Sale conducted by Fort Davis Auction Company Martin Stringer Auctioneer, TX Lic #12598.
1. Prospective bidders must present a valid driver's license or acceptable photo I.D. to obtain a bidder card.
2. PAYMENT: Full payment sale day by cash, approved company or personal checks, & approved Visa, MasterCard, American Express or Discover credit cards. All payment methods must be approved by the auction company prior to bidding. A Bank letter of guarantee is required on any checks over $1,000.00. A credit card and thumbprint may be required to secure large checks without bank letter. In addition, auction house reserves the right to hold items until check clears.
3. No purchases will be removed until paid for in full.
4. Sales tax will be charged unless the buyer has a dealer's resale certificate that is directly related to the industry that is being sold. Prospective buyer should present their resale information at the time of registration.
5. All items in the sale are being sold, "as is, where is" without warranties or guarantees and with all faults. I agree that by placing a bid that I have previewed the item enough to place an educated bid. Bidders should satisfy themselves as to the usefulness, condition and value of each item prior to bidding. Any statement made by the auctioneer or seller regarding the items to be sold is for identification purposes only. Any error in description does not relieve the buyer or his agent of their responsibilities to preview. All Items Sold As Is, Where Is. All sales are final.
6. Fort Davis Auction Company reserves the right to accept or refuse any bid for any reason. The winning bidder will be the person designated by the auctioneer as the final high bidder. In the event of a tie bid, auctioneer reserves the right to reopen the bidding prior to moving to the next lot.
7. Auctioneer reserves the right to bid on behalf of the seller (in the event of a reserve) up to, but not beyond the reserve amount.
8. In the event of a dispute between buyer and seller, or any problem with items bid on or purchased, the auctioneer will act as mediatory and the auctioneer's remedy will be deemed final.
9. BUYER'S RESPONSIBILITIES: Buyer assumes full responsibility for all items purchased when auctioneer declares it sold. Fort Davis Auction Company is not responsible for security or the security of the items purchased. Auction Company is not responsible for mixed lots, missing, stolen, damaged or misplaced items.
10. I agree my bid is a legal binding contract and agree to pay for all items in full. A 10% surcharge will be applied to any invoices not paid in full within 21 days of auction. Any items not paid in full and removed within 30 days of auction, will be considered abandoned and resold at winning bidders expense. Expense will include original purchase price, in addition to full commission, surcharge, storage, removal and catalog fees.
11. Removal of items on Sale Day, By Appointment or advertised times ONLY. Any item not removed within 30 days of auction end will be deemed abandoned. Purchaser accepts full responsibility for all costs incurred by Auction Company for removal, storage, and/or disposal of abandoned merchandise.
12. Buyers assume all responsibility for removal, transportation and handling of purchased items. In the event of assisted removal by any Fort Davis Auction Company employee, I agree to hold harmless Fort Davis Auction Company and said employee or employees harmless in regards to damage to item, vehicle, or bodily injury. Any assistance should be considered a courtesy.
13. The buyer hereby assumes and does agree to indemnify and hold harmless the auctioneer and sellers from any current or future claim which shall pertain to the fitness, use, damage, safety, injuries to persons or property that may have occurred during the auction or that may have been caused by or during removal or use of items purchased, or any other claim regarding the use of that asset as purchased. Neither the Auctioneer, Auction Company, nor the Seller assumes responsibility for any accidents or loss due to theft, fire, vandalism, or personal injury.
14. All firearms purchasers must be Texas residents, must be the actual buyer, must not be prohibited by law from purchasing a firearm and must be able to pass the requirements on BATFE Form 4473, and execute an affidavit to such.
15. Fort Davis Auction Company is licensed and regulated by the Texas Department of Licensing & Regulation. 16. All buyers must acknowledge and accept by signature the terms and conditions on this contract provided at registration.

LOT 1 VINTAGE RANGER PHOTOGRAPH (1933) 8" x 10" Captioned on back "A pack train in the Big Bend Country showing a couple of rangers..." Stamped on back REF. DEPT. Jul 11 1933 N.E.A.
LOT 2 E.E. TOWNSEND POLL TAX RECEIPT. A 1921 Brewster County, Texas Poll Tax Receipt signed by E.E. Townsend. Townsend born in 1871 was call the "Father of Big Bend National Park" was a Texas Ranger, U.S. Marshal, Sheriff of Brewster County and Texas Congressman.
LOT 3 L.B CARRUTHERS Letter dated 1882 on J. Sender & Bro (Fort Davis Merchants robbed b Jesse Evans gang in 1880) written by L.B. Carruthers who was the Texas Rangers Sergeant of Company E that arrested John Selman.
LOT 4 J.B. GILLETT LETTER dated May 15th, 1901 written and signed by J.B. Gillett a Texas Ranger with Company D, Frontier Battalion. Capt. Gillett also served with Companies A, E, & C and was city marshal in El Paso in 1882. He wrote Six Years with The Texas Rangers in 1921
LOT 5 W. KEESEY LETTER & TOKEN. Extremely rare W. Keesey saloon token from Fort Davis, Texas circa 1880's with a letter to Menger in San Antonio dated 1879 on Keesey Bros letterhead signed by O.M. Keesey who served as county judge in Presidio County in 1875 and Jeff Davis County in 1880 and again in 1891.
LOT 6 JOE SITTER PHOTOGRAPH. Original black & white press photo of Joe Sitter on horseback and New York Tribune dated July 1, 1915 headline and photo cut line of same. Sitter was a U.S. Customs mounted Inspector who captured the notorious bandit Chico Cano and was later ambushed and murdered by Cano. Sitter was also involved in the raid and burning of Pilares, Mexico.
LOT 7 ALPINE NATIONAL BANK NOTE. Extremely rare series of 1929 small size National Currency $10 bank note issued by The First national Bank of Alpine, Texas. A Jones-Woods note with printed H.L. Kokernot signature.
LOT 8 RANGER COMMISSION JOE ALDRICH & FRANK HAMER. A scarce Texas Ranger Warrant of Authority (Commission) appointing J.W. Aldrich (Roy Aldrich's brother) a private in Headquarters Company Sept 28, 1929. Signed by both Robert Robertson, Adjutant General and Capt. Frank A. Hamer of Bonnie and Clyde fame.
LOT 9 JOHN WESLEY HARDIN MEMOIR. An original card cover printing of the Life of John Wesley Hardin published by Smith & Moore, Seguin, Texas 1896. Most of these were destroyed in a fire during litigation shortly after printing.
LOT 10 TEXAS CRIMINAL BOOK. Texas cardcover list of Fugitives From Justice for 1900. Austin: Von Boeckmann, Moore & Schutze State Contractor, 1900. 203 pgs. Contains descriptions and lists crimes of Fugitives from all over Texas.
