BIDDER AUCTION TERMS AND CONDITIONS AGREEMENT
This is a legal agreement between you and Expert Estate Auctions. You must be 18 years old to register and bid. As a Bidder, (one who is making bids (“Bidder”), you agree to the following instructions, terms and conditions of this Auction as stated in these terms and conditions (“Terms and Conditions”).
The successful Bidder (the “Buyer”) is legally obligated to complete the purchase. Failure to complete a purchase constitutes a breach of contract and will result in being banned from future sales. Buyer may also be subject to monetary damages and any other remedies permitted by law. Therefore, when you place a bid, you are committing and prepared to complete the purchase without cancellation under any circumstances.

REGISTRATION
In order to use the services, you must register on the website as we only conduct online auctions. At the time of registration, we collect personal information from you to verify your identity and to provide the services. We also collect credit card information to process winning bids immediately upon auction close. All personal information will be processed and handled in accordance with our Privacy Policy posted on the website. By submitting any personal information to us, you are agreeing to the terms of our Privacy Policy. We may deny registration to you at any time, and at our sole discretion.

AS-IS, WHERE-IS, & AUCTION PREVIEW
All goods sold in our online auctions are sold AS IS, WHERE IS, and WITHOUT UCC WARRANTY of any kind whatsoever. There are no warranties given by the Seller nor Expert Estate Auctions, expressed or implied as to these goods, including, but not limited to, warranties of merchantability, and the sale is final. The buyer has no right of return for any circumstances of any kind. Please bid accordingly.

Expert Estate Auctions does not conduct in-person previews of our online auction goods. Please take time to look at the pictures and read the descriptions of any and all the items you wish to bid on. Descriptions are based upon what we can see and find about the item at the time the sale is processed and listed but are not guaranteed. Some items may be shown with other items in the background or nearby but not included in the same lot. Please do not assume they are together. Read the description to find out what item(s) is/ are being sold in each lot.

BUYER'S PREMIUM
An 18% Buyer’s Premium plus appropriate sales tax will be added to each invoice. Expert Estate Auctions reserves the right to change the Buyer's Premium and it will be noted within the current auction agreement.

AUCTION CLOSING TIMES, SOFT CLOSE, & MAX BID
All auction times are based on Eastern Standard Time. Each lot will have a predetermined delay before the next lot closes. This is known as a soft close which prohibits "sniping" and provides everyone an opportunity to bid their maximum. You may put in your maximum bid on the outset of the auction close and the system will "proxy" bid on your behalf up to the set maximum amount you entered.

BILLING/ INVOICING
Registration is free with no credit card charges unless you win a bid. A pre authorization (hold) for $1.00 may be done to validate the credit card(s) on file but this is a temporary hold that will drop after a few days (it is not a charge). If you are the winner on an item(s) after an auction closes, we immediately charge the credit card the highest bid price PLUS an 18% Buyer’s Premium and applicable retail sales taxes on top. Invoices for the winning bidders will be available in their bidder profile shortly after closing and they will also be sent via email. Please check your spam and delete files as sometimes emails can be sent to these folders. Invoices not paid in full prior to the start of pickup will mean the unpaid lots are considered abandoned and may be dispersed in any way the seller and/ or Expert Estate Auctions deem appropriate. You will be prohibited from bidding in future auctions until such time as your account is in good standing with Expert Estate Auctions.

If you fail to pay your invoice or fail to timely pick up your items during the published pick-up date/ time/ location, your bidding privileges may be subsequently revoked. Unpaid items or abandoned items (not picked up at the stated date/ time/ location) may revert back to the seller. If your bidding privileges are revoked, they may be restored, at the discretion of Expert Estate Auctions, by paying for the item or repaying for the loss of revenue due to the unpaid invoice.

PURCHASES EXCEEDING $3,000
Any purchase exceeding $3,000 must be paid in full in the form of cash, a cashier's check or bank wire transfer. Call our office at 703-957-8569 for more information.

TAX EXEMPTION
All bidders will be subject to sales tax unless you have provided our office with the appropriate documentation PRIOR to an auction closing. Any exemption form submitted after an auction closes will be eligible for the next auction in queue. No exceptions.

REMOVAL/ PICKUP OF ITEMS
We ship at our discretion and only when arrangements have been made PRIOR to auction close. Do not bid if you cannot arrange for pick up on the published pick-up date/ time/ location or if shipping arrangements have not been made PRIOR to auction close. There will be a $10 - $20 Handling Fee added to each shipment depending on shipping material used and time spent.

Items not picked up will be considered abandoned without refund and your bidding privileges may be revoked. We do not supply tools, packing material or assist with moving your purchases. Please bring help to move large items. Any damages to the property premises at which the auction pickup is conducted caused directly by you or your help will be your responsibility with the repair costs being charged to your credit card. Do not bring pets or young children to the pickup as the movement of household items presents an extremely high-risk environment that could result in injury or death. All buyers must show a copy of the invoice (digital or hard copy) and must be prepared to show photo ID before items will be released.

As mentioned above, failure to conduct a timely pick up on the published date/ time/ location will result in the abandonment of your items and will be disposed of at the discretion of the Seller and/ or Expert Estate Auctions. We are typically under a tight schedule involving the sale of our Seller's home and cannot and will not accommodate Buyers who are unable to plan ahead.

If you know before pick-up day that you will not be able to retrieve your items, contact our office immediately so that we can do our best to give your items away to other buyers or arrange for donation, trash, etc to avoid disposal fees; otherwise, your credit card will be charged for any fees incurred in the disposal of abandoned items.

MISSING ITEMS
Please inspect your items BEFORE leaving the pick-up to ensure all of your items are present. You will be asked to sign off on your invoice which is your acknowledgement that you have received all of your invoice items. Refunds will not be issued later for those who sign off their invoice.

If an item is found missing at pick-up, Expert Estate Auctions shall not be held liable to the Buyer for the missing item(s), except to return all costs, fees and taxes paid for said missing items.

Typically, missing items are the result of family members experiencing remorse over a sentimental piece and removing it without our knowledge. We try to mitigate this as much as possible but if it cannot be resolved in your favor, we ask for understanding.

MUTUAL RESPECT
We want to WOW both our Sellers and Buyers with our service but it is a two-way street of mutual respect. Please be mindful of our contract with the Sellers/ Homeowners and the service we provide them during a typically stressful time in their lives. Honoring your contract when you accept these Terms & Conditions will make it a win-win for everyone on both sides.
