Conditions of Sale
This is an internet auction with online bidding only. No bids will be taken in person or by telephone.
PAYMENT: Credit card only. You must register to bid and furnish your credit card information at that time.
Before bidding on-site, online or at any Mountain City Realty & Auction, LLC (MCR&A) sale, you must read and accept the Terms and Conditions of Bidding. Read these terms carefully. When you sign your Bidder Registration Agreement or click the "accept" button online, you enter into a binding legal agreement with the seller and MCR&A.
PREVIEW: The preview for this sale is one day only. NOTE: Sunday June 18th, 1 PM - 5PM. on site: 6287 Poage Valley Road, SW Roanoke County.
PICK UP: You will need to pick up your winning bids the following Saturday, June 24th, 9 AM - 3PM. This is important as the items must picked up this day and cleared out. If you need shipping call The Packaging Store: 540-772-0999. M-F, 9-5.
Any information supplied by any employee or agent of MCR&A, in any form whatsoever, is intended solely as general guidance on the use of Online Bidding Services and the buying and selling of lots at MCR&A sales. REMEMBER: We represent the seller.
MCRA offers no guarantees or warranties-expressed or implied of any nature whatsoever as it relates to the lots offered at any of our sales. Should there be any remaining manufacturers warranty, it is up to you as the buyer to obtain satisfaction from the manufacturer. Each and every lot at MCRA is sold "AS IS, WHERE IS". Where there is an opportunity to preview a sale, we strongly encourage you to attend the preview. Regardless, it is up to the buyer to determine the value and condition of each item, even if there is not a preview offered or you failed to attend. Feel free to contact us if you need additional information on a particular item. Ultimately, it is up to the buyer to determine the condition before you bid. Once you bid, you are committed.
IMPORTANT DISCLOSURE:
We are auctioneers, not authenticators. We do our best to describe as best we can, based on our research, education, overall market experience and information furished to us by the seller. It is ultimately up to you, the buyer, to determine what you are buying, how it may be used, how much you should pay for it and how you plan to remove it.
INDEMNIFICATION:
You agree to indemnify, defend and hold harmless MCRA and its clients, consignors, employees, agents, affiliates, successors, officers, directors and assigns from and against any and all claims, demands, losses, damages, liabilities, costs and expenses, including attorney fees, arising out of or relating to any claim or action based upon your use of internet bidding or live auctions or other sales or your otherwise breach of this agreement. We cannot be held responible for weather related issues; work stoppages due to illness, labor disputes; disruption in utility services- such as the internet, software or other computer problems; from the electric company or any other cirmstances out of our control.

As previously mentioned, all property sold "AS IS-WHERE IS" and neither MCRA nor the Consignor(s) makes any representation of warranty, expressed or implied, as to the merchantability, fitness, or condition of the property or as to the correctness of description, genuineness, attribution, provenance or period of the property or any use or repurpose of a particular item. PLEASE double check the discriptions to make sure what you are buying. No reference to imperfections is made in the catalog descriptions or verbally by the Auctioneers. Since all sales are final, MCRA will make no refunds, and will not allow charge-backs from your bank cards. Please carefully review the descriptions, then verify the information to your satisfaction before you bid.
CONTRACT:
Before bidding on-site, online or by proxy with MCRA, you must read and accept the Terms and Conditions of Bidding. Read these terms carefully. When you sign your Bidder Registration Agreement or click the "accept" button online, you enter into a binding legal agreement with MCRA of Roanoke, Virginia USA. Any information supplied by any employee or agent of MCRA in any form whatsoever, is intended solely as general guidance on the use of online bidding services and the buying and selling of lots at MCRA. We will not reverse bids. A minimum reserve price may be disclosed or kept confidential as our client desires. We as the Agent for Consignor/seller may place bids during the auction if and when the highest outstanding bid at any time during the sale is below the reserve which may have been established on the lot being offered. Associates of MCRA may bid and buy.
PAYMENT:
If you win the bid, congratulations-it's yours. If you do not want us to charge the bank card you have registered with, YOU MUST CONTACT US. Otherwise, we will charge your card. If you fail to pick up your winning bids at the appointed time and we do not hear from you, we will consider the item abandoned and will charge the bank card on file including a $25.00 fee for each lot plus any additional expense required in removing the item. MCRA reserves the right to hold purchases until we get clear bank or authorization/verification on your credit card.
NO SHIPPING:
We do not ship. Period.
If you require shipping, there are numerous carriers for you to contact and make arrangements. A simple internet search will result in numerous qualified shippers. If you do hire a shipper, you must make sure that shipping agent can be at the pick-up site at the appointed time. If arrangements cannot be made, please do not bid. If you need insurance, that also will between you and your shipping agent. MCRA recommends that you contact your personal/business insurance carrier and notify them of your purchase(s). MCRA will bear no responsibility for any mishaps or loss due to shipping, fire, theft or any reason whatsoever natural or man-made.
BUYER'S PREMIUM:
A Buyer's Premium of 15% will be added to the high bid to determine the final sales price.
Example: $100.00 x .15 = $115.000.
SALES TAX:
We sell locally. We work from Roanoke County, Virginia USA. We collect 5.3% percent sales tax from all buyers. If you are a merchant, farmer or otherwise sales tax exempt, it is your responsibility to furnish us with the proper Virginia state forms. Otherwise, we will collect the sales tax.
FIREARMS: ( If applicable) Virginia law now requires background on checks on firearms. We are not a Federal Firearms Licensed (FFL) Dealer. Therefore, we must hand-off your firearm purchase to a FFL dealer for your pickup. We still must collect for you purchases before the weapons are handed off to a FFL dealer. We will give you the necessary information about arranging for you to pick up your gun purchases. The FFL dealer will charge you to do the background check. As a courtesy, the FFL will not charge for an antique or other weapons not requiring a background check. You must be 18 years of age for a long gun and 21 for a handgun. We follow all other state and federal laws. Remember… WE DO NOT SHIP. If you require shipping, that will be between you and the local FFL dealer.

MCRA reserves the right to bid on behalf of the sellers. Additionally, MCRA associates are allowed to bid on their own behalf for items they want to own.

AUCTIONEER’S NOTE: Originally, the Poage Farm was a King’s grant! The Poages were, and continue to be quite entrepreneurial. Over time this family, in addition to cattle, hog, chicken, dairy and vegetable farming, have been store keepers; millers at their own waterwheel gristmill; carpenters that included making furniture, cabinets and coffins as well as postmasters and taking on boarders. The Poages Mill area is one of the oldest settlements in the south west portion of Roanoke County. Many of these items were made right on the farm. Come, bring a friend and preview with us on Sunday.
