ONLINE AUCTION TERMS: Visa, MC or Discover -13% Buyer's Premium

Acceptance of Terms: Buyers registering for and placing bids online agree to the following Terms of Sale.
BY PLACING A BID YOU AGREE TO ALL OF THE FOLLOWING TERMS AND CONDITIONS:

Before you place your first bid, YOU MUST accept the Terms & Conditions to which you agree when you check the box to register, and place your first bid:

*** NEW: Effective Sept. 13th, 2023 prior to transfer a firearm, rifle, shotgun or ammunition to a purchaser you MUST go through NYS to complete the background check process.

** $9.00 per firearm transaction

** 2.50 per ammunition transaction

If you purchase a firearm and ammunition on one invoice you will be charged $11.50 via NYS.

* These charges will be added on your invoice as a line item and you will be charged when we run your credit card at the end of the auction to NYS Buyers ONLY.

* If you are an out-of-state buyer who is picking up a firearm or ammunition you MUST have CASH for the NYS NICS fees

* If you a NYS resident that request shipping and have been charged the line item charge we will take that off of your shipping/handling for this auction.

Auction info and terms:

* Bidding Ends: Saturday, December 2nd starting at 10:00 am

* Extended Bidding: This is a timed auction with a staggered closing. Starting at 10 am, each item will close with 20 seconds between each lot. If a bid is placed within the last 3 minutes of the closing the item will automatically extend for an additional 2 minutes.

Preview In Person: 2:00 -5:00 pm Friday, Dec. 1st at Hessney Auction Center

* You are able to view any items in person before placing a bid, you can also email or call with any specific questions on items before Friday DEC 1st- we can provide any other photos needed.

- PAYMENT: We will run the Credit Card you register with after the completion of the auction.

CASH, NYS CHECK, CERTIFIED CHECK OR WIRE transfer is available if you request to pay this way BEFORE SATURDAY December 2nd - NOTE* Buyers premium is 13% regardless of payment type.

* ALL Vehicles require payment by certified funds: wire transfer, Certified bank check/ cashier check.

* All buyers will be charged 13% buyers premium regardless of payment type. and 7.5% NYS sales tax if you are a NY buyer. If you are tax exempt you must send us a copy of your resale certificate PRIOR to auction closing, once cards are ran we cannot refund sales tax.

PICK UP: Please respect dates and times of pick up days:

Monday, 9:30-5:00 pm, Tuesday 12:00 - 7:00 pm, and Wednesday 9:30- 5:00 pm

ALL FIREARMS/AMMO - by Appointments only. You will be emailed a sign up link with your invoice after the close of the entire auction.

ALL ACESSORIES: No appointment is needed.

PLEASE BE AWARE OF STATE LAWS AND UNDERSTAND BEFORE PLACING BIDS:

Any firearm/ items that you bid on and are unable to have you are still subject to pay for, it is up to the buyer to read all terms and be responsible for all payments and passing a background check, If you cannot have the item due to laws or due to a denied background check you can re-consign to a future auction for 25% commission.

** Semi-Auto Rifles: Any purchase of a semi-auto rifle in NYS requires a permit, please call your specific county for more information. Out of state residents purchasing a semi-auto rifle, we can ship to an FFL in your state, however you cannot pick up in person in NY without this permit,

BY PLACING A BID YOU AGREE TO ALL OF THE FOLLOWING TERMS AND CONDITIONS:

These show up to you as a buyer on your screen and you must click "YES I ACCEPT" before you can bid on any item in the auction.

** If your county requires special paperwork (ex. Monroe), please send an email requesting the pistol paperwork 24 hours notice required!

SHIPPING/ PACKING :

** We do try our best to get all packages out in a timely manner, but with everything going on in the world right now, the USPS is experiencing delays. We are asking our customers to please allow an additional 10-15 business days (this does NOT include weekends or holidays) for shipping/tracking updates.

SHIPPING INSURANCE: Hessney Auction Company ships via USPS and UPS with Insurance on items over $100 at the cost of the buyer through the outside company Shipping Saint. If your item(s) are lost/damaged, all claims MUST be made through Hessney Auction Company within 30 days of shipment. If a claim is made independently of Hessney Auction Company, all insurance is voided, and we cannot make an additional claim on your behalf. If a claim must be made please email us and we will provide you with a detailed list of what must be included in order for us to submit it to our carrier/Insurance.

*PLEASE NOTE Insurance ONLY COVERS THE PURCHASE PRICE: this is a term directly from our companies insurance. Coins can not be shipped with insurance. THIS IS ALL WE can provide for insurance, and this is directly the terms of Shipping Saint, our shipping providor. This is your choice as a buyer if purchasing from out of the area and needing shipping.

Auctioneer’s Limitation of Liability for Transit Services: Buyer understands and agrees that Auctioneer’s liability for loss of or damage to the items, if any, ends when the items have been delivered to the Secure Location, and Auctioneer has received evidence of delivery. Any claim that property has sustained loss or damage during transit must be reported to Auctioneer within seventy-two (72) hours of the delivery date. Under no circumstances is Auctioneer liable for consequential orpunitive damages.

* SHIPMENTS must be sent to the billing address of the card holder or the FFL Dealer address on license,

* If you fail your background check you will NOT get a refund, you can consign it to a future auction.

*NOTE: New York State law requires that a National Instant Criminal Background Check must be completed prior to all firearm sales or transfers, including sales or transfers of rifles or shotguns. The sale of transfer of a firearm, rifle or shotgun at a gun auction without first conducting a Background Check is a crime.

** If you are tax exempt you MUST notify us prior to the close of the auction, along with a copy of the form, if not you will be charged tax. We cannot remove tax once the card has been processed.

If you would like your items shipped please contact our office as soon as possible with shipping information, including your FFL (If required) Any item deemed to large to ship in house will be brought to the UPS Store at your expense.

All Ammo is shipped via UPS - no Ammo can be shipped to a NYS resident but can be shipped to an FFL near you.

* We do NOT ship powder or primers or mounts

Everything is sold AS IS. WHERE IS. All Sales are Final- No Returns.

Hessney Auction Co. provides ample opportunity for buyers to thoroughly inspect goods to be sold. All purchases should be made on the buyer's own recognizance. All persons bidding in absentee who have not physically inspected the goods prior to the sale are also subjected to these terms. All lots are sold "As is". There are no warranties expressed or implied, including, but not limited to warranties of merchantability or fitness for a particular purpose. Hessney Auction Co. and consigners make no guarantee or warranty as to the authenticity of the merchandise, the correctness of the catalog, nor shall any description (oral or written) of condition, size, quality, rarity, importance or provenance be deemed a guarantee.

* Condition is listed with obvious flaws, or noted if firearm are new, unfired in box. "As New" does not mean "New" it is a condition report, meaning the firearm is "as new condition". If a firearm is brand new- unfired, it will be listed as so.

* Box Lot Ammo- Please be sure to review photos & full descriptions for box lot ammo, all is sold as is. In person preview is available. Box lot ammo may contain mixed, partial or full boxes and is sold as is. The lot descriptions are meant merely as a guide and we do not guarantee the counts or descriptions described therein. We make every effort to accurately describe all items, but there is the possibility of error. Hessney Auction Company is not responsible for any errors or omissions in the description of merchandise. Buyers Premium:

All sales are subject to a Buyer's Premium; reference to the buyer's premium is made in auction advertisments, flyers and catalogs. Buyer's premium will be a stated percentage and must be paid by the buyer as part of the purchase price.

* This is a public auction and not a retail setting. All sales are final. No returns or chargebacks are accepted.

* NO CHARGEBACKS< You agree to all terms & conditions when registering and placing all bids. It is the buyer responsibility to pick up or set up shipments.

* Some items may be sold per peice. The bid price is multiplied by the amount of items in the lot. This is shown on the catalog using the bid price x quantity. (Example "$12.50 x 4" equals a total bid of $50.00)
