ESTATE SALE — TERMS & CONDITIONS
By entering this sale and/or purchasing any item, all buyers acknowledge and agree to the following terms and conditions in full. These terms are non-negotiable and apply to all sales without exception.
1. All Sales Are Final
ALL SALES ARE FINAL. No refunds, returns, credits, or exchanges will be issued under any circumstances, including but not limited to buyer dissatisfaction, change of mind, or items not performing as expected. It is the buyer's sole responsibility to inspect all items prior to purchase.
2. Accepted Payment Methods
Lewis Auction House & Estates accepts the following forms of payment:
• Cash (exact change appreciated)
• Credit and debit cards (Visa, Mastercard, Discover, American Express)
All sales must be paid in full before items are removed from the premises. Items are not reserved until payment has been received and confirmed. Lewis Auction House & Estates reserves the right to decline any transaction at its discretion.
3. Items Sold As-Is — No Warranties
All items are sold as-is, where-is, with no warranties expressed or implied. Lewis Auction House & Estates makes reasonable efforts to describe and represent items accurately; however, we make no guarantees regarding condition, age, authenticity, completeness, or functionality. Descriptions provided are for reference only and do not constitute a warranty of any kind.
Buyers are strongly encouraged to examine all items thoroughly before purchasing. Questions about specific items should be directed to staff on-site prior to the sale.
4. Removal of Purchased Items
All purchased items must be removed from the premises by the end of the sale day on which they were purchased, unless prior written arrangements have been made with Lewis Auction House & Estates management. Items not removed within the agreed timeframe may be forfeited without refund.
Buyers are responsible for providing all labor, equipment, and packing materials needed to remove their purchases. Lewis Auction House & Estates staff are not obligated to assist with loading or moving items. Any damage to the property during removal is the sole responsibility of the buyer.
5. Holds and Previews
Holds and previews are offered at the sole discretion of Lewis Auction House & Estates and will be communicated on a sale-by-sale basis. When holds are not available, items may not be set aside or reserved in any manner before or during the sale. Previews, when offered, are for inspection purposes only and do not constitute a purchase or reservation.
6. Conduct on Premises
All buyers and guests are expected to conduct themselves in a respectful and lawful manner. The following apply to all attendees:
• Children must be supervised by a parent or guardian at all times.
• No strollers, carts, or large bags are permitted inside without prior approval of staff.
• Shoplifting or theft will result in immediate removal and prosecution to the fullest extent of the law.
• Lewis Auction House & Estates staff reserve the right to remove any individual from the premises for any reason, at any time, without notice.
• Items may not be moved, hidden, or repositioned to prevent others from purchasing them.
7. Pricing and Disputes
All prices are set by Lewis Auction House & Estates on behalf of the estate. Any pricing disputes must be resolved on-site with a manager before the item is removed. No pricing adjustments will be made after a sale is complete.
8. Limitation of Liability
Lewis Auction House & Estates, its staff, agents, and representatives shall not be liable for any injury, loss, damage, or accident occurring on or near the sale premises, including but not limited to personal injury, property damage, or theft. Attendance at this sale is at the buyer's own risk.
Lewis Auction House & Estates acts solely as an agent on behalf of the estate owner and is not responsible for the accuracy of any representations made by the estate owner regarding the items offered for sale. The estate, its heirs, and Lewis Auction House & Estates expressly disclaim any liability arising from item descriptions, valuations, or provenance claims.
9. Right to Refuse Service / Cancel Sale
Lewis Auction House & Estates reserves the right to refuse service to any individual for any lawful reason. We further reserve the right to cancel, postpone, or modify this sale at any time without prior notice, including but not limited to circumstances involving inclement weather, unforeseen property conditions, or estate-related legal developments.
10. Governing Law
These Terms and Conditions shall be governed by and construed in accordance with the laws of the State of Tennessee. Any dispute arising from or related to these terms or any purchase made at this sale shall be subject to the exclusive jurisdiction of the courts of Williamson County, Tennessee.
