Terms of Sale
All property offered and sold by HAVN Auctions is sold as agent for the Consignor and is subject to the following terms. By participating in the auction, whether in person, online, absentee, or through a third-party platform, bidders agree to be bound by these Terms of Sale. Visit https://havnauctions.com/terms

1. As-Is / Final Sale
All items are sold AS-IS. All sales are final. No returns, no refunds, no exceptions.
Property is sold to the highest bidder acknowledged by the auctioneer. The auctioneer may reject any bid, reopen bidding, or withdraw any lot and reoffer it later.
Catalog descriptions, condition reports, photographs, and other statements are for guidance only and do not constitute warranties. Absence of a condition report does not imply perfect condition.
Buyers have 15 days after the auction to notify HAVN Auctions of any gross misrepresentation. Claims submitted after this period will not be accepted.
2. Bidder Responsibility
Bidders are responsible for verifying age, size, condition, description, provenance, and value of any lot before placing a bid.
HAVN Auctions provides item information as a courtesy and does not guarantee accuracy or completeness.
Bidders are fully liable for all bids. Errors, failure to complete purchases, or disputes may result in corrective action, including suspension of bidding privileges or collection measures.
3. Auctioneer Discretion
HAVN Auctions and its auctioneers have full discretion to determine the winning bidder and resolve disputes.
We may set or adjust bidding increments and accept or reject any bid.
We may postpone, cancel, or reoffer an auction or an individual lot.
Tie bids, irregular bidding, or technical issues will be resolved at the auctioneer's sole discretion.
4. How We Conduct Our Auctions
Reserve. Unless a lot is specifically marked ?No Reserve,? lots may be subject to a confidential minimum selling price (reserve).
We may open bidding below reserve and, where permitted by applicable law, place bids on behalf of the seller up to the reserve to protect that minimum.
Opening Bid. Opening bids are set by HAVN Auctions and may be changed at any time based on reserve, estimates, and bidding activity.
Receipt of Bids. Bids are time-logged by our systems. If identical bids are received, priority is generally given to the first received bid, subject to our final determination of official bid timing.
Winning Bid. The highest bid accepted by the auctioneer/system at close is the winning bid. Winning bidders must pay the full purchase price (hammer price + buyer's premium + applicable charges).
Results and Notifications. We may issue preliminary results after a sale; final results remain subject to post-sale review, verification, and correction.
5. Auction Errors
HAVN Auctions reserves the right to cancel or adjust a sale in cases including but not limited to:
Lot(s) unavailable or failing quality control.
Sale below reserve price.
Clerical, catalog, or description errors.
Technical or system malfunctions.
Suspected fraud or bidding misconduct.
6. Withdrawal
HAVN Auctions may withdraw any lot at any time before bidding begins without liability.
7. Buyer's Premium & Payment
A buyer's premium is added to the hammer (winning bid) price. The rate depends on how you participate (for example, third-party platforms vs in-house absentee). Tiered schedules for LiveAuctioneers and for in-house absentee are shown on our Absentee Bidding page; if a specific sale, catalog, or platform terms differ, those terms control for that sale.
Card and electronic processing. Payment card and certain other electronic payments incur processing costs. We pass those costs through: a 3% transaction processing fee may be added to your invoice when you pay by credit card, debit card, or similar card-based methods.
Payment is due within 3 business days of invoice unless otherwise stated. Accepted methods include cash, wire transfer, approved check, ACH, Visa, Mastercard, American Express, and Discover. Whether the 3% processing fee applies depends on the payment method used, as described above.
HAVN Auctions reserves the right to require guaranteed funds for large purchases. Unpaid accounts may be subject to legal or collection action.
8. Taxes
Applicable Washington State sales tax will be added unless a valid resale or tax exemption certificate is provided.
Online platform purchases may also be subject to marketplace tax rules.
9. Removal & Shipping
Buyers must remove lots within 10 business days unless otherwise arranged.
Shipping is at the buyer's expense. HAVN Auctions may provide a list of recommended shippers but is not responsible for loss, damage, or breakage during transit.
10. Limitation of Liability
HAVN Auctions' liability is limited to the amount paid by the buyer for the lot in question.
HAVN Auctions shall not be responsible for indirect, incidental, or consequential damages.
11. Governing Law
These terms are governed by the laws of the State of Washington. All participants consent to the jurisdiction of courts located in Seattle, Washington.
