Auction Terms & Conditions-

-Conditions of Sale
All sales are final and all property is sold “As is, Where is.” It is the bidder’s responsibility to determine condition and usefulness of the items purchased. We attempt to describe all items to try to give you a visual of the item you are bidding on, plus we take as many pictures as possible to give full view range of said items. We describe them to the best of our ability and many times rely on information from the original owner that is given to us. If you have questions or are NOT SURE about the condition of or something pertaining to an item in our auction please do not hesitate to pick up the phone and give us a call or text. We will answer your questions to the best of our ability. Call/text 972-469-2909 to speak to Misti. If you are still unsure of the items condition or authenticity- do not bid on that item or you will take on all responsibility for that item.

-Buyers Premium
We charge a 18% buyers premium .***Note: buyers premium for all Lonestar Vintiques auctions is 18% .

-Bidding
A bid by any person shall be conclusive proof that the person has made themselves acquainted with these conditions of sale and has agreed to be bound by them. In the event of non-payment during posted pickup days, we reserve the right to charge the outstanding invoice balance to the credit card you provided upon registration or a previous card registered with. Failure to honor your bid may result in loss of bidding privileges by us and other auctions on HiBid. Keep in mind that you have an "auction score" like you have a "credit score". Any non-payment, items not picked up (forfeited or abandoned), or irrational behavior on site or to employees will not be tolerated. If any of the above happens, we will "ding your score". It will show to all other auctioneers on HiBid the reason your auction score has been affected because we will leave our own notes - didn't pick items up, non-payment, irrational behavior, and so forth. Please keep that in mind.

-Payment
Lonestar Vintiques will take payment (charge the card used to register for the auction) at the close of the auction. We do not accept cash, check or cashier's checks. We only accept payment through HiBid. Please remember that payment is extremely important to us as a small business and to the home owner that is selling their items.
We see it like this: if you decided not to pay your bill, the other person that was bidding against you would have paid their bill, had they won. But instead of them winning, you bid against them enough for you to win, now causing you to be the winner... so please don't be a loser by not paying your bill! Be a winner! The home owners appreciate getting paid and so do we Lol.

-SHIPPING
We at Lonestar Vintiques, love offering shipping to our nation wide bidders and even our Texas bidders! If you require shipping, please make sure to say so upon registering for each individual auction. If you forgot or didn't think you would need shipping when you registered, please email us at LonestarVintiquers@gmail.com requesting shipping for your item(s). If you have an out of state address on your HiBid profile and do not request shipping, we will assume you need shipping if the items are not picked up from the sale address on pick up day.
We will charge your card on file with HiBid for all shipping costs, so please make sure funds are available. We ship through USPS and will try our best to find the best rates for you through USPS.
$5 handling fee for each box if items fit in a USPS Flat Rate Box.
$10 handling fee for each box that is larger than a USPS Flat Rate Box.
We will get all items shipped out by the following Friday after the buyer pickup day for that auction.

-Authenticity
Though all descriptions are believed to be correct, neither auction company nor seller makes any warranties of any kind with respect to the property and in no event shall be held responsible for having made or implied any warranty of description, genuineness, authorship, attribution, provenance, period, culture, source origin, fitness for a particular purpose, condition etc.

-Auction
The Auction company owners, employees and home owners reserve the right to bid on any items in auction. Persons attending the home during removal of goods assume all risks of damage of or loss to person and property and specifically release Lonestar Vintiques and all owners & employees from liability therefore. Neither company owners nor their principal shall be liable by reason of any defect in or condition of the premises on which the sale is held including but not limited to personal injury, fire or theft. If foregoing conditions or any other applicable conditions are not complied with, in addition to other remedies available to Company Owners and Seller by law, including without limitation, the right to hold the purchaser liable for the bid price, company owners at their option may 1) resell the property publicly or privately, with the purchaser being liable for the payment of any deficiency plus all costs incurred or 2) cancel the sale, retaining all liquidated damages on all payment made by purchaser. Company owners commission and all other incidental damages will be charged. Company owners are acting as an agent and agent only and is not responsible for the acts of his or her principals.

-Pickup Times
Pick up times are firm unless extenuating circumstances warrant i.e., acts of nature, etc. All items must be picked up during the published times. If you cannot make pickup during the established times, DO NOT BID. Do not risk placing a bid hoping that we can store your items! We do not have the room or the resources to store your items. Again, if you cannot make pickup during the established times, DO NOT BID. If you do choose to bid and fail to pick up your items during the published times, we will charge the credit card on your file and your items will be considered abandoned and therefore are forfeited. Failure to abide by the pickup times may result in loss of bidding privileges. Refer back to the section titled "Bidding" for further understanding.

-Governing Law
The laws of the state of Texas govern this agreement. Any and all lawsuits must be filed in Dallas County courts and the Northern District of Texas.

-Privacy Policy
Included in these terms and conditions is the privacy policy as outlined on the Lonestar Vintiques website.

-Indemnification
Buyer shall indemnify Lonestar Vintiques against any claims, damages, or liability (including reasonable attorney’s fees) as a result of an injury or other harm suffered by any person and stemming from the sale, whether arising before, during, or after the sale. Buyer agrees to indemnify Lonestar Vintiques for any damages or losses. Buyer will not hold Lonestar Vintiques, it’s owners, affiliates or its employees, liable for accidents, injury, theft, or incidents related to this purchase.

-Intellectual Property
By submitting any images to Lonestar Vintiques for the purpose of sale, marketing, or any use on our website, you grant Lonestar Vintiques world wide non-exclusive license to use the image on any and all marketing collateral digital, printer or otherwise.

-Trademarks
All trademarks, service marks, and copyrights owned by Lonestar Vintiques shall not be used without written permission. This includes the name Lonestar Vintiques Estate Sales, Lonestar Vintiquers, any and all website URL addresses and abbreviations of such.

-AuctionFlex
AuctionFlex sets up each user on this website and collects all user information. Lonestar Vintiques does not have access to user names and passwords. AuctionFlex does provide Lonestar Vintiques with user name, contact information and credit card information provided during the registration processes. User information will not be sold to any third party advertisers by Lonestar Vintiques.
