TERMS and CONDITIONS OF SALE:

This is an internet auction with online bidding only. No bids will be taken in person or by telephone.

The system has a MAX-BID feature. This means that you have the option to set the "maximum" amount you want to spend on a particular lot and the system will advance the bid for you. The system will bid only to the amount you set and ONLY if someone else is advancing the bids againist you. If you are out bid, you will be notified giving you a second chance to bid again if you so choose.

PAYMENT: Bank card only. You must register to bid and furnish your bank card information at that time.

REGISTRATION: Before bidding on-site, online or at any Mountain City Realty & Auction, LLC (MCR&A) sale, you must read and accept the Terms and Conditions of your participation. Read these terms carefully. When you sign your Bidder or buyer Registration Agreement, or click the "accept" button online, you enter into a binding legal agreement with the seller and MCR&A.

SALE BEGINS: Thursday, April 16, 2026 at 7PM

PREVIEW: On site, 1344 South Main Street, Rocky Mount VA
One day only: Saturday, April 25th., 9AM - 2PM. You must show ID to enter the preview.

SALE ENDS: The auction begins closing at 7PM on Thursday, April 30th. TAKE NOTICE: This is a soft close auction, which means as long as someone is bidding, the bid goes on. Much like a live sale, as long as someone is interested in a particular item, they may continue bidding until the last man (or woman) is standing. For this reason, we highly recommend using the MAX-BID feature.

PICK UP PURCHASED ITEMS: Your auction winnings will need to be picked up the following Saturday, May 2nd., from 9AM - 3PM. This is important as we must clean out the house so that the real estate may be offered for sale. Items must be picked up this day. Bring your own help to load heavy purchases. REMEMBER... we do not ship nor will we move your purchases to another location for a later pickup. If you need shipping call The Packaging Store: 540-772-0999. M-F, 9-5. ASSISTANCE ONLY: Any information supplied by any employee or agent of MCR&A, in any form whatsoever, is intended solely as general guidance. We will try our best to help you, but in the end it is up to you to make buying decisions. Same goes for on line services and the buying and selling of lots at MCR&A sales. It is up to the bidder to determine what is best for himself and his situation and to bid and buy accordingly.

NOTICE: WHERE-IS means you are responsible for moving the merchandise. It is up to you, the buyer to bring your own help, packing, rope, tie-downs, two-wheel dolly or other moving equipment and tools such as screwdrivers and wrenches. We highly encourage you to come to the preview to determine what equipment you will need to move certain items and how much help you need to bring with you on pickup day. If you can't make it to the preview, contact us and we'll give you our best guess at how much time and effort is need to move your newly purchased goods.

REMEMBER: We represent the seller. MCRA offers no guarantees or warranties-expressed or implied of any nature whatsoever as it relates to the lots offered at any of our sales. Should there be any remaining manufacturer's warranty, it is up to you as the buyer to obtain satisfaction from the manufacturer. Each lot and every lot at MCRA is sold "AS IS, WHERE IS". When there is an opportunity to preview a sale, we strongly encourage you to attend the preview. Regardless, it is up to the buyer to determine the value and condition of each item, even if there is not a preview offered or you failed to attend. Feel free to contact us if you need additional information on a particular item. Ultimately, it is up to the buyer to determine the condition before you bid. Once you bid, you are committed.

IMPORTANT DISCLOSURE:
We are auctioneers, not authenticators. We do our best to describe as best we can, based on our research, education, overall market experience and information furnished to us by the seller or other third-party sources. It is ultimately up to you, the buyer, to determine what you are buying, how it may be used, how much you should pay for it and how you plan to remove it.

INDEMNIFICATION:
You attend this sale, preview and pick up of items purchased at your own risk. Neither the seller nor the Auction company will be responisible for accidents no matter the servierity. You agree to indemnify, defend and hold harmless MCRA and its clients, consignors, employees, agents, affiliates, successors, officers, directors and assigns from and against any and all claims, demands, losses, damages, liabilities, costs and expenses, including attorney fees, arising out of or relating to any claim or action based upon your use of internet bidding or live auctions or other sales or your otherwise breach of this agreement. We cannot be held responsible for weather related issues; work stoppages due to illness; labor disputes; disruption in utility services- such as the internet; software or other computer problems; issues regarding the electric company or other utility any other circumstances beyond of our control.
As previously mentioned, all property sold "AS IS-WHERE IS" and neither MCRA nor the Consignor(s) makes any representation of warranty, expressed or implied, as to the merchantability, fitness, or condition of the property or as to the correctness of description, genuineness, attribution, provenance or period of the property or any use or repurpose of a particular item. PLEASE double check the descriptions to make sure what you are buying. No reference to imperfections is made in the catalog descriptions or verbally by the Auctioneers. Since all sales are final, MCRA will make no refunds, and will not allow charge-backs from your bank cards. Please carefully review the descriptions, then verify the information to your satisfaction before you bid.

CONTRACT:
Before bidding on-site, online or by proxy with MCRA, you must read and accept the Terms and Conditions of Bidding. Read these terms carefully. When you sign your Bidder Registration Agreement or click the "accept" button online, you enter into a binding legal agreement with MCRA of Roanoke, Virginia USA. Any information supplied by any employee or agent of MCRA in any form whatsoever, is intended solely as general guidance on the use of online bidding services and the buying and selling of lots at MCRA. We will not reverse bids. A minimum reserve price may be disclosed or kept confidential as our client desires. This is not an absolute auction and we, as the Agent for Consignor/seller, reserve the right to place bids during the auction on behalf of the seller. There may be a disclosed or undisclosed reserve on any lot. Associates of MCRA may bid and buy for their own use.

PAYMENT:
If you win the bid, congratulations-it's yours. ***** PLEASE, only register with the bank card you want charged. We will, immediately following the sale, charge your card. You will then be emailed a paid invoice. We do not accept cash or check payment for our on-line venue*****. If you fail to pick up your winning bids at the appointed time and we do not hear from you, we will consider the item(s) immediately abandoned and will charge the bank card on file including a $25.00 fee for each lot plus any additional expense required in removing the item(s). MCRA reserves the right to hold purchases and/or titles until we get an authorization/verification and payment on your credit or bank card.

NO SHIPPING:
We do not ship. Period.
If you require shipping, there are numerous carriers for you to contact and make arrangements. A simple internet search will result in numerous qualified shippers. If you do hire a shipper, you must make sure that the shipping agent can be at the pick-up site at the appointed time. If arrangements cannot be made, please do not bid. If you need shipping insurance, that will also be between you and your shipping agent. MCRA recommends that you contact your personal/business insurance carrier and notify them of your purchase(s). MCRA will bear no responsibility for any mishaps or loss due to shipping, fire, theft or any reason whatsoever natural or man-made.

BUYER'S PREMIUM:
A Buyer's Premium of 15% will be added to the high bid to determine the final sales price.
Example: $100.00 x .15 = $115.000.

SALES TAX:
We sell locally. We work from Roanoke County, Virginia USA. We collect 5.3% percent sales tax from all buyers. If you are a merchant, farmer or otherwise sales tax exempt, it is YOUR responsibility to furnish us with the proper Virginia state forms. Otherwise, we will collect the sales tax.

ACCIDENTS:
MCRA or the seller are not responsible for accidents that may happen to you or to someone you may harm in attending this sale. You attend the sale, preview, or loading time at your own risk. Please be careful and respectful of your fellow auction attendees. Please be mindful not to block neighborhood driveways or mailboxes. Please do not bring your pets to the sale. Carefully consider bringing small children as the sale site is in no way child-proof and may cause injury.

MCRA reserves the right to bid on behalf of the sellers. Additionally, MCRA associates are allowed to bid on their own behalf for items they wish to own and are bound by these same terms.
