IMPORTANT TERMS & CONDITIONS
By registering for this auction or placing a bid, each bidder acknowledges that they have reviewed and agreed to the applicable Conditions of Sale of Latin American Fine Art. Bidders are responsible for reviewing all available lot information and requesting any additional photographs, condition information, documentation, or other information they consider necessary before bidding.
BIDDING & FINAL SALES
All bids are voluntary and binding. Successful bidders are obligated to complete their purchases. Bids and completed sales cannot be cancelled or withdrawn due to a change of mind, bidding error, failure to review the lot information, or other circumstances within the buyer?s control. Certain lots may be subject to a confidential reserve not exceeding the published low estimate. Except as otherwise provided by the Conditions of Sale or required by applicable law, all sales are final.
PAYMENT
Payments are processed directly by Latin American Fine Art and not through LivePayments. Successful bidders will receive an official invoice directly from Latin American Fine Art with the final amount due and payment instructions. Any invoice or transaction summary automatically generated by LiveAuctioneers is for reference only.
Accepted payment methods include bank transfer, Zelle, and other methods expressly authorized by Latin American Fine Art. Credit cards are not accepted. Buyers are responsible for applicable bank, wire, intermediary, currency conversion, or transaction fees.
Full payment must be received within seven (7) calendar days following the conclusion of the auction unless otherwise agreed in writing. Failure to make payment may result in cancellation of the sale, resale of the lot, and/or a non-payment report to LiveAuctioneers.
CONDITION & LOT INFORMATION
All lots are sold ?as is? and ?where is.? Bidders are responsible for reviewing descriptions, photographs, dimensions, condition information, provenance, and available documentation before bidding.
Condition reports and additional photographs are available upon request. Condition reports are general assessments provided as a courtesy and are not comprehensive conservation examinations or guarantees that every condition issue, restoration, alteration, imperfection, or evidence of age has been identified. The absence of a reference to a particular condition issue does not imply that none exists.
Latin American Fine Art conducts its cataloging and research in good faith based on the information, documentation, provenance, scholarship, and professional resources reasonably available at the time of sale. Scholarly opinions, attributions, provenance information, archival records, and related research may evolve as new information becomes available.
CLAIMS
Any material claim concerning the authorship, attribution, description, or other material cataloging information of a purchased artwork must be submitted in writing within fifteen (15) calendar days following the buyer?s receipt of the artwork.
A timely claim does not establish that the cataloging or description was incorrect and does not automatically entitle the buyer to cancellation, return, refund, or any other remedy.
To proceed with a formal review, the buyer must provide supporting documentation within thirty (30) calendar days following receipt of the artwork, including at least two (2) independent written professional opinions issued by recognized and appropriately qualified specialists with established expertise in the artist or relevant body of work. The opinions must identify the artwork and specialist, state the specialist?s relevant qualifications and conclusion, explain the reasons and supporting evidence, and be signed and dated.
Submission of a claim or professional opinions serves to initiate a review and does not, by itself, establish the validity of the claim or guarantee cancellation, return, or refund. Latin American Fine Art will evaluate the matter based on the totality of the available evidence and may request additional documentation, physical inspection, independent consultation, provenance or archival research, or scientific or technical analysis where appropriate.
Claims not notified within the 15-day period, or for which the required supporting documentation is not provided within the 30-day period following receipt, will not be eligible for review under this procedure, except where otherwise required by applicable law.
SHIPPING
Shipping, packing, insurance, customs, and related logistical expenses are the buyer?s responsibility and are not included in the purchase price unless expressly stated otherwise.
Shipping is generally invoiced separately and coordinated within five (5) to ten (10) business days after full cleared payment and all necessary shipping information have been received. This timeframe is an estimate and may vary according to destination, packing requirements, carrier availability, customs, or other logistical circumstances.
Latin American Fine Art may assist in coordinating shipment through appropriate carriers. Once property has been released to the carrier, transportation risk passes to the buyer, subject to applicable insurance and law. Latin American Fine Art is not responsible for delays, loss, damage, customs holds, or transportation events outside its reasonable control.
STORAGE
Buyers must provide the required shipping information, pay applicable shipping charges, and arrange shipment or collection in a timely manner.
If property remains with Latin American Fine Art for reasons attributable to the buyer, a fifteen (15) calendar-day grace period applies following notification that the property is available for shipment or collection. After this period, storage may be charged at USD $20 per calendar day, per lot until the property is shipped or collected. All outstanding charges must be paid before release.
TAXES, CUSTOMS & INTERNATIONAL BUYERS
Buyers are responsible for all applicable taxes, import duties, VAT, customs charges, brokerage or clearance fees, permits, and other governmental or administrative requirements associated with their purchase or destination.
Customs delays, additional costs, regulatory requirements, or import restrictions applicable to the buyer?s destination do not, by themselves, constitute grounds for cancellation of a sale.
OWNERSHIP & RELEASE
Legal title does not transfer until Latin American Fine Art has received full and cleared payment of all amounts due. Property will not be released, shipped, or made available for collection until payment has been verified and all amounts required for release have been paid.
LIABILITY
To the fullest extent permitted by applicable law, any liability of Latin American Fine Art arising from the sale of a lot shall be limited to the purchase price actually paid to Latin American Fine Art for that specific lot. Except where otherwise required by law, Latin American Fine Art shall not be responsible for indirect losses, including anticipated profit, loss of opportunity, financing costs, currency fluctuations, or changes in market value.
GOVERNING LAW
Transactions arising from this auction are governed by the applicable laws of Mexico. To the extent permitted by applicable law, disputes shall be submitted to the competent courts located in Mexico City, Mexico. Use of LiveAuctioneers does not, by itself, alter the governing law applicable to the contractual relationship between Latin American Fine Art and the buyer.
