All items sold as is where is with all faults and with no warranties express or implied. Buyer is responsible for inspection of items including physical inspection, reading of descriptions, and viewing of all photos, prior to bidding. Please text us at Silver Lake 903-875-9458 prior to auction day if you have a question about an item or would like to place an offline absentee bid on an item. Auction staff do their best to take plenty of photos and give an accurate description including damage but may not always be accurate or complete.
BIDDING - By placing a bid, bidder signifies that they have examined the items to their satisfaction, or that they have chosen not to personally examine them. Bidders should consider that there will be a 15 per cent buyer's premium added to the total of items purchased for this auction with a 3 per cent discount for cash payment. This is to help cover the cost of auction workers and incidental expenses. Bidders should also consider that there will be Texas Sales Tax added to their purchase unless the buyer has a valid resale tax certificate on file with us or the item being sold is not subject to sales tax, Bidders should further consider that shipping costs, if applicable, have become very expensive, especially for oversize and heavy items.
Winning bidders will be emailed an invoice the night of or day after the auction. If you are unable to attend an auction or are not comfortable with online bidding, you may leave an absentee bid by calling or texting us up to 24 hours before the auction begins to close. Attempts to place absentee bids the day of the auction should be by text and may or may not be accepted depending on how busy we are, therefore best to bid early. If the sale site says you "may have won" but you still have not received an invoice after 24 hours, please check your spam, and if its not there, please call us. 903-875-9458.
PAYMENT - We do not automatically charge winning bidder credit cards. To charge a "card on file" bidders must contact us with the CVV code on the card on file. Winning bidders have until noon the Saturday following the auction to complete their transaction. All unpaid bids will be cancelled at that point and items may be resold to other buyers. Methods of payment include cash, check, credit card, and you are now able to pay with Cashapp if you wish. Invoices over $1000 and invoices containing gold and silver purchases must be paid for in cash or by wire transfer unless you are an established customer. There is a $35 charge for returned checks. By placing a bid through this website or by absentee or at live auction, you are entering into a legally binding contract and agree to follow through with the payment for and pickup of the item as specified above. Bidder expressly agrees not to stop payment, dispute or contest auction transactions and agrees to payment rules and item abandonment rules above stated.
PICKUP will be by appointment at 121 N Garitty, Frost, Texas on Tuesday, Thursday, Friday, 9 to 6 and 9 til Noon on Saturday. You must call or text in advance to set a pick up time. 903-875-9458. Paid items may be stored for late pickup in most cases for up to 30 days after the auction. For larger items or large quantities, buyers may rent a storage unit for $75 per month located behind the auction house. Unless storage is arranged, any items left at the auction over 30 days, whether paid for or not, are thereby abandoned and may be resold or disposed of by the auction house.
Limited loading help is typically available during pickup week, but buyers are responsible for packing and loading items and encouraged to bring their own packing materials and loading help. Once you are declared the winner of an item you are responsible for loss or damage.
SHIPPING - Shipping is done in house and we will typically charge a packing fee between $2 for an envelope to $25 or more for an XXL box in addition to postage by USPS or UPS. Insurance may be added to purchases over $100 at buyer's expense. We do our best to package items safely and securely and to keep shipping costs as low as possible, but Silver Lake Auction LLC makes no warranty with respect to shipping items.
Silver Lake Auction LLC and its consignors reserve the right to remove any and all items from a sale at any time, up until the time the item is sold, and auction may be canceled or postponed in the event of inclement weather, power outages, or other unforeseen events.
All sales are final with no returns.
Anyone who is age 18 or over may bid, however Silver Lake Auction LLC reserves the right to reject a bid from any bidder. Bidders who have negative ratings or who have failed to pay or pickup items previously may have their bids cancelled or denied. Workers at the auction as well as the auctioneer himself may bid. The highest bidder acknowledged by the auctioneer shall be the purchaser. For live auctions, in the event of a dispute between bidders, or if the auctioneer doubts the validity of a bid, the auctioneer shall have sole discretion to name the successful bidder, reopen the bidding between two tie bidders, or resell the item.
Bidders are responsible for their own merchandise once they are recognized as the purchaser.
The auctioneer may at his discretion combine or divide lots.
