These Terms & Conditions apply to every auction conducted by 1111 Jewelry Store, L.L.C. unless different terms are announced in writing for a particular auction.

IMPORTANT SHIPPING NOTICE

NO LOCAL PICKUP. NO INTERNATIONAL SHIPPING.

All eligible purchases must be shipped exclusively through LiveAuctioneers LiveShipping to a valid domestic United States delivery address accepted by LiveShipping. Buyer-arranged shipping, third-party shipping, hand delivery, and in-person pickup are not available.

Bidders must review the available shipping quote and confirm that LiveShipping can serve their address before bidding.

Agreement and Acceptance

Please read these Terms & Conditions carefully.

By registering, placing a bid, or otherwise participating in an auction conducted by 1111 Jewelry Store, L.L.C. (?Auction Company?), whether through LiveAuctioneers or another authorized platform, each Bidder acknowledges having read, understood, and agreed to be legally bound by these Terms & Conditions.

If you do not agree, do not register or bid.

Unless otherwise disclosed, the Auction Company acts as agent for the Consignor. The Auction Company may also offer property that it owns or in which it has a financial interest when appropriately disclosed.

A binding contract of sale is formed when the Auctioneer accepts the highest qualifying bid or the bidding platform records the Lot as sold. The successful Bidder then becomes the Buyer.

Before bidding, each Bidder is responsible for reviewing the complete Lot listing and photographs, requesting additional information or a condition report when desired, and asking any questions concerning the Lot or these Terms & Conditions.

Registration

All Bidders must register and provide accurate, complete, and current identification, contact, payment, billing, and shipping information.

The Auction Company may approve, deny, suspend, or revoke registration at its reasonable discretion. The Auction Company may require government-issued identification, proof of address, payment verification, financial references, or a refundable deposit.

Registration may be refused, suspended, or cancelled when fraud, unauthorized activity, abusive conduct, threats, payment irregularities, identity concerns, or conduct detrimental to the auction is reasonably suspected.

Bidders must maintain the confidentiality and security of their accounts. Unless prohibited by law, each Bidder is responsible for bids placed through the Bidder?s account.

Bidding

Each bid is a legally binding and irrevocable offer to purchase the Lot at the amount bid, together with the Buyer?s Premium, taxes, shipping charges, and other applicable amounts.

Bidders are responsible for accidental, mistaken, duplicate, or unauthorized bids placed through their accounts. Bid retractions or cancellations are not permitted after a bid has been recognized except when required by law or expressly authorized by the Auctioneer.

The Auctioneer may:

a. Establish or modify bid increments;

b. Accept or reject any bid;

c. Determine the successful Bidder;

d. Resolve bidding disputes;

e. Reopen bidding when reasonably necessary;

f. Withdraw, combine, divide, pass, or reoffer any Lot;

g. Correct clerical, catalog, invoicing, or administrative errors; and

h. Postpone, suspend, or cancel all or part of an auction when reasonably necessary.

The Auctioneer?s decisions concerning bidding and auction administration are final to the fullest extent permitted by law. The Auction Company?s records and the platform?s electronic records shall control in the event of a bidding dispute.

The Auction Company is not responsible for missed bids, internet failures, device problems, software errors, platform interruptions, transmission delays, or other technical difficulties.

Reserve Prices

Unless expressly offered without reserve, any Lot may be subject to a confidential reserve.

A reserve is the minimum price agreed upon by the Consignor and the Auction Company below which the Lot will not be sold.

As permitted by applicable law and platform rules, the Auctioneer may open bidding or place successive bids on behalf of the Consignor up to, but never above, the reserve. Such bidding will not be used to exceed a bona fide Bidder?s maximum authorized bid.

If the reserve is not met, the Auctioneer may declare the Lot Passed, Withdrawn, or Unsold or may offer it for post-auction sale.

Buyer?s Premium and Purchase Price

A 23% Buyer?s Premium will be added to the Hammer Price of each Lot unless a different premium is announced in writing for the auction.

The Purchase Price consists of:

a. The Hammer Price;

b. The Buyer?s Premium;

c. Applicable sales tax; and

d. Shipping and any other applicable charges.

Payment

Payment is due immediately upon receipt of the invoice and no later than three calendar days after the auction closes unless the Auction Company approves different arrangements in writing.

LiveAuctioneers may automatically charge a payment method maintained on the Buyer?s account in accordance with the auction?s posted payment settings and LiveAuctioneers? then-current payment policies. By registering and bidding, the Bidder authorizes any automatic payment permitted under those policies.

The Auction Company may require payment by wire transfer, ACH, cashier?s check, certified funds, or another approved method, particularly for high-value purchases or transactions requiring additional verification.

The Buyer must promptly review the invoice and report any billing question before the applicable automatic-payment processing date.

No Lot will be released or shipped until the Purchase Price and all other required charges have been paid in full with cleared funds.

A declined payment, returned payment, unauthorized payment reversal, or improper chargeback may constitute Buyer default.

Sales Tax

Applicable sales tax will be collected unless a valid resale or exemption certificate is submitted and accepted before invoicing.

The Buyer is responsible for all taxes and governmental charges legally applicable to the transaction.

Auction Announcements and Corrections

Written or verbal announcements, corrections, supplemental information, and revised Lot information issued before or during the auction take precedence over earlier catalog descriptions, photographs, advertisements, estimates, or other published material.

The Auction Company may correct typographical, clerical, photographic, pricing, catalog, invoicing, website, or administrative errors before, during, or after the auction.

A correction does not invalidate an otherwise lawful sale except when required by applicable law.

Shipping?LiveAuctioneers LiveShipping Only

NO LOCAL PICKUP IS AVAILABLE.

NO INTERNATIONAL SHIPPING IS AVAILABLE.

All eligible Lots must be shipped exclusively through LiveAuctioneers LiveShipping to a valid domestic United States delivery address accepted by LiveShipping.

The following are not permitted:

a. Local or in-person pickup;

b. Buyer-arranged shipping;

c. Third-party shippers or couriers;

d. Hand delivery;

e. Release to the Buyer, the Buyer?s representative, or an independent carrier; and

f. Shipment to an international destination.

A Bidder located outside the United States may bid only if the Bidder provides an eligible domestic United States delivery address accepted by LiveShipping. The Auction Company will not ship internationally or release property for international forwarding.

Before bidding, each Bidder must confirm that:

a. LiveShipping is offered for the Lot;

b. The Lot is eligible for LiveShipping;

c. LiveShipping serves the intended domestic delivery address; and

d. The Bidder accepts the displayed or estimated shipping cost.

The Buyer is responsible for all LiveShipping charges and related fees. Shipping charges are calculated or administered through LiveAuctioneers and are not established or controlled by the Auction Company.

The Auction Company cannot cancel a completed sale or issue a refund merely because the Buyer considers the shipping charge too expensive.

Purchased property will not be shipped until the Purchase Price and all applicable shipping charges have been paid in full with cleared funds.

LiveShipping will determine whether multiple purchases may be combined. Combined shipping is not guaranteed.

The Buyer must provide a complete and accurate delivery address. The Buyer is responsible for additional charges, delays, or losses resulting from an incorrect, incomplete, inaccessible, or undeliverable address.

Insurance, declared-value protection, carrier selection, packaging, tracking, delivery procedures, claims, and delivery timing are governed by the applicable LiveShipping and carrier terms.

To the fullest extent permitted by law, the Auction Company is not responsible for carrier delays, failed delivery attempts, loss, theft, or damage occurring after the Lot has been transferred to the shipping provider. Shipping claims must be submitted through LiveAuctioneers or the applicable carrier or insurer.

If a Lot or destination is not eligible for LiveShipping, the Bidder should not bid. The Auction Company is not required to offer an alternative delivery method.

Inspection, Condition, and Photographs

ALL LOTS ARE SOLD ?AS IS, WHERE IS,? WITH ALL FAULTS.

Bidders are strongly encouraged to carefully examine the complete listing and all photographs, request additional information or a condition report, and ask questions before bidding.

Catalog descriptions, photographs, measurements, weights, gemstone identifications, diamond grades, precious-metal content, designer or maker attribution, provenance, age, estimates, and condition reports express the Auction Company?s good-faith opinion based on the information reasonably available. They are not warranties or guarantees.

Photographs form part of the Lot description. Color, scale, texture, and appearance may vary because of lighting, photography, monitor settings, screen resolution, or individual device displays.

The absence of a condition statement does not mean that a Lot is free from defects, wear, damage, repair, resizing, alteration, restoration, replacement stones, replacement parts, or other condition issues.

Oral statements are not binding unless confirmed in writing by the Auction Company.

Jewelry, Watches, and Luxury Goods

Unless expressly supported by an identified independent report or certificate, statements concerning gemstone identity, origin, treatment, enhancement, diamond grade, precious-metal fineness, designer attribution, authenticity, provenance, dimensions, and weight represent the Auction Company?s opinion and are not guarantees.

Gemstone weights, precious-metal weights, measurements, and grades are approximate unless expressly stated otherwise.

Estate, vintage, antique, and pre-owned jewelry may exhibit wear, repairs, resizing, restoration, replacement stones, replacement components, or alterations consistent with age and previous use.

Mechanical and battery-operated watches are not guaranteed for accuracy, water resistance, service history, power reserve, future performance, or continued operation unless the Lot description expressly states otherwise. Any statement that a watch is running refers only to its operation when examined and is not a future-performance guarantee.

Third-party certificates, reports, receipts, boxes, packaging, and accessories are included only when expressly stated in the Lot description. The Auction Company does not independently guarantee information supplied by third parties.

Nothing in this section limits any non-waivable legal right or mandatory protection provided by the bidding platform.

Estimates

Auction estimates and replacement-value estimates are opinions provided for general guidance only.

An estimate is not a representation or guarantee of market value, retail value, replacement cost, resale value, or the price the Lot will achieve.

The Hammer Price may fall below, within, or above the published estimate.

All Sales Final

ALL SALES ARE FINAL.

Except when required by applicable law, a mandatory platform policy, or express written approval from the Auction Company, no returns, refunds, exchanges, cancellations, credits, or price adjustments will be permitted.

A Buyer?s failure to inspect the Lot, review photographs, request information, understand the shipping charges, or read these Terms & Conditions does not provide grounds for cancelling the sale.

Compliance With Laws

The Buyer is responsible for complying with all applicable federal, state, and local laws concerning the purchase, possession, transportation, resale, or use of a Lot.

The inability to obtain a permit, license, approval, or shipping authorization does not relieve the Buyer of the obligation to complete the purchase.

Buyer Default

A Buyer is in default if the Buyer fails to make timely payment, provides false information, initiates an improper payment reversal or chargeback, refuses authorized delivery, or otherwise violates these Terms & Conditions.

Subject to applicable law, the Auction Company may:

a. Process an authorized payment through LiveAuctioneers;

b. Cancel the sale;

c. Resell the Lot publicly or privately;

d. Hold the Buyer responsible for the Purchase Price, any resale deficiency, Buyer?s Premium, collection expenses, reasonable attorney?s fees, court costs, interest where permitted, and other legally recoverable damages;

e. Retain payments already received where legally permitted;

f. Withhold or delay shipment;

g. Suspend or permanently revoke bidding privileges;

h. Report the default to LiveAuctioneers or another bidding platform;

i. Offset amounts owed against funds otherwise payable to the Buyer where permitted by law; and

j. Exercise any other available legal or equitable remedy.

The Buyer remains responsible for the unpaid Purchase Price until the balance has been paid or the Lot has been resold and all resulting obligations have been satisfied.

The Auction Company may delay shipment, cancel a transaction, or withhold a Lot while investigating suspected fraud, unauthorized activity, identity-verification concerns, payment irregularities, or chargebacks.

Limitation of Liability

To the fullest extent permitted by applicable law, the Auction Company, Auctioneer, Consignor, and their respective owners, officers, employees, representatives, contractors, and agents will not be liable for indirect, incidental, consequential, special, exemplary, or punitive damages arising from the auction or from the purchase, shipment, possession, or use of a Lot.

Nothing in these Terms & Conditions excludes or limits liability that cannot legally be excluded or limited.

Privacy and Electronic Communications

Bidder information may be collected and used for registration, identity verification, payment processing, shipping, fraud prevention, legal compliance, auction administration, customer service, and protection of the Auction Company?s legal rights.

Information may be shared with LiveAuctioneers, payment processors, shipping providers, insurers, professional advisers, government authorities, and other parties when reasonably necessary to administer the transaction or comply with law.

By registering, each Bidder consents to receive invoices, payment reminders, notices, and other auction-related communications electronically.

Electronic registration, bidding, invoices, notices, signatures, and acceptance of these Terms & Conditions have the same effect as paper records to the extent permitted by law.

Force Majeure and Technology Failures

The Auction Company is not responsible for a delay, interruption, cancellation, or failure to perform caused by circumstances beyond its reasonable control, including severe weather, fire, flood, natural disaster, war, terrorism, civil disturbance, labor dispute, governmental action, public-health emergency, internet outage, power failure, cyber incident, platform malfunction, carrier delay, or other similar event.

The Auction Company may postpone, suspend, reschedule, or cancel an auction or affected transaction when reasonably necessary because of such an event.

Governing Law and Venue

These Terms & Conditions and every transaction arising from an auction conducted by the Auction Company will be governed by the laws of the State of Alabama, without regard to conflict-of-law principles.

Any legal action arising from these Terms & Conditions or an auction conducted by the Auction Company must be filed in a court of competent jurisdiction located in Alabama, unless applicable law requires otherwise.

Severability, No Waiver, and Assignment

If any provision is determined to be invalid, illegal, or unenforceable, that provision will be enforced to the maximum extent permitted, and the remaining provisions will remain effective.

The Auction Company?s failure to enforce a provision on one occasion does not waive its right to enforce that provision later.

The Buyer may not assign or transfer a purchase or any obligation under these Terms & Conditions without the Auction Company?s prior written consent.

Entire Agreement

These Terms & Conditions, the Lot listing, auction announcements, written corrections, invoice, bidder-registration information, and applicable platform terms constitute the agreement governing the transaction.

If information conflicts, a specific written auction announcement or correction controls over earlier general information, subject to applicable law and mandatory platform rules.

No oral statement modifies these Terms & Conditions unless confirmed in writing by the Auction Company.

Interpretation

Section headings are provided for convenience and do not control interpretation.

Unless context requires otherwise, singular words include the plural, plural words include the singular, and references to a person include an individual or legal entity.

Definitions

Auction Company means 1111 Jewelry Store, L.L.C.

Auctioneer means the licensed auctioneer conducting or administering the sale for the Auction Company.

Bidder means any individual or entity that registers, participates, or places a bid.

Buyer means the successful Bidder after the highest qualifying bid has been accepted or the Lot has been recorded as sold.

Consignor means the owner or authorized seller of property entrusted to the Auction Company for sale.

Hammer Price means the highest accepted bid for the Lot, excluding the Buyer?s Premium, taxes, shipping, and other charges.

LiveShipping means the shipping service offered or administered through LiveAuctioneers.

Lot means an item or group of items offered for sale under one lot number.

Purchase Price means the Hammer Price, Buyer?s Premium, applicable taxes, shipping charges, and every other amount due from the Buyer.

Acceptance

By registering, bidding, or otherwise participating in the auction, each Bidder confirms having read, understood, and accepted these Terms & Conditions in their entirety.
