Terms & Conditions
ALL PROPERTY IS SOLD AS IS, WHERE IS, WITH ALL FAULTS. ALL SALES ARE FINAL.
A 20% buyer?s premium will be added to the hammer price of each lot. Applicable sales tax and other charges will be added as required.
By registering for or participating in this auction, each bidder acknowledges and agrees to these Terms & Conditions and all other posted auction policies.
CONDITION & INSPECTION
All property is offered in its existing condition. No warranty or guarantee, express or implied, is made concerning the condition, quality, merchantability, fitness for a particular purpose, authenticity, age, origin, attribution, authorship, maker, materials, measurements, provenance, completeness, functionality, or value of any property except where expressly required by applicable law.
Condition statements are provided as a courtesy and are not exhaustive. The absence of a condition statement does not imply that an item is free from damage, restoration, repairs, alterations, losses, defects, wear, or other condition issues.
Photographs form an important part of the lot information. Bidders are responsible for reviewing all available photographs, descriptions, measurements, and condition information before bidding and for requesting additional information when necessary.
By bidding, the bidder represents that they have satisfied themselves as to the condition and suitability of the property and are not relying solely upon the auction house?s description or estimate.
CATALOG DESCRIPTIONS & ATTRIBUTIONS
Catalog descriptions, titles, photographs, estimates, measurements, dates, materials, artist or maker identifications, origins, provenance statements, and other information are prepared in good faith and represent opinions or information available to the auction house at the time of cataloging.
Such information should not be construed as a warranty, guarantee, or representation of fact unless expressly stated otherwise.
Terms such as ?attributed to,? ?style of,? ?manner of,? ?after,? ?possibly,? ?appears,? ?believed to be,? ?likely,? and similar qualifying language indicate an opinion or uncertain attribution and are not guarantees.
Measurements are approximate. Colors and appearance may vary due to photography, lighting, displays, and other factors.
The auction house reserves the right to correct typographical errors, descriptions, photographs, lot numbers, estimates, measurements, or other catalog information and to amend, withdraw, combine, or divide lots before or during the auction.
BIDDING & FINAL SALE
Bidders are responsible for all bids placed through their accounts. The highest accepted bid constitutes a binding purchase agreement, subject to the auction house?s right to resolve bidding disputes or platform errors.
Estimates are provided only as opinions of possible auction value and are not guarantees of the selling price, retail value, fair market value, authenticity, or future resale value.
No return, refund, exchange, cancellation, or price adjustment will be granted merely because an item does not meet a bidder?s expectations, because the bidder failed to inspect available information, because shipping costs are greater than anticipated, or because subsequent research results in a different opinion regarding attribution, age, origin, value, or other characteristics.
Nothing in these terms is intended to waive rights or remedies that cannot legally be waived under applicable law.
PAYMENT, RELEASE & UNCLAIMED PROPERTY
Property remains subject to the auction house?s control until all amounts due have been paid and cleared.
The auction house may refuse to release property to anyone other than the registered purchaser or the purchaser?s authorized shipping agent and may require reasonable identification or authorization before release.
Buyers must make timely arrangements for shipment or other authorized removal. Property remaining after the auction may be subject to reasonable storage, handling, transportation, or other charges after any stated removal period.
Property left unclaimed for an extended period may, to the extent permitted by applicable law and after any notice required by law, be moved, stored, resold, or otherwise handled at the buyer?s expense. The buyer remains responsible for amounts lawfully due.
SHIPPING & THIRD PARTIES
Shipping is the buyer?s responsibility. Any assistance provided by the auction house in identifying, communicating with, or coordinating a shipper is provided as a convenience and does not make the auction house responsible for the acts or omissions of an independent carrier, packer, freight company, delivery service, or other third party.
The auction house does not guarantee shipping cost estimates, delivery dates, or carrier performance.
PLATFORM & TECHNICAL ISSUES
The auction house is not responsible, to the extent permitted by applicable law, for bids missed or affected by internet outages, software failures, platform interruptions, device failures, delayed transmissions, or other technical problems outside the auction house?s reasonable control.
The auction house reserves the right to resolve bidding disputes and address material clerical or technical errors in a manner it considers reasonable and consistent with applicable law and auction-platform requirements.
