Terms and Conditions

Thank you for attending our downsizing estate sale. By participating in this sale, all buyers agree to the following terms and conditions:

1. All Sales Are Final

All items are sold AS IS, WHERE IS with no warranties, guarantees, refunds, exchanges, or returns. Buyers are responsible for carefully inspecting all items before purchase and determining that the condition, size, functionality, and suitability meet their needs.

2. Item Descriptions and Condition

While every effort is made to accurately describe and display items, buyers acknowledge that:

Used items may show signs of wear, age, imperfections, or previous use.
Descriptions, measurements, and photographs are provided as a courtesy and are not guarantees.
Buyers are responsible for verifying item condition prior to purchase.

3. Pricing and Negotiations
Prices are established by the seller and/or estate sale organizers.
Negotiations may be considered at the discretion of the seller.
All pricing decisions made at checkout are final.
Discounts or reductions, if offered, will be communicated by sale staff.
4. Payment Terms

Accepted forms of payment may include:

We accept cash, Apple Pay, Venmo and Zelle

Payment must be completed before any item leaves the premises.

5. Holds and Reservations
Items may be placed on hold only at the discretion of sale staff.
A hold does not guarantee purchase unless payment has been received.
Unpaid items may be returned to the sales floor at any time.
6. Removal of Purchased Items

Buyers are responsible for:

Bringing appropriate transportation, packing materials, and assistance for purchased items.
Removing purchased items within the timeframe designated by sale staff.
Ensuring items can safely fit through doorways, stairways, and other access points.

Sale staff and property owners are not responsible for damage caused during removal or transportation.

7. Large Items and Furniture

For furniture, appliances, artwork, and other large items:

Buyers must arrange their own pickup, moving assistance, and transportation.
Items must be removed carefully to avoid damage to the property.
Estate sale staff are not responsible for moving, loading, or securing purchased items unless otherwise agreed upon.
8. Safety and Property Access

For safety reasons:

Buyers must remain in designated sale areas.
Certain areas of the property may be restricted.
Children must be supervised at all times.
Do not climb, move heavy objects, open restricted areas, or enter unsafe areas.
The seller and organizers reserve the right to refuse entry or service to anyone acting unsafely or disrespectfully.
9. No Guarantees on Electronics, Appliances, or Mechanical Items

Electronics, appliances, tools, vehicles, and mechanical items are sold without warranties. Buyers are encouraged to inspect and test items when possible before purchase.

10. Artwork, Collectibles, and Valuables

Buyers acknowledge that:

Items are sold based on available information at the time of sale.
The seller does not guarantee authenticity, age, origin, or value unless specifically documented.
11. Personal Information and Privacy

Any documents, photographs, records, or personal information discovered among items remain the property of the seller unless intentionally offered for sale. Buyers agree to respect personal privacy and not disclose or misuse private information.

12. Right to Refuse Sale

The seller and/or sale organizers reserve the right to:

Refuse service to any individual.
Remove items from sale at any time.
Correct pricing errors.
Cancel transactions if necessary.
13. Liability Disclaimer

By attending the sale, buyers assume responsibility for their own safety and belongings. The seller, property owner, and sale organizers are not responsible for accidents, injuries, theft, damage, or loss occurring during the sale or removal of purchased items.

14. Agreement to Terms

Participation in the downsizing estate sale constitutes acknowledgment and acceptance of these Terms and Conditions.
