Timed Auction Terms & Conditions
These Terms and Conditions constitute a binding legal agreement between the bidder/purchaser and Blue Moon Estate Sales of Central Fairfax, NW DC, Potomac and Bethesda (hereinafter referred to as "BMES").
1. Bidder Registration & Approval
All bidders and buyers shall present satisfying documentation, if applicable, prior to being approved to bid in this auction. BMES reserves the right to deny bidding approval to any individual at its sole discretion.
2. No Reserve vs. Reserve Pricing
This auction contains items with 'no reserve' or 'reserve' pricing, as indicated in each item description.
•No Reserve: There is no minimum price set; the item is guaranteed to sell to the highest bidder regardless of the winning bid price.
• Reserve: There is a confidential minimum price the bidding must reach to sell. If the reserve is not met, the item will not be sold.
3. "As Is" and Disclaimer of Warranties
All property is sold "AS IS" with all faults. Neither BMES nor the listing agent makes any warranties or representations of any kind or nature, express or implied, with respect to the property.
In no event shall BMES be responsible for the correctness of, nor deemed to have made any representation or warranty of, description, genuineness, authenticity, authorship, attribution, provenance, period, culture, source, origin, or condition of the property. No statement made at the sale, in the bill of sale, invoice, catalog, or elsewhere shall be deemed a warranty or an assumption of liability.
4. Timed Auction Bidding & Technical Malfunctions
• Bidding Extensions (Soft Close): To prevent "bid sniping," this timed auction utilizes a soft-close feature. If a bid is placed within the final minutes of a lot's closing time, the bidding clock for that specific lot will automatically extend for an additional designated period. This will continue until all active bidding stops.
• Technical Disclaimers: BMES relies on third-party technology platforms (including LiveAuctioneers) to conduct online bidding. BMES is not responsible for internet disruptions, software glitches, missed bids, or technical failure of any kind. BMES reserves the right, at its sole discretion, to extend, pause, close, or reopen the auction in the event of a system malfunction.
5. Final Authority and Disputed Bids
The highest bidder, as determined by BMES, shall be the purchaser. In the case of a disputed bid or technical timing dispute, BMES shall have sole and absolute discretion to determine the successful purchaser, withdraw the lot, or reoffer it for sale. BMES reserves the right to refuse any bid or refuse to acknowledge any bidder.
6. Invoicing, Buyer's Premium, and Taxes
• Buyer's Premium & Fees: A buyer's premium equal to 20% of the final bid (hammer) price, plus a 3.99% processing fee, will be added to each lot sold and is payable by the buyer as part of the total purchase price.
• Taxes: Applicable state and local sales taxes will be applied to the total purchase price (hammer price + buyer's premium) based on the buyer's location, unless a valid resale/tax-exempt certificate is submitted and approved prior to the closing of the auction.
• Auto-Payment: Invoices are generated the day following the auction. If you have a credit card on file with LiveAuctioneers, the total balance on the invoice will be automatically charged within 24 hours of the invoice being sent.
7. Collection, Removal, and Abandoned Property (local pick up)
All merchandise must be removed from BMES premises within four (4) business days of the auction's conclusion. BMES assumes no liability for any damage or loss to property left on its premises after this period.
If any property has not been removed within four business days, the property will be considered abandoned, and BMES may, at its sole option and without further notice to the buyer:
• (a) Place the merchandise in a subsequent auction, without reserve, to be sold to the highest bidder. BMES will deduct its standard commission and storage/handling fees, and remit any remainder to the purchaser.
• (b) Donate the merchandise to a charitable organization.
• Note: The buyer forfeits all original payments made on items deemed abandoned.
8. Shipping, Delivery, and Cancellations
• LiveAuctioneers Shipping: LiveAuctioneers and their shipping partners offer convenient worldwide shipping. Estimated costs are based on your zip code, item size, weight, and the designated vendor. The buyer is responsible for all indicated shipping costs, packing fees, insurance, and any international duties or taxes.
• No Shipping Cancellations: BMES WILL NOT CANCEL A SALE DUE TO SHIPPING COSTS OR ISSUES. All sales are final. BMES is not responsible for obtaining any permits or licensing for the buyer.
• Returned Shipments: If items are returned to BMES due to an incorrect address provided at checkout or carrier delivery errors, the buyer is obligated to pay for a second shipping charge and any return fees. If the buyer requests a cancellation after an item is returned, BMES may, at its sole discretion, honor it; however, all shipping costs, processing fees, and a restocking fee will be withheld from the refund.
9. Forms of Payment
Acceptable forms of payment are VISA, MasterCard, American Express, or Discover, payable in U.S. dollars. Invoices must be paid in full. BMES reserves the right to hold merchandise until the funds have completely cleared.
10. Default and Remedies for Breach
If the purchaser breaches any obligations under these Conditions of Sale (including the obligation to pay in full by the deadline), BMES may exercise all legal rights and remedies, including:
• (a) Canceling the sale and retaining any payments made by the purchaser as liquidated damages.
• (b) Re-offering the item at a public auction without reserve, holding the original purchaser liable for any financial deficiency between the original and new sale price, plus all costs, storage fees, and legal fees.
• (c) Reporting the default to LiveAuctioneers, which may result in a permanent ban from future bidding.
11. Acceptance of Terms
Bidding on any item indicates your explicit, legally binding acceptance of these terms, as well as any other terms printed, posted, or announced prior to or during the auction. All sales are final, and no refunds or chargebacks will be granted.
