The property listed in this auction will be offered and sold by Girlfriends Estate Sales INC. as owner or as "Agent for Consignor" subject to the terms and conditions set forth on this page.

ITEMS OFFERED FOR SALE:

All Articles or Lots Sold "As Is"--Girlfriends Estate Sales INC. and the Consignor assume no risk, liability, or responsibility for the authenticity or the authorship of any property identified in this auction (that is, the identity of the creator or the period, culture, source of origin, as the case may be, with which the creation of any property is identified herein). All property is sold as-is, where-is and neither Girlfriends Estate Sales INC. nor the Consignor make any warranties or representations of any kind, or nature, with respect to the property, and in no event shall they be responsible for the correctness, nor deemed to have made any representation or warranty, of description, authenticity, attribution, provenance, age or condition of the property. No statement in the description, made at the sale, on the bill of sale or invoice, or elsewhere, shall be deemed such a warranty or representation or an assumption of liability. While Girlfriends Estates will do its best to list any damage, repairs or restorations, the absence of these descriptions or conditions must not be taken to imply that the lot is in perfect condition. Most of the items GES sells are antique, vintage or used. You should expect signs of wear consistent with age. Condition reports may be available. All sales are final. No returns, credits or exchanges. Please review all photos carefully prior to bidding.

Conditions to Cancel a Sale:

Notwithstanding the preceding condition, if within seven (7) days of the sale of any lot, the purchaser gives notice in writing to Girlfriends Estate Sales INC. that the lot so sold is counterfeit and, if within ten (10) days after such notice the purchaser returns the lot in the same condition as when sold, and proves beyond a reasonable doubt that the returned lot is in fact a counterfeit and that this was not indicated by a fair reading of the catalog, the sale will be rescinded and the purchase price refunded.

Right to Withdraw:

Girlfriends Estate Sales INC. reserves the right to withdraw any property at any time prior to the sale.

AUCTION PROCEDURE:

Registration

Girlfriends Estate Sales INC. requires each bidder to register online with Auction Ninja before placing any bids. A valid major credit card will be required. By becoming a REGISTERED member you represent that you are of legal age. As a member, you agree to provide true accurate, current and complete information about yourself as prompted by the Site’s registration forms. In addition, as a member, you agree and acknowledge that you will maintain valid credit card info within your membership profile so long as you maintain an account with GES.

Please go to the Auction Ninja website and read carefully the terms of service. That will enable you to have a good bidding experience and answer many questions you have.

Acceptance of Bids

Girlfriends Estate Sales INC. reserves the right to reject a bid from any bidder. Girlfriends Estate Sales INC. will not knowingly accept a bid from the consignor of any lot. Bids placed on the GES website are a binding contract and you are responsible for paying all amounts due to GES including sale price, buyer's premium and all applicable taxes. Please do not bid if you are unable to pay and take possession of the items in the specified time periods for each auction, sale or event. Any items won and not paid for within 24 hours of auction close are eligible for sale to underbidder(s). All sales are final. No returns, credits or exchanges.

Payment and Title Transfer

Upon the close of the online auction, title to the offered lot passes to the highest bidder who thereupon (a) assumes full risk and responsibility therefore, and (b) will pay the full purchase price therefore, or such part as Girlfriends Estate Sales INC. may require. Girlfriends Estate Sales INC. is also not responsible for technical issues or loss of internet connection. In cases where your internet connection is lost, Girlfriends Estate Sales INC. will not stop the auction while your internet connection is re-established.

Payment credit cards will be processed within 24 hours of the lot closing, all lots must be paid in full (including buyer’s premium, if applicable) prior to shipping or picking up the lot.

Non-payment

will result in negative feedback, unpaid item strikes, and being placed on our no-bid list.

Receipt to be Presented to Claim Articles

No article shall be delivered to a purchaser until a paid receipt has been presented. Girlfriends Estate Sales INC. will not make deliveries or purchasers may on request facilitate the employment of carriers and packers for the purchaser's account, however, Girlfriends Estate Sales INC. will not be responsible for their acts in any respect whatsoever.

BUYER’S PREMIUM: A buyer’s premium of 15-18% (noted on each auction) will be added to the hammer price in all auctions and will be charged along with the hammer prices and applicable sales tax to the credit or debit card you have on file with GES within 24 hours of the auction end.

SALES TAX: All sales are subject to appropriate sales tax laws. Tax exempt buyers must provide the appropriate state sales tax exemption certificate prior to the end of the sale. Upon receipt of such information by GES, your future purchases will not be taxed. Tax resale forms can be submitted in your membership profile. Your profile name and address must be the same as your resale certificate. (You must click the Tax Exempt Button located under the Upload Certificate Box to receive the Tax Exempt Status!) BEFORE BIDDING ONLY!

Removal of Purchased Merchandise All purchases must be paid for and removed during the scheduled pick-up time, typically the Saturday following the auction close from 10am until 2pm. (unless special arrangements are mutually agreed to prior bidding). Once the storage fee exceeds the purchase price of the items the item will be considered forfeited and no refunds will be provided and the bidder being added to our no bid list.

Default on Sale If any of the foregoing conditions or any other applicable conditions are not complied with, in addition to other remedies available to Girlfriends Estate Sales INC. and to the Consignor by law, including without limitation the right to hold the purchaser liable for the bid price, Girlfriends Estate Sales INC., at its option, may either (a) cancel the sale, retaining as liquidated damage all payments made by the purchaser or (b) resell the property on three days notice to the purchaser and for the account and risk of the purchaser, either publicly or privately, and in such event the purchaser shall be liable for the payment of any deficiency plus all costs, including warehousing, the expense of both sales, and Girlfriends Estate Sales INC. commission at its regular rates and all other charges due hereunder plus incidental damages.

Payment Information Upon the close of the online auction, title to the offered lot passes to the highest bidder who thereupon (a) assumes full risk and responsibility therefore, and (b) will pay the full purchase price therefore, or such part as Girlfriends Estate Sales INC. may require. Girlfriends Estate Sales at its sole discretion will reoffer the items or donate them to a charity of GES’s choosing. GES reserves the right to report your account to collections for the combined total of the original invoice amount and any moving or disposal charges. Your membership with GES will be revoked unless past due invoices and any additional charges are paid in full.

Shipping Information:

USPS/UPS SHIPPING: WE DO SHIP on a limited basis on orders of a combined total of $50 or more. Girlfriends will pack and ship items that will safely fit in a 16" x 13" x 13" box (small U-Haul box) sent via UPS ground or any USPS priority boxes. These items are shipped the week following the auction. All packing and shipping charges for items shipped in-house will be charged to the credit card on file and a shipping receipt with tracking will be texted or emailed to the account on file. Girlfriends will ship all items with tracking (no exceptions) and buyers will be responsible for the charge.

PLEASE NOTE: We will only ship to the select payment method's billing address. This means the address on your profile is irrelevant, the address connected to the payment method you select at registration for each auction is where the items will be sent. Be sure the card you use has the billing address where you want to receive your merchandise. Due to high amounts of fraud there is no exception to this rule. You hereby understand that if you have the items shipped to the wrong address due to not updating your billing address, it is up to you to try to recover those items, Not us! Please be careful when you register your address and we are sorry for any inconvenience. This would not have to be implemented if it was not necessary. The auction industry is experiencing a very high number of stolen credit cards and this is our way to protect ourselves and our customers. We will ask for identification on shipping orders as we do for local pick up.

All items are SOLD AS IS. Bidders are strongly encouraged to ask questions prior to bidding. While we will do our best to list any damage, repairs or condition issues, the absence of these descriptions or conditions must not be taken to imply that the lot is in perfect condition. If you choose to bid on an item that is later seized by customs, Girlfriends Estate Sales INC. is not liable for any costs or refunds.
