PICKUPS: ***IMPORTANT*** Whoever is picking up your items must have the SIX LETTER CODE emailed to you from Estatesales.net or provide the last 4 Digits of the Credit or Debit Card used for the purchase to have your items released during pickups.
Please check in upon arrival and once the correct code has been provided, you will be escorted to your items. All items purchased must be completely removed from the premise by the Buyer at the Buyer’s sole expense without exception by the final pickup window; unless prior shipping or delivery arrangements have already been made. Please bring a copy of your invoice and have your code or card numbers ready to help speed up the process.

BETA OFFERING - We are offering limited personal delivery options on all none furniture or very heavy items. You must make an appointment and there is a Separate Fee for this service. Limited windows available and delivery address must be within a 100 mile radius. Minimum fee of $25 applies for the first 20 miles. Additional charges for additional mileage. Final fee based on time, mileage and any necessary materials needed to safely transport the items. If this is something you might be interested in, please email me for more information.

This Buyers Agreement (“Agreement”) is made between Sunshine’s Emporium Estate Sales and the person or entity listed on this page (“Buyer”). Buyer agrees to be bound by the terms of this Agreement with respect to all tag sales and auctions (online and in-person) conducted by Sunshine’s Emporium.
Buyer acknowledges that additional terms and conditions of this Agreement may be posted and/or announced on the website and such additional terms are deemed incorporated into this Agreement by this reference and are binding on the Buyer.

While using this site or our services, and submitting any purchase, you are signifying acceptance of the Terms and Conditions of Sunshine’s Emporium online tag sales, whether you have read the terms or not, you agree to the following:
• You will not conduct any fraudulent activities on this site or directed towards Sunshine’s Emporium.
• All items are “As-Is” with no warranties, no guarantees, expressed or implied, and sold with all faults, defects, and any accidental omissions or errors in the description.
• All Sales are Final! No Returns, Exchanges, Refunds or Chargebacks.
• Chargebacks will be handled as any other theft would be. We will report the theft to the proper authorities along with taking any necessary civil and/or criminal actions against you.
INSPECTION: Inspection for this sale will be done by online catalog of items with pictures only. Please check the photos carefully for item’s condition and make sure to ask any questions prior to purchases.
Each lot and/or item is sold “As-Is and Final,” with all faults, defects, and any accidental omissions or errors in the description. No refunds, exchanges, returns or chargebacks are allowed.
SALES TAX: All sales are subject to Georgia Sales and Use Tax. Purchases for this sale are subjected to 7% sales tax. Tax exempt buyers must provide the appropriate state sales tax exemption certificates prior to purchase. Upon validation and acceptance, your purchase will not be taxed.
PAYMENT: All payments are due immediately at time of purchase. We accept credit and debit cards. When you purchase any item(s), you irrevocably authorize us to charge your credit card the listing price, shipping costs (if applicable), plus all necessary sales tax.

***If someone other than you are planning on picking up your purchases, please make sure they give your last name and have a copy of the invoice, and any necessary codes to give to the employee at pickup.***

All items won must be completely removed from the premises by the Buyer at the Buyer’s sole expense without exception. Please bring your invoice and code to help speed up the process.
Shipping is available on certain items and will be noted in the item’s description if being offered. Otherwise, the item(s) will be available for Local Pickup Only. Please see the shipping information below for more information.
***Please note: Buyers hereby indemnify and hold harmless the Sellers and the Owners from any and all damages, claims, or liabilities from, any injuries to persons or death or property caused during the removal of items purchased or with the use of items. The buyer is solely responsible for any damage to the property caused by or during the removal of items purchased.
The majority of our sales are under strict timelines to have the items picked up and removed. Any item(s) not removed by the last pickup day and time, will be considered abandoned (Unless prior shipping arrangements have been made). There are No Refunds or Chargebacks on abandoned items.
FAILURE TO PICK UP (ABANDONED ITEMS): In the event you do not pick up your purchase during the designated dates and times (or make prior shipping arrangements), your item(s) will be considered abandoned.
You therefore agree that the failure to receive any item(s) in the event of abandonment Does Not relieve Your responsibility to pay for the item(s) or any other associated fees and applicable sales tax.
You hereby authorize Sunshine’s Emporium to charge your credit card for the purchase amount plus any fees and applicable sales tax and the buyer agrees they will not seek a refund or chargeback for any abandoned items or any other reason.
Sunshine’s Emporium, may at its absolute sole discretion: dispose, donate the items to a charity of our choice, or resell any items deemed abandoned.
PROCEDURES FOR PICK UPS:
• Please be respectful of others.
• You are responsible to bring all necessary help that may be needed to move large or heavy items. Our staff is not equipped to help move these items. Please also bring your own necessary equipment (dollies, straps, rope or blankets that may be needed to move large items), as these items will not be available at the premises.
• You are responsible to bring all necessary packing materials (boxes, totes, bubble wrap, etc.) to safely remove and transport your items.
• Wait in the designated location outside the premise until you are checked in. Once checked in, you will be escorted to your items.
• If there are any concerns about your items, please wait for the onsite lead to review and discuss your situation.
• By leaving the premise, you are stating you are ok with your items.
SHIPPING: We are not a shipping company. However, we are happy to ship small and medium items to all 50 states, if the item(s) will fit safely in Priority Flat Rate packaging. Thus, large, super heavy and very fragile items will not be shipped.
SHIPPING COSTS include handling, packing materials, postage, sales tax, full coverage insurance costs, and signature confirmation on all orders valued over $150.
We are happy to combine shipping where possible. Not all items will be able to be combined. Please email me if you are interested in combined shipping rates. Please include titles and lot numbers.
All items are shipped within 3 business days of cleared payment through the USPS using 2-3 days Priority Mail. All packages will also include tracking, and full insurance (no exceptions). You will receive an email with the tracking information once your item has shipped.
***Since all items shipped are COMPLETELY INSURED, should any damage or loss occur to the purchased items after shipped, Sunshine’s Emporium is NOT responsible. Therefore, ALL insurance claims should be handled through the carrier (USPS) directly and NOT through your credit card company.

Items are believed to be in good condition unless otherwise stated. The absence of a condition in the description does not imply the lot and/or item(s) are in perfect condition or free from wear and tear, imperfections, the effects of aging or defects.
It is the Buyers responsibility to determine exact condition of the item(s) prior to purchase. Buyer hereby waives and releases Sunshine’s Emporium and the owner from and against any claims, demands, liability, or expense of any kind arising from the lot or items within a lot.

• Buyer should carefully examine all photos before purchasing. Buyer assumes all risks associated with any nonconformity of any item or any component of any lot.
• Buyer further acknowledges that he or she is not relying upon any statements, oral or written, from representations of Sunshine’s Emporium contained in any advertisements of any type pertaining to the sale, including without limitations statements concerning condition, genuineness or authenticity, originality, origin or provenance, previous use or ownership, manufacturing or restoration processes, year or age, serial number, make, and/or model of any item or of any component of any lot.
• Sunshine’s Emporium reserves the absolute right to withdraw any item at any time from a sale.
• Sunshine’s Emporium reserves the absolute right, at its discretion, to refuse or reject any Buyer from purchasing.
