ACCADIA ESTATE SALES
TERMS & CONDITIONS
These Terms & Conditions (“Agreement”) govern all estate sale services conducted by Accadia Estate Sales (“Accadia,” “we,” “us,” or “our”) for a client (“Client”) and all purchases made by buyers (“Buyers”) at any estate sale managed by Accadia.

PART I – TERMS & CONDITIONS FOR CLIENTS (ESTATE OWNERS / REPRESENTATIVES)
1. Scope of Services
Accadia agrees to organize, market, and conduct an estate sale of the personal property located at the Client’s designated premises (“Property”). Services may include staging, pricing, advertising, staffing, conducting sales, and post-sale cleanup as agreed in writing.
2. Ownership & Authority
Client represents and warrants that they are the legal owner of the property being sold or have full authority to sell it. Client agrees to indemnify and hold Accadia harmless from any claims related to ownership disputes.
3. Commission & Fees
• Accadia shall receive a commission of 25% of gross sales, unless otherwise agreed in writing.
• Any additional fees (e.g., hauling, disposal, cleaning, specialty appraisals) will be disclosed in advance.
• Commission is earned upon completion of the sale and is non-refundable.
4. Payment to Client
• Client proceeds will be paid within 5 days after completion of the sale and reconciliation of payments.
• Accadia may withhold funds to cover returned payments, chargebacks, or unresolved disputes.
5. Removal of Items
• Client agrees not to remove, sell, or give away items once the sale preparation begins without Accadia’s written consent.
• Any unauthorized removal may result in termination of this Agreement and forfeiture of commission.
6. Unsold Items
At the conclusion of the sale, Client must select one or more of the following options:
• Donate unsold items
• Retain unsold items
• Dispose of unsold items (fees may apply)
Accadia is not responsible for items left behind after the agreed removal date.
7. Liability & Insurance
• Accadia carries general liability insurance.
• Accadia is not responsible for loss due to fire, theft, vandalism, weather, or acts beyond reasonable control.
• Client agrees not to hold Accadia liable for ordinary wear, minor damage, or breakage during the sale.
8. Cancellatio
• Client cancellation after preparation has begun may result in a cancellation fee and reimbursement of incurred expenses.
• Cancellation within 5 days of the scheduled sale date may result in full commission being due.
9. Indemnification
Client agrees to indemnify and hold Accadia harmless from any claims, damages, or expenses arising from Client’s breach of this Agreement or misrepresentation of authority.

PART II – TERMS & CONDITIONS FOR BUYERS
10. All Sales Are Final
• ALL SALES ARE FINAL.
• No refunds, returns, or exchanges for any reason.
• Items are sold AS IS, WHERE IS, with no warranties expressed or implied.
11. Inspection Responsibility
Buyers are responsible for inspecting items prior to purchase. Accadia makes no guarantees regarding authenticity, condition, functionality, age, or value.
12. Payment Methods
Accepted payment methods may include:
• Cash
• Approved digital payments (e.g., Zelle, Venmo, etc.)
Accadia reserves the right to refuse any payment method.
13. Non-Payment & Payment Reversal Penalties
• Failure to complete payment results in immediate forfeiture of the item.
• Returned checks, chargebacks, reversed digital payments, or declined transactions will incur:
o A minimum $50 administrative fee, or the maximum allowed by law
o Full recovery of the item or its retail value
o Possible civil action for collection costs, attorney fees, and damages
Accadia reserves the right to ban Buyers who fail to honor payment obligations from future sales and will be reported and blacklisted on various auction estate sales websites.
14. Item Removal
• Buyers must remove items by the deadline announced at the sale.
• Large items may require scheduled pickup.
• Items not removed by the deadline may be considered abandoned with no refund.
15. Damage & Liability
• Buyers are responsible for any damage they cause to the Property or other items.
• Accadia is not responsible for injuries, accidents, or damages incurred during the sale.
• Buyers enter the Property at their own risk.
16. Conduct & Safety
• Accadia reserves the right to refuse service or remove any individual for unsafe, disruptive, or inappropriate behavior.
• Children must be supervised at all times.
17. Theft & Fraud
• Theft, tag switching, or payment fraud will result in immediate removal and possible prosecution.
• Accadia cooperates fully with law enforcement.

PART III – GENERAL PROVISIONS
18. Right to Refuse Service
Accadia reserves the right to refuse service to any Client or Buyer at its sole discretion.
19. Governing Law
This Agreement shall be governed by and construed in accordance with the laws of the state in which the estate sale occurs.
20. Severability
If any provision of this Agreement is found unenforceable, the remaining provisions shall remain in full force and effect.
21. Entire Agreement
These Terms & Conditions constitute the entire agreement between the parties and supersede all prior discussions or representations.
