Pickup Dates: Saturday, April 25, 2026, from 10:00 AM – 5:00 PM AND Monday, April 27, 2026, from 10:00 AM – 4:00 PM
1. Registration and Bidding
All bidders must register with a valid credit/debit card. A $100 hold will be placed on the card until the sale concludes and items are picked up.
By registering to bid, you agree to all terms stated herein, forming a binding legal contract.
The auctioneer reserves the right to reject or accept any bid and to set or alter bid increments.
Absentee and proxy bidding are permitted at the discretion of the auctioneer.
Seller(s) or their agents are prohibited from bidding on their own items. If they do, both the buyer’s premium and seller’s commission will be applied.
2. Buyer's Premium and Sales Tax
A 10% Buyer’s Premium ONSITE and a 13% Buyer’s Premium ONLINE will be added to all successful bids.
Virginia Sales Tax of 5.3% will be charged on all non-titled items unless a valid tax exemption certificate is presented prior to checkout.
Titled items are exempt from sales tax but may be subject to DMV fees.
3. Payment Terms
Payment methods accepted: Cash, Good Check, Wire Transfer (additional $10 fee), and Credit/Debit Card (4% fee applies).
All payments are due by 4:00 PM on Monday, April 27, 2026. After this deadline, your card will automatically be charged for the full invoice.
Late Payment Penalty: Invoices not paid in full by the deadline will incur a 10% late fee.
Title(s) for applicable items may be held until checks have cleared (typically 5–10 business days).
Failure to pay will result in collection action, including legal proceedings and referral to the Bedford County Sheriff’s Office. Buyer will be responsible for all associated attorney fees, court costs, and collection fees.
4. Item Removal and Storage Fees
All purchased items must be removed during the scheduled pickup dates.
A $25/day storage fee per buyer will apply to any items not removed by the end of the published pickup period.
If you require special arrangements, contact us prior to sale day to discuss options.
5. Condition and Inspection of Items
All items are sold “AS IS, WHERE IS,” with no warranties expressed or implied by the auctioneer, auction company, or seller.
No refunds, exchanges, or returns will be given.
Bidders are solely responsible for inspecting all items in person and confirming all condition statements, specifications, or details before bidding.
Condition descriptions, hours, and mileage are provided as courtesy only and are not guaranteed to be accurate.
Equipment in this auction may continue to be used up until the sale; hours, mileage, and condition may change. All significant updates will be announced prior to or during the auction.
6. Titles
Unless otherwise noted (e.g., “No Title”), titled vehicles are assumed to convey with a clear title.
It is the buyer’s sole responsibility to perform any title research (e.g., VIN history) before bidding.
7. Technical Issues and Platform Disclaimer
The auction platform provider and T&T Realty and Auction LLC are not responsible for missed bids or technical failures of the bidding software.
In the event of a cyber-attack, server failure, or other disruption, the auctioneer reserves the right (but is not obligated) to extend the auction or take any corrective actions deemed necessary.
To avoid last-minute issues, we strongly recommend using the “Max Bid” feature.
8. Liability Disclaimer
All persons attending the preview, auction, or item pickup do so at their own risk.
T&T Realty and Auction LLC, its agents, employees, affiliates, and co-hosts (including the Tuck family) assume no responsibility for accidents, injuries, or damages to property or persons.
Bidders agree to hold harmless the auction company and all its representatives regardless of the cause of any such damage or injury.
9. Auctioneer's Rights and Announcements
The auctioneer may accept bids on behalf of himself, absentee bidders, and sellers.
All decisions by the auctioneer are final in the event of a bidding dispute.
Announcements made on auction day take precedence over any prior advertising, listings, or printed materials.
10. Marketing and Communication
By registering for this auction, you consent to being added to T&T Realty and Auction LLC’s email and marketing list. You may unsubscribe at any time.
11. Inventory Changes
All inventory is subject to change prior to or during the auction.
Any major updates or alterations to advertised equipment will be disclosed as available.
12. Legal Compliance
This auction shall be governed by the laws of the Commonwealth of Virginia.
Any legal disputes arising from this auction shall be filed and heard in the appropriate court within Bedford County, Virginia.
