contact us if you need other arrangements.
PREVIEW: All lots are sold "AS IS, WHERE IS." Property shall be displayed for thorough public inspection and sold as is, where is, and without recourse for any refund or reduction of the sale price.
On the fall of the auctioneer's hammer or other acknowledgment of a successful bidder on a lot, title to the property in that lot will pass and the successful bidder there upon assumes full risk and responsibility for the purchased property. The highest bidder shall be the buyer. If any dispute arises, the auctioneer shall have absolute discretion to settle it and put any disputed lot up for sale again. Fisher Reality & Auction has full discretion to refuse any bids.
Online bidding is a convenience offered to customers and while we make every effort to execute your instructions regarding your Online Bids. Fisher Realty & Auction is not liable or responsible for any errors or failure to execute such instructions.
STORAGE: We have no storage. Your items must be picked up at address of sale. We will not haul your items unless it is to the UPS store.
DESCRIPTIONS: All descriptions are subjective and up for interpretation. Please note you are responsible for looking at all photos and reading descriptions. We offer a preview day for in person inspection of the items being offered for auction.
TECHICAL PROBLEMS: We have made reasonable efforts to provide for online bidding for this auction. You recognize and acknowledge, however, that technical problems with hardware, software, or internet connectivity, as well as human errors, may arise and may affect, without limitation, the Fisher Realty and Auction's HiBid website, our online bidding program and process, your or our internet service and access, and your connection to this auction’s bidding program and process. You further acknowledge that these and other technical problems may develop at any time and with or without notice. You acknowledge and agree that neither we nor the Seller is in any way responsible for any such technical problems, and that you have no absolute or other right to be able to bid on this auction in the event of any such technical problems. Notwithstanding the foregoing, you further acknowledge and agree that, in the event of any such technical problems, we reserve the right to postpone or cancel the auction and/or extend the bidding time for this auction and/or relist the property for auction at another time, in our sole discretion, and that our decision with regard to any such actions is and will be final.
All legal disputes or any litigation's that may arise, for any reason, between Fisher Realty & Auction and bidder shall be tried in Courts of Dyersburg, Dyer County, Tennessee. Successful purchasers agree to pay any and all reasonable attorneys' fees and costs incurred by Fisher Realty & Auction, the seller and/or their assigns, agents or employees in the commencement or defense of any action here-under as well as in the collection of any obligation here-under.
This auction is being conducted under appropriate state and local laws and the Uniform Commercial Code. Any additional terms or conditions of sale shall be announced prior to the auction. Bidding on any item indicates acceptance of these terms and conditions.
By attending this sale you agree not to hold Fisher Realty and Auction Co. and it’s employees liable should you suffer any injuries or fall inside the property, outside the property, lawn, driveways or going up or down stairs.
